Call to Order The meeting was called to order at 7:05 p.m. with Mayor Ralph presiding. 2. Roll Call Mayor Ralph - Present Council President Boyce - Present Brenda Fincher, Councilmember - Present Dennis Higgins, Councilmember - Present Satwinder Kaur, Councilmember - Present Marli Larimer, Councilmember - Present Les Thomas, Councilmember - Present Toni Troutner, Councilmember - Present 3. Changes to the Agenda Chief Administrative Officer, Derek Matheson added 9A to other business regarding lodging tax business leisure tourism promotion grants. Boyce moved to approve the agenda as amended, seconded by Thomas. The motion passed unanimously with a vote ol 7-O. 4. PublicCommunications Mayor Ralph expressed her appreciation of Dick's Drive-in's donation of burgers today to employees, Ralph is grateful for Dick's partnership with the City and indicated the grand opening is December L2, 2018, with a ribbon cutting scheduled between 10 and 11 a.m. Public Recognition Mayor Ralph expressed condolences to the City of SeaTac over the loss of SeaTac Councilmember Amina Ahmed's this past weekend as a result of the injuries she suffered during an auto collision. Fincher and Kaur expressed words of appreciation for Amina Ahmend. Employee of the Month Mayor Ralph recognized Amy Waters as the December employee of the month, Brennan Taylor, Development Engineering Manager, recognized Amy for her work and provided examples of how Amy exemplifies the City's core values. Approved January L5, 2019 Proclamation for Lea Bishop Day Mayor Ralph presented Emerson Bishop with the proclamation for Lea Bishop Day. Lori Hogan, Recreation and Cultural Superintendent, expressed words of appreciation for Lea. Lea's husband, Emerson Bishop accepted the proclamation and spoke regarding Lea and her contributions to the City of Kent. Proclamation for Chief Ed Crawford Day Mayor Ralph presented Chief Padilla with the proclamation for Chief Ed Crawford Day. Chief Padilla expressed his appreciation of Chief Crawford and indicated he will follow up with details on the memorial service. Historical Society Presentation - How Electricity Came to Kent Matheson advised that he will coordinate rescheduling this presentation to a future meeting. Community Events Council President Boyce reviewed past and upcoming events at the accesso ShoWare Center, Troutner advised of upcoming Spotlight Series events. Councilmember Thomas, expressed his appreciation of the councilmembers and their support of him during his recent absence. 5. Reports from Council and Staff Derek Matheson, Chief Administrative Officer Matheson advised that the 20L9 City Council Strategic Planning Retreat has been scheduled for February L,2OL9 from 1 - 5 p.m. with lunch from L2 - 1 p,m., and February 2,20L9, from 8 a.m, - 5 p.m.The retreat will be held at the Lake Wilderness Lodge. Jim Reed will facilitate the retreat. Matheson advised his written report is in today's agenda packet and there is an executive session tonight regarding potential litigation as well as collective bargaining and expected to last 30 minutes with no action anticipated when the Council reconvenes into open session, Mayor Ralph Mayor Ralph provided details regarding her recent "Coffee with the Mayor" event at the Kent Senior Center. The next event will be held in February during the evening. Ralph indicated she has been meeting with the legislative delegation in anticipation of the session that begins in January. The City's top priority is getting streamline sales tax mitigation payments reinstated. Page 2 of 7 Kent City Council Regular Meeting Minutes December 11, 2018 Kent, Washington Approved January 15, 2019 Ralph expressed her appreciation of the Parks Department's continued support of putting on the Christmas Rush 5 and 10k, Ralph provided a recap of the 5th annual Shop with a Cop event, and the Game of Life conference. Mayor Ralph attended the I-405/L67 elected leadership group meeting and indicated the fly over HOV ramp at I-405 to 167 is 6 months ahead of schedule. Council President Boyce Boyce provided a brief review of the two presentations from tonight's workshop regarding the Kent Geo Portal and an update on the 228th/224th Street Corridor. Councilmember Higgins Councilmember Higgins is the Chair of the Public Works Committee, reviewed information regarding the 5G wireless cell franchise with Cingular (AT&T) that the committee recommended move onto the full council. Higgins advised the committee heard a presentation on plastic bag waste and indicated that the committee will wait for the outcome of a bill that is currently in the state legislature regarding plastic bags before taking action. Councilmember Troutner Troutner serves on the Sound Cities Association Regional Law, Safety and Justice Committee that will meet on January 24,2OL9. Councilmember Fincher Fincher serves on the Arts Commission and advised that the Spotlight Series program is now available. Fincher serves on the Sound Cities Association King Conservation District Advisory Committee that is working on their program of work. Councilmember Thomas Thomas serves on the Puget Sound Regional Fire Authority Governance Board that will be working on their strategic plan. 6. Public Hearing None. 7. Public Comment None, 8. Consultant Services Agreement with Skillings Connolly, Inc. for the Operations and Maintenance Facility Fuel Island Replacement Project - Authorize The Mayor was authorized to sign a Consultant Services Agreement with Skillings Connolly, Inc. in an amount not to exceed $120,000,00, for the Russell Road Operations and Maintenance Facility Fuel Island Replacement Project, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. F. Downey FarmsteadlFrager Road Quit Claim Deed for Right-of-Way Establishment - Authorize The Mayor was authorized to sign the quit claim deed to dedicate new right-of-way for the proposed new Frager Road to King County, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. G. Emergency Management Performance Grant - Authorize The Mayor was authorized to accept and sign the Emergency Management Performance Grant from the Washington Military Department/Emergency Management Division and the U.S. Department of Homeland Security, in the amount of $7L,321, sign all necessary grant documents, amend the budget, and authorize expenditure of the funds in accordance with final grant terms and conditions acceptable to the City Attorney. H. Ordinance Adopting KCC 9.36.15O - Stoplight Traffic Safety Cameras - Adopt Ordinance No.4297 was adopted, amending Chapter 9.36 of the Kent City Code by adding the new section 9.36.150 entitled, "Stoplight traffic safety cameras," I. Ordinance Amending KCC 9.36.140 - School Speed Zone Traffic Safety Cameras - Adopt Ordinance No.4298 was adopted, amending Kent City Code section 9.36.140 to increase the base fine for an infraction committed in a school speed zone from #I24 to $136. J. Amendment to American Traffic Solutions Contract for Stoplight Safety Camera Program - Authorize The Mayor was authorized to enter into a second amendment to the contract with American Traffic Solutions to provide traffic safety camera systems and administrative services relating to the stoplight traffic safety camera program, contingent upon council's adoption of KCC 9.36.150, and upon terms and conditions approved by the Police Chief and City Attorney, K. Ordinance Granting Water System Franchise to Highline Water District - Adopt Ordinance No. 4299 was adopted, granting the Highline Water District a non- exclusive 15-year franchise to construct, maintain, operate, replace and repair a water system within public rights-of-way of the City of Kent, Page 5 of 7 Kent City Council Regular Meeting Minutes December 11, 2018 Kent, Washington Approved January 15, 2019 L. Ordinance Granting Sewer Franchise to Midway Sewer District - Adopt Ordinance No, 4300 was adopted, granting Midway Sewer District a non-exclusive 15-year franchise to construct, maintain, operate, replace and repair a sewer system within public rights-of-way of the City of Kent. M. Consolidating Budget Adjustment Ordinance - Adopt Ordinance No. 4301, approving the consolidating budget adjustment ordinance for adjustments made between July 1, 2018 and November L4, 2OL8, reflecting an overall budget increase of $22,989,456. N, Ordinance Dedicating Public Right of Way at Morrill Meadows Park and SE 248th Street - Adopt Ordinance No. 4302 was adopted, that: (1) dedicates a portion of City-owned property at Morrill Meadows Park and SE 248th Street for both right-of-way and overflow purposes, to be available as the City may authorize for public utility, cable and telecommunication service providers, and other franchisees and licensees; (2) authorizes the Mayor to sign all documents necessary to finalize and define the dedications authorized by the ordinance; and (3) directs the City Clerk to record a certified copy of the ordinance upon its passage, O. 132nd Avenue S.E. Pedestrian Improvements Project (North) S.E. 240th Street to S.E. 248th Street - Accept as Complete The Mayor was authorized to accept the 132nd Ave SE Pedestrian Improvements (North) SE 240th to SE 248th St Project as complete and release retainage to Axum General Construction, Inc., upon receipt of standard releases from the state and the release of any liens. 9. Other BusinessA, Lodging Tax Business or Leisure Tourism Promotion Grants - Award Michelle Wilmot, Economic Development Project Manager, provided a brief presentation regarding the Lodging Tax Advisory Committee that included the funding purpose, process, and award recommendations. Wilmot provided next steps that includes the notification of awards, preparation of contracts, news release, and the process for 2019 applications. Wilmot responded to council's questions regarding the process to determine the amount of the award. Council President Boyce advised he is the chair of the committee and expressed his appreciation of Wilmot's leadership to streamline the grant process. Mayor Ralph expressed her appreciation of the LTAC committee and Wilmot and indicated the committee's strategic decision making speaks to the work the City is doing to promote Kent as a place of innovation, where Kent changes the world. Seconded by Councilmember Kaur, motion passed 7-O. 1O. Bids A, 64O Pressure Zone Booster Station - Award Tim LaPorte, Public Works Director, presented information regarding the 640 Pressure Zone Booster Station. Councilmember Higgins moved to award the 64O Pressure Zone Booster Station Project to Prospect Construction, Inc. in the amount of +2,728,427.9O and authorize the Mayor to sign all necessary documents, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. Seconded by Councilmember Fincher motion passed 7-O. 11, Executive Session and Action after Executive Session At 8:11 p.m. the Council went into executive session. At 8:40 p.m. Executive Session was extended for an additional 20 minutes At 8:55 Executive Session was extended for an additional 10 minutes, At 9:06 p,m. the Council reconvened into regular session A.
