I have also reviewed records relating to your past on-duty vehicle accident history, which includes accidents that occurred on November 3, 2013; January 2, 2014; and July 4, 2014. These three (3) accidents predate your December 15, 2014, accident by less than two (2) years and were all determined to be preventable and caused by your inattentiveness while driving. Commander Todd Durham performed the investigation into the collision that occurred on December 15, 2014, and made the following findings and recommendation: 1. The collision is classified as an accident; 2. The accident is classified as preventable; and 3. That this matter be closed with a one day suspension. Kent Police Department Policy No. 21.2.1., Responsibilities of On-Duty Driving, requires that when officers are not responding to calls, they are to drive in a safe manner and operate their vehicles in compliance with the law. While focused on a vehicle that you believed was driving recklessly, you rear-ended another vehicle when you failed to observe that it had stopped for traffic. It does not appear that anything contributed to the accident other than your attention . having been diverted elsewhere while you were still actively driving your patrol vehicle forward. Although it was dark, there is no indication that the vehicle in front of you had any defective equipment, and it appears the road was dry and the sky clear. Therefore, after my review of the documentation, I am prepared to enter findings consistent with those of Commander Durham, except that I am adding EVOC retraining. Such a finding will result in an unpaid suspension of one (1) day, for which you may use any available vacation or comp time to cover, and EVOC training with an emphasis on avoiding distracted driving, which will be scheduled by your supervisor. You were previously advised in July 2014 that your involvement in an additional preventable accident would likely result in an unpaid suspension. However, prior to a final determination and imposition of discipline, a pre-disciplinary hearing will be scheduled in order that you may provide information you may feel is relevant to my final determination. You may have legal counsel or union representation present at this pre- disciplinary hearing. It is your responsibility to ensure the presence of a union representative or legal counsel.
