The Kent School District altered the amendment form provided by the City of Kent and signed off on it. While the content is not as presented to the school, the final dollar amount is accurate. Since these services have already been provided and the final dollar amount noted as owed to the City is accurate, this form is fine to sign off on so this contract can be closed out and the City reimbursed by the school district. KPD is working to negotiate a new contract for the 2020-2021 school year and beyond. PD16-378 AMENDMENT NO, 3 TO POLICE SERVICES AGREEMENT Between the Kent Police Department and the Kent School District 2fJL9 - 2020 THIS AMENDMENT NO. 3 TO THE POLICE SERVICES AGREEMENT (hereinafter "Amendment No. 3") is made and entered into by and between the City of Kent and the Kent Police Department (hereinafter referred to collectively as the "Department"), and the Kent School District (hereinafter referred to as the "District") for the provision of school safety liaison services. I. RECITALS 1,1 The parties entered into the Police Services Agreement on November 22, 20L6, (hereinafter "Agreement"), wherein the Department agreed to provide a commissioned police officer, holding the rank of Commander or higher, to assist with communication and logistics between the District and the Department on issues relating to school safety. t.2 The Agreement provided for an initial one-year term, expiring on August 3L,2OL7, and authorized up to three (3) successive one-year terms thereafter upon the mutual agreement of the Department and the District' 1.3 The first and second options were exercised through prior amendments to extend the Agreement through August 31, 2019. Through this Amendment No. 3, the parties wish to exercise the third option and extend the Agreement through August 3I, 2020, and to ratify all acts consistent with terms of this Amendment No. 3 and prior to its effective date. NOW, THEREFORE, and in consideration of the mutual promises set forth herein, the parties mutually agree as follows: II. AGREEMENT 2.L TERM EXTENSION. The Second Amendment to the Agreement expired on its own terms on August 31, 2019. The parties have mutually agreed to exercise the third and final option to extend the Agreement for an additional one-year term. The Agreement is hereby ratified, renewed and reinstated. The term of the Agreement is hereby extended through August 3I,2020. All acts consistent with the authority of the Agreement and prior to the effective date of this Amendment No. 3 are hereby ratified and affirmed, and all terms of the Agreement and this Amendment No. 3 shall be deemed to have applied. AMENDMENT NO. 3 TO POLICE SERVICES AGREEMENT - 1 (2019 - 2020 School Year) 2.2 CONSIDERATION. The total compensation due from the District for the services provided under the Agreement and this Amendment No. 3, for the time period of September 1, 20L9, through August 3L, 2020, is $53,167,25 as set forth in the attached and incorporated Attachment A-1. 2.3 REMAINING PROVISIONS. Except as specifically amended by this Amendment No, 3, all remaining provisions of the Agreement shall remain in full force and effect. IN WITNESS, the parties have executed this Amendment No. 3, which shall become effective on the last date executed below. Watts, Superintendent Date AMENDMENT NO. 3 TO POLICE SERVICES AGREEMENT - 2 (2019 - 2020 School Year) Dana Ralph, Mayor Date 04/23/2021 ATTACHMENT 4.1 TO POLICE SERVICES AGREEMENT The parties agree that the total cost to the Department to provide a School Safety Services Liaison with a law enforcement officer who is employed by the Department and holds the rank of Commander or higher to the District in accordance with the terms of the Agreement and Amendment No. 3 is $212,669.48, regardless of actual salary or benefit adjustments that may be made by the Department for the Commander. The District's reimbursement obligation, which is twenty-five percent (25olo) of the total cost to the Department for the Liaison provided to the District, equals $53,L67.25. This sum will be considered the District's total reimbursement obligation for the Liaison provided by the Department for the duration of the performance period of this Agreement, regardless of actual salary or benefit adjustments that may be made by the Department for its officer the rank of Commander or higher. The District shall pay said reimbursement in twelve (12) approximately equal monthly payments spread over a one-year period starting September 1, 2019, with each payment being made upon submission by the Department of a monthly invoice; provided, in the event this Amendment No. 3 is executed after the term under this Amendment No. 3 begins, the District shall pay the total compensation as set forth in this Attachment, but will have fewer months to make such payments.
