5. Reappointment of Lew Sellers to the Public Facilities District Board -
Confirm
Matt Gilbert covered the Motion and Summary briefly.
Bill Boyce asked whether the position had been opened up to other
volunteers. Matt Gilbert stated that it had not but that there are no
provisions that create term limits for this position.
MOTION: Confirm the reappointment of Lew Sellers to Position
Number 5 of the Public Facilities District Board, for a 4-year term
that will expire on August 31, 2023.

6. Economic Development Activity Update
Bill Ellis gave an update regarding the Naden property. He discussed the
current negotiations with a hospitality company for the South end of the
Naden property. He asked an initial question of what the City thinks is a best
use for the North part of the property. Bill discussed the criteria of GSA for
tenanting large office space in south King County, and pointed out the
requirements of walkability and restaurant amenities within a half mile as an
example of how places compete for new business.
The next topic Bill covered was the passage of the Light Manufacturing
amendment and how it can affect change to the Railroad Avenue area.
There were some questions regarding timeline of these events with Bill
indicated would be moving quickly with a meeting set with the hospitality
group on July 11, 2019.
7. Ordinance Adopting Housekeeping Code Amendments - Adopt
Sara Ullman presented the 2018 Housekeeping Code Ordinance. She covered
the 6 proposed code changes outlined in the Summary.
There were questions regarding how this amendment was received at the
June 24, 2019 Land Use and Planning Board public hearing. The Amendment
passed unanimously with no comments.
There were clarifying questions asked and answered:
#2 Marli Larimer asked if the proposed radius mailing of 300 feet is typical in
other jurisdictions? Sara stated that it is the typical distance for the State
and other jurisdictions.
#3 Bill Boyce asked, have the schools been brought in to the discussions
about these changes. Sara indicated, yes, Hayley Bonsteel has been working
with them.
#6 Bill Boyce asked can one of these vehicles be driven around the block and
re-parked, effectively starting the 30-day calendar over? Sara explained that
no, these are vehicles that are not legal on roads.
# 6 Marli Larimer asked if a project car can still be kept in a garage or side
yard? Sara indicated that the rule is that the vehicle must be stored inside
and screened from view.
MOTION: Adopt Ordinance No. 4329, adopting 2018 Housekeeping
Code Amendments as recommended by the Land Use and Planning
Board.

8. Rally the Valley Update
Danielle Butsick presented an update on the Rally the Valley effort, a long-
range planning project aimed at creating a new vision for Kent’s industrial
valley.
Staff has worked with the Rally the Valley advisory panel to develop a
strategic framework, complete with a vision, four strategic issues (or problem
statements), and four goals related to 1) diversification and optimization of
financial tools, 2) improving the visual landscape, 3) encouraging a diversity
of uses to complement the Valley’s strengths, and 4) investments in the
public realm.
The second advisory panel meeting focused on financial tools, and resulted in
panel and consultant recommendations to further research Local
Improvement Districts, Community Facilities Districts, and Transportation
Benefit Districts to fund capital projects.
The third advisory panel meeting focused on the public realm and identifying
ways to increase utilization of existing assets, improve visibility and
accessibility of destinations, and create multimodal connections between
destinations. Panel members recommended working with developers and
business owners to establish on-site recreation/open space opportunities,
and to partner with private developers to build small public realm
improvements.
The next advisory panel meetings will focus on design, aesthetics, and
diversification of uses in the Valley.
9. Economic Development Partnership Agreement with The Port of
Seattle - Authorize
Danielle Butsick gave a presentation on a Port of Seattle Economic
Development Partnerships Program grant that has been offered to the City
and where the monies will be spent. The grant is non-competitive and is
based on population, capped at $65,000 for cities with greater than 65,000
residents.
The grant offered to the City of Kent is for the maximum amount of $65,000
and the City has already dedicated matching funds at 50% ($32,500),
placing the total amount available at $97,500.

The money will go to three projects related to the broader Kent Valley
repositioning initiatives Marketing and Media Messaging for the Business
Recruitment Website, the Rally the Valley project Economy and Employment
research, and the Regional Trails Opportunity Study. A greater share will be
given to the Trails Study.
City Council is being asked to authorize the mayor to sign the Interlocal
Agreement between the City of Kent and the Port of Seattle to accept the
funds and conditions.
MOTION: Authorize the Mayor to accept the Port of Seattle’s
Economic Development Partnership Program Grant in the amount of
$65,000,amend the budget, authorize expenditures of the grant
funds and any matching funds accordingly, and authorize the Mayor
to sign all necessary documents, subject to final terms and
conditions acceptable to the City Attorney and Economic and
Community Development Director.

10. Ordinance Adopting the Shoreline Master Program Update - Adopt
Danielle Butsick presented the proposed changes to the Shoreline Master
Program. The Department of Ecology has reviewed the City’s proposed
amendments.
The goals of the SMP are:
1. Shoreline development that make sense and emphasize water-dependent
uses
2. Protect natural resources
3. Promote public access
Proposed revision submitted to Ecology 4/24/2019 were:
1. Reference to the most recent critical areas regulations adopted in 2017
2. Updated definitions, thresholds, and exemption rules
3. Vegetation conservation provisions specific to potential use conflicts with
regional trails
4. Remove Panther Lake PAA references
5. Fix mapping error - amend Shoreline Environment Designation for two
parcels on Frager Road
6. Minor edits to improve functionality and readability (e.g. removing unused
definitions, updated maps and diagrams, clarifying language)

Ecology’s requested revisions per the Initial Determination received
6/25/2019 were:
1. Required - Exclude CAO provision for appeals from critical area review
decisions (KCC 11.06.080.C)
2. Required - Exclude CAO provision for 300-ft. limit for increased wetland
buffer (KCC 11.06.600.B)
3. Required - Exclude CAO provision for “reasonable use” wetland modification
allowances in shoreline - not consistent with SMA (KCC 11.06.610)
4. Required - Remove amendment language pertaining to flexibility to allow
non-native planting where necessary
5. Recommended - Clarify language on authority of Kent’s Critical Areas
Regulations (CAO) relative to SMA
6. Recommended - Update CAO reference to 2017 ordinance number, and in
definitions
7. Recommended - Clarifying language on applicability and presiding language
in case of conflict
8. Recommended - Remove incorrect section reference to WAC 173-27-170.
9. Recommended - Update map figure, as noted (to demonstrate curving
OHWM).
Having received an Initial Determination of consistency from the Department
of Ecology, Kent City Council may now adopt the Shoreline Master Program
amendments, which will then be forwarded to the Department of Ecology for
final approval.
MOTION: Adopt Ordinance No. 4328, adopting the Shoreline Master
Program Update.

11. Impact of Permit Center Process
Matt Gilbert and Barb Napier presented information on recent permitting
activity and updates on ECD’s efforts to improve customer service.
In May of 2018 ECD began using a first-in, first-out prioritization scheme for
permit reviews, which decreased review time. This resulted in increased
demands on Permit Center staff. Beginning in May of this year the Permit
Center is closed to the public on Wednesdays so permit techs can work on
other duties besides counter work. This has helped to reduce the wait time
for people to get notice that their permits are ready or that changes are
needed.

This has increased customer traffic on Thursdays, but the overall impact has
been positive by reduced wait time on the back-end of the permit process.
The Federal Way Link Light Rail project was discussed. There is some concern
regarding hiring an engineer and planner for this project.
