ECONOMIC & COMMUNITY DEVELOPMENT Ben Wolters, Director Phone: 253-856-5454 Fax: 253-856-6454 220 Fourth Avenue South Kent, WA 98032-5895 February 3, 2016 TO: Chair Randall Smith and Land Use & Planning Board Members FROM: Hayley Bonsteel, Long Range Planner & GIS Coordinator RE: Opiate Substitution Treatment Facilities [ZCA-2016-3] For February 8, 2016 Workshop SUMMARY: State law places responsibility for the regulation of opiate substitution treatment facilities under the jurisdiction of the State Department of Social and Health Services, which may only certify those facilities that are located in accordance with local land use ordinances. Given that opiate substitution treatment facilities are not currently defined or addressed in Kent’s zoning code, Planning staff is seeking Board authorization to develop zoning code amendments that pertain to the location and operation of opiate substitution treatment facilities. BACKGROUND: Opiate substitution treatment services include dispensing opioid agonist treatment medications that are used in the treatment of opiate dependency and administered by licensed opiate substitution facilities, and providing other medical and rehabilitative services such as counseling. The goal of opiate substitution treatment is total abstinence from chemical dependency for the individuals who participate in the treatment program, but some persons may require treatment over an extended period of time, and the opiate substitution medications themselves can be addictive. Opiate substitution treatment facilities present the potential for increased land use impacts such as loitering, litter, property damage or other crime, as recognized by the industry itself. However, the few existing studies conducted through peer-reviewed research have not conclusively established direct evidence linking opiate substitution treatment facilities to an increased incidence of crime in the areas immediately surrounding the facilities. Because the State has explicitly passed legislation to control the operation of opiate substitution treatment services, and has declared that cities may require conditional or special use permits with reasonable conditions for the siting of opiate substitution treatment facilities, Planning staff is developing a proposal to amend the Kent City Code to include a new use category for opiate substitution treatment facilities (including a new definition that would reflect state law), and identify processes, locations and parameters under which they may be allowed. Staff will be available at the February 8, 2016, workshop to introduce the project and answer questions.
