April Delchamps, Senior Transportation Planner gave an update on the Non-
Motorized Transportation Plan she presented slides of two non-motorized
projects and two multimodal projects that received grant funding.

development of the draft non-motorized projects list and the draft
prioritization criterion.
6.Freight Mobility Strategic Investment Board Update - Info Only
Tim LaPorte, Public Works Director, attended the Freight Mobility Strategic
Investment Board (FMSIB) meeting in Walla Walla on Friday, September 21.
His presentation to the board included the status of our current South 228th
Street Grade Separation Project, as well as other freight related issues in
Kent.
7.Bridges - Info Only
Bill Thomas, Street and Vegetation Manager gave an update on the city’s
bridge inventory, inspection and maintenance program.
8.Quiet Zone - Info Only
Chad Bieren, Deputy Public Works Director / City Engineer gave a status
update of the Quiet Zone.
·Both the Burlington Northern Santa Fe (BNSF) and Union Pacific Railroad
(UPRR) Notices of Intent are in their 60-day comment periods. The BNSF
comment period ends on October 17, 2018. The UPRR comment period ends
on November 10, 2018.
·BNSF has blocked access to their property between Gowe St and Titus St to
remove illegal parking. This action was identified in the Quiet Zone
Diagnostic as an action item for the Quiet Zone establishment.
ADDED ITEM: Information Only/Sound Transit Parking Garage
Danielle Butsick, Long Range Planner noted that the parking plan that Sound
Transit has proposed, is inadequate and does not address additional capacity.
Butsick asked committee members if they want staff to continue pushing
back the plan that has been laid out. The desire from committee members is
to continue pushing back.

SUBJECT: Lifeline Rates
MOTION: Move to recommend Council authorize the Mayor to amend
section 7.01.080 of the Kent City Code, entitled “Lifeline Utility Rate,” to
clarify that Consumer Price Index (CPI) increases do not apply to lifeline
utility rates, subject to final terms and conditions acceptable to the City
Attorney and Public Works Director.
SUMMARY: The lifeline program provides reduced utility rates to those individuals
who qualify for the program. The purpose of this ordinance is to exempt those
rates from the annual rate increases that have automatically been structured, by
ordinance, based on the increase in the CPI.

ORDINANCE NO.
AN ORDINANCE of the City Council of the
City of Kent, Washington, amending Section
7.01.080 of the Kent City Code, entitled “Lifeline
utility rate,” to clarify that CPI increases do not
apply to lifeline utility rates.
RECITALS
A. In 1982, the city established eligibility requirements for the
city’s lifeline utility rate in Resolution No. 980, reducing the standard
water, sewer, solid waste and storm utility rates for individuals at least 62
years of age, or permanently and totally disabled, and meeting certain
income requirements.
B. In 2005, the eligibility requirements for the lifeline utility rate
were codified within the Kent City Code.
C. The lifeline utility rates are not subject to rate increases
based upon the Consumer Price Index (CPI), specifically the CPI-W
Seattle-Tacoma-Bremerton.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:

ORDINANCE
SECTION 1. - Amendment. Section 7.01.080 of the Kent City
Code, entitled “Lifeline utility rate,” is hereby amended as follows:
Sec. 7.01.080. Lifeline utility rate.
A. The lifeline utility rate is available only to utility customers qualifying
under the following criteria:
A. 1. The utility account shall be in the name of the individual
owner or renter certifying eligibility for the lifeline utility rate.
B. 2. That individual shall be or exceed sixty-two (62) years of age
at the time of filing or be permanently and totally disabled.
C. 3. For a household of one (1) or more individuals, the adjusted
gross personal income for all individuals living in the household, as
determined by Internal Revenue Service individual tax forms filed for the
previous year, shall not exceed the income limits set annually by the
federal Department of Housing and Urban Development (“HUD”)
concerning eligibility for HUD assisted housing programs.
D. 4. Only one (1) service charge reduction per utility will be given
for each applicant and for each property served.
E. 5. The service under which the lifeline utility rate is assessed
shall be for single-family residential purposes only.
F. 6. Individuals must apply for the lifeline utility rate through the
customer services division of the city’s finance department located at the

Centennial Center, 400 West Gowe St., Kent, Washington. The application
must be notarized and may be required to be submitted annually.
GB. Determination of eligibility shall be made by the city’s finance
director, or his or her designee, based upon the information given in the
eligible customer’s application.
HC. Upon approval of the application, the household will receive the
reduced utility rate for water, sewer, solid waste, and storm utilities
beginning the first day of the month following the date of the application.
Any reduced utility rate received pursuant to this section 7.01.080 shall
not be subject to a rate increase based upon the Consumer Price Index
(CPI).
SECTION 2. – Severability. If any one or more section, subsection,
or sentence of this ordinance is held to be unconstitutional or invalid, such
decision shall not affect the validity of the remaining portion of this
ordinance and the same shall remain in full force and effect.
SECTION 3. – Corrections by City Clerk or Code Reviser. Upon
approval of the city attorney, the city clerk and the code reviser are
authorized to make necessary corrections to this ordinance, including the
correction of clerical errors; ordinance, section, or subsection numbering;
or references to other local, state, or federal laws, codes, rules, or
regulations.
SECTION 4. – Effective Date. This ordinance shall take effect and
be in force thirty days from and after its passage, as provided by law.

SUBJECT: Downey and Naden Clearing and Grading Change Order
MOTION: Move to recommend Council authorize the Mayor to sign a change
order in the amount of $792,369 for the Downey and Naden Clearing and
Grading Project, subject to approval of the language therein by the City
Attorney and Public Works Director.
SUMMARY: The latest phase of the Downey Farmstead Restoration project is
currently under construction with clearing of the site and excavation of material
paid for via grants. The contract for this work was awarded to Scarsella Brothers,
Inc. in July.
The King County Flood Control District has approved another $780,000 in grant
funds for the Downey Farmstead project with funding now available. Staff is
recommending a change order to the existing contract that would allow us to move
more material from the Downey Farmstead site using this grant which would also
advance the project further towards completion. The excavated material would be
exported to the City owned Naden Avenue property in preparation for selling that
site for future development.
There is some additional site preparation activity that would be required at the
Naden site to accommodate the larger amount of fill material. This work would be
required to be paid from the City’s general fund.
The total Change Order amount is $792,369. $759,466 would be funded by the
King County Flood Control District grant funds, and $32,903 would be funded by
the City’s General Fund.
The City advertised the Downey Farmstead project for competitive bids and
received favorable prices for the work. Staff would like recommendation for
approval from the Committee on executing a Change Order to have Scarsella
Brothers complete additional excavation to haul the material to the Naden Avenue
site; up to the $780,000 grant amount award. This also maximizes the
marketability of the Naden site.

BUDGET IMPACT: Additional work on the Downey site would be completed using
the $780,000 Cooperative Watershed Management Grant. Preparation work on the
Naden site would be completed using the city’s General Fund.

In accordance with Sections L-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above,

The Dow ney excavation is part of a habitat enhancement project to create a new Green River
side channel. King County Flood Control District has made available additional King County
Cooperative Watershed Management Grant in the amount of $780,000 to performing thís

SUMMARY:
Fall TeamUp2CleanUp was held Saturday, September 15, 2018 from 9:00 a.m. -
Noon. Once again we partnered with the Kent Downtown Partnership, Kent Station,
The Golden Steer Restaurant, The Doorman Services and Republic Services. 124
residents totaled 403 volunteer hours and removed 128 bags of trash and debris off
our streets and trails and out of our parks and neighborhoods helping us keep Kent
beautiful.
Fall Recycling Collection Event will be held Saturday, October 20 at Hogan Park
from 9:00 a.m. to 3:00 p.m. Residents of Kent and King County can bring in their
hard to recycle items such as: mattresses, documents for shredding, scrap metal,
concrete, appliances, Styrofoam and more. This event is funded by the King
County Waste Reduction & Recycling Grant and the Local Hazardous Waste
Management Program Grant.

SUMMARY: Both the BNSF and UPRR Notices of Intent are in their 60-day
comment periods. The BNSF comment period ends on October 25, 2018. This date
was previously reported incorrectly as October 17, 2018. The UPRR comment
period ends on November 10, 2018.
