This Amendment is made between the City and the above-referenced Consultant or Vendor
and amends the original Agreement and all prior Amendments. All other provisions of the original
Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force
and effect. For valuable consideration and by mutual consent of the parties, Consultant or
Vendor’s work is modified as follows:
1.Section I of the Agreement, entitled “Description of Work,” is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, the Consultant or Vendor shall:
As described in attached Exhibit A, incorporated herein, consultant shall
provide additional support through construction completion and assist
with design concepts for a memorial honoring fallen Kent Police Officer
Diego Moreno.
2.The contract amount and time for performance provisions of Section II “Time of
Completion,” and Section III, “Compensation,” are modified as follows:

The Consultant or Vendor accepts all requirements of this Amendment by signing below, by
its signature waives any protest or claim it may have regarding this Amendment, and
acknowledges and accepts that this Amendment constitutes full payment and final settlement of
all claims of any kind or nature arising from or connected with any work either covered or affected
by this Amendment, including, without limitation, claims related to contract time, contract
acceleration, onsite or home office overhead, or lost profits. This Amendment, unless otherwise
provided, does not relieve the Consultant or Vendor from strict compliance with the guarantee and
warranty provisions of the original Agreement.
All acts consistent with the authority of the Agreement, previous Amendments (if any), and
this Amendment, prior to the effective date of this Amendment, are hereby ratified and affirmed,
and the terms of the Agreement, previous Amendments (if any), and this Amendment shall be
deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this Amendment, which is binding on the parties of this contract.

Proposal for Landscape Architectural Services – Extended Construction Administration
services and Memorial Design
Terry:
With the construction contract extension, we have identified a need for additional
services in order to continue with our construction support services for West Fenwick
Park. As of end of January we have expended our original fees, and have estimated
fees for the duration of construction anticipated to be complete in mid-March.
We have included a task within this scope letter to assist you with the development of a
memorial to be installed at the Futsal Court in honor of Diego Moreno. Detailed
information is included below, based on our current understanding of the design intent.
This letter outlines our proposed landscape architectural services to complete the task
on site. We are looking forward to completing this project with you!
Construction Administration $15,190.00
The fees identified below are estimated from our recorded time spent on a weekly cycle
during the construction phase. Play area coordination had exceeded our anticipated
fees of $3,840. Tasks include the following:
Attend up to 7 weekly construction meetings and up to 4 related site visits;
associated coordination and follow up
(1) One punch list and (1) one back punch
Post construction manuals
Respond to RFI’s, and issue ASI’s as needed
Additional play area coordination: $3,620

Memorial Design $12,670.00
We are excited with the opportunity to assist with developing a memorial for Diego
Moreno at the newly installed Futsal Court. We understand there are two components to
the memorial – a metal sign that will act as an archway either onto the field or over one
goal post that will read, “Diego Moreno Memorial Field” or “Diego’s Field”. The second
item will be a bronze plaque that will be integrated onto the site, likely at the new paved
are on the southwest edge of the court. The following tasks are included as part of the
design effort:
Develop two concepts for the metal arch that are graffiti resistant
Develop a conceptual layout for incorporating the bronze plaque into a stone
seat or plinth and placed in conjunction with the new benches at the concrete
pad.
It is assumed the layout and text for the bronze plaque is designed and
coordinated by the City.
Attend up to four virtual meetings to coordinate design elements.
Provide detailed drawings for the metal arch and stone seat with integrated
plaque.
Structural engineering support for the metal archway and footings to be
provided by Swenson Say Faget. (Their fees will be paid off our base scope of
services with a remaining budget of $1,600).
Construction support that includes a trip to select stone at Marenako’s, review
shop drawings, coordinate delivery and install of bronze plaque, installation of
metal arch.
Fees
Based on the scope of services identified at this time, we have established a fee of
$27,860 for landscape architectural services. Fees will be billed monthly based upon
the percentage of work completed. Services beyond those noted in this proposal will be
billed as additional services on an hourly basis as follows:
Principal $185.00 per hour
Associate $164.00 per hour
Project Manager $120.00 per hour
Landscape Designer $95.00 per hour
Administrative Staff $95.00 per hour
