Ordinance Eliminating References to Council Committees from the Kent City Code - Adopt Kent City Council Committee of the Whole - Regular Meeting Minutes October 8, 2019 Kent, Washington Page 3 of 7 Assistant City Attorney, Adam Long, advised this ordinance eliminates reference to committees in the Kent City Code. MOTION: Adopt Ordinance No. 4336, amending the Kent City Code by eliminating references to the Operations Committee and the Public Safety Committee. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 10/15/2019 7:00 PM D. Bill of Sale to Clear Title at 303 West Meeker Street - Authorize Assistant City Attorney, Adam Long, advised this Bill of sale will clarify title to the buildings at 303 West Meeker Street. Years ago, the City used the vacant buildings to conduct police and fire exercises. The buildings were to be demolished, but were not. The Bill of Sale made out to the City never passed through City Council and the City has consistently maintained that it did not have a legal interest in the property. This Bill of sale clears title so development can move forward. MOTION: Authorize the Mayor to execute a Bill of Sale for improvements at 303 West Meeker Street to Southworth Properties, LLC., together with all other necessary documents, subject to final terms and conditions acceptable to the City Attorney. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 10/15/2019 7:00 PM E. 2019 Court Commissioner - Temporary Limited Term Position Matheson advised that Mayor Ralph has appointed Anthony Gipe as the City's Municipal Court Judge with a term that will start January, 1, 2020. In an effort to allow him to wind down his law firm and get up to speed at the City before January 1st, a recommendation is before the committee to create a limited term position that will end on December 31, 2019. This position will allow the City to provide benefits through the end of the year. MOTION: Authorize the Mayor to establish a temporary limited term position of Court Commissioner, to be funded out of the Municipal Court budget, with an end date of December 31, 2019. Interlocal Agreement with WSDOT for SR 509 Gateway Project - Authorize Link Light Rail Liaison, Kelly Peterson provided the Council with details on the Interlocal Agreement with WSDOT for the SR 509 Gateway Project. MOTION: Authorize the Mayor to sign an interlocal agreement (GCB 3093) with the Washington State Department of Transportation to provide $2 million in funding identified in the Puget Sound Gateway Program SR167 and SR509 Completion Projects, Local Funding and Phasing Memorandum of Understanding, subject to the terms and conditions acceptable to the Public Works Director and the City Attorney. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 10/15/2019 7:00 PM G. Veterans Drive Extension PSRC Grant Acceptance - Authorize Peterson reviewed the Gateway Program Memorandum of Understanding and the SR 509 Gateway Project that will be completed in two stages. Peterson detailed the Veteran's Drive PSRC Grant, west corridor completion plan and the ILA with WSDOT that formalized details of Kent's funding contribution. MOTION: Authorize the Mayor to sign agreements necessary to accept $4 million of Federal Highway Administration funds for expenditures on the Veterans Drive Extension, a local nexus project within the SR509 Gateway Program, subject to final terms and conditions acceptable to the Public Works Director and City Attorney. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 10/15/2019 7:00 PM H. WSDOT Reimbursement Agreement for South 224th - Authorize Chad Bieren, Deputy Public Works Director provided information on the Reimbursement to WSDOT for inspection on 224th. Although WSDOT went over budget, the overall project is currently within budget. Kent City Council Committee of the Whole - Regular Meeting Minutes October 8, 2019 Kent, Washington Page 5 of 7 MOTION: Authorize the Mayor to modify agreement JA 6673 with WSDOT for review, permitting and approval of the South 224th Street Project within WSDOT right-of-way and inspection of materials, to increase costs from $70,000 to $130,000, subject to final terms and conditions acceptable to the Public Works Director and City Attorney. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 10/15/2019 7:00 PM I. USGS Joint Funding Agreement - Authorize Mike Mactutis, Environmental Engineering Manager, provided the Council with information on the US Geological Survey - Joint funding Agreement for the Operation of Stream and River Gages. This is an annual agreement that the city has been dong for at least 20 years on various gages throughout the City. This City's portion of this agreement is for $82,000 to fund 6 gages. Data is used to help design stream projects. These gages are needed to help protect property and infrastructure. Mactutis advised the public can access the data online. This year's agreement reflects an increase of 3.5% from last year. Higgins advised the Council should pay attention to how much the federal government is requiring Cities to pay for the gages. MOTION: Authorize the Mayor to sign a Joint Funding Agreement for Water Resources Investigations between the City of Kent and the U.S. Geological Survey in an amount not to exceed $82,510 subject to final terms and conditions acceptable to the City Attorney and Public Works Director. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 11/5/2019 5:00 PM J. Information Only - 2019-2021 Department of Ecology Stormwater Capacity Acceptance and NPDES Update Laura Haren, Environmental Conservation Analyst, provided the Council with information on the New State/Federal Stormwater Permit (NPDES) and what it means for Kent. The program is under the Municipal Stormwater Permit required by the EPA through the Clean Water Act. Kent City Council Committee of the Whole - Regular Meeting Minutes October 8, 2019 Kent, Washington Page 6 of 7 New program requirements include MS4 mapping and documentation, the Source Control Program for Existing Development and Comprehensive Stormwater Planning. Haren reviewed the Municipal NPDES permit programs: · Public Education and Outreach · Public Involvement and Participation · Illicit Discharge Detection and Elimination · Controlling runoff from new development, redevelopment and construction sites · Operations and maintenance · Monitoring and Assessment Haren indicated the new requirements will increase staff's workload - additional inspections could exceed 500. This is a citywide permit and nearly all departments have a role. The new permit requirements are in place to not only improve water quality, but to improve the awareness of pollution prevention. Goals include: · Use new programs to effect some behavioral change in the community through education · Implement some strategic Kent-specific and regional programs .to protect and enhance water quality. Grant offer: · 2019-21 Biennial Municipal Stormwater Capacity Grant · $50,000 for general Clean Water Act permit implementation · No match is required. · Grant funds must be expended by March 31, 2021. 5. ADJOURNMENT Matheson, advised the Committee of the Whole will meet on November 12, 2019 and the meeting on November 26th will be cancelled. During the month of December, the Council will meet on December 10th and the Committee of the Whole will meet on December 3rd and 17th. Matheson provided details on the updates being made to Chambers and expressed his appreciation of Parks/Facilities, Multimedia and the Clerk’s Office for making Chambers available for today’s meeting.
