TO WATER DISTRICT Ill FRANCHISE AREA rNGiNEERING DEPT
AGREEMENT between the City of Kent, a municipal corporation of the State
of Washington, hereinafter called "City" , and King County Water District
No. 111 , a special purpose district of the State of Washington, hereinafter
called "District" .
WHEREAS, the City and the District desire to enter into a temporary
Agreement for providing water service to residential properties located within
the franchise boundaries of Water District 111 lying east of 124th Avenue S.E.
from S. 277th Street southerly to the southern franchise limits of Water
District 111 ; and
WHEREAS, the owners of property described in Exhibit A incorporated by
reference have requested that the District allow the City to provide water
service to such property; and
WHEREAS, the City and District have worked in a cooperative fashion to
service customers and landowners in their respective districts when it has
been in the mutual interest of the District and City to so cooperate; and
WHEREAS, it is the intent of the parties to comply with the provisions of
RCW Chapter 39.04, Interlocal Cooperation Act, as amended.
NOW, THEREFORE, it is hereby agreed as follows:
1 . The City shall service those properties within Water District Ill
lying east of 124th Avenue S.E. from S. 277th Street southerly to the
southerly franchise limits of Water District 111 .
2. The City shall service the subject property under the provisions of
Kent City Code Chapter 7.06, including utility billing to the respective
properties so served pursuant to Kent City Code Chapter 7.02, including
enforcement of delinquent utility bills and collection. The City is solely
responsible for the design, planning, construction, and operation of the water
utility service provided for such properties.
3. The City is permitted to collect any environmental mitigation fees or
charges from developers of said properties within such area pursuant to Kent
City Code provisions, including but not limited to Kent City Code Chapter
12.12A, 4.14, and other policies, plans, and programs adopted by the City of
Kent related to mitigating growth development impacts within the City of Kent
or within the sphere of interest of the City of Kent. Provided, however, that
said developers are subject to direct payment to the District for any capital
facility system charge required to be paid for development within the
boundaries of Water District 111 pursuant to District ordinances, rules, and
regulations.
4. This Agreement is subject to mutual termination of the parties upon
120 days written notice to either or both parties.
5. Any and all expenses related to providing service to said properties
by the City shall be at the City's sole expense. The City shall be
responsible for obtaining any and all necessary easements and permits related
to the design, construction, and operation of such system service to said
properties.
6. The effective date of this Agreement shall be upon execution by the
City and District followed by approval by King County whichever is later.
