AN ORDINANCE of the City Council of the
City of Kent, Washington, authorizing the transfer
of excess Local Improvement District Guaranty
Funds to the General Fund.
RECITALS
A. If Local Improvement Guaranty Fund has sufficient funds
currently on hand to meet all valid outstanding obligations of the fund and
all other obligations of the fund reasonably expected to be incurred in the
near future, RCW 35.54.095 authorizes the City to reduce the balance in
its local improvement guaranty fund to an amount not less than ten
percent (10olo) of the net outstanding obligations guaranteed by the fund.
B. The City has determined that is has excess funds totaling
$118,651.20 in its Local Improvement Guaranty Fund, and there are no
net outstanding obligations guaranteed by the fund.
C, The City may by ordinance transfer excess local improvement
assets to its general fund.
D. Pursuant to RCW 35.54.095, the Finance Director has certified
that the Local Improvement Guaranty Fund has sufficient funds currently
on hand to meet all valid outstanding obligations of the fund and all other
obligations of the fund expected to be incurred in the near future.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:
ORDINANCE
SECTION 7, - Transfer Authorized. The Finance Director is hereby
authorized to transfer $118,651.20 from the Local Improvement Guaranty
Fund to the General Fund.
SECTION 2, - Prior Acts Ratified. Any transfers consistent with the
authority granted in Chapter 35.54 RCW taken prior to the effective date of
this ordinance are hereby ratified and confirmed.
SECTION 3, - Severability. If any one or more section, subsection,
or sentence of this ordinance is held to be unconstitutional or invalid, such
decision shall not affect the validity of the remaining portion of this
ordinance and the same shall remain in full force and effect.
SECTION 4, - Corrections by City Clerk or Code Reviser. Upon
approval of the City Attorney, the City Clerk and the Code Reviser are
authorized to make necessary corrections to this ordinance, including the
correction of clerical errors; ordinance, section, or subsection numbering;
or references to other local, state, or federal laws, codes, rules, or
regulations.
SECTION 5, - Effective Date. This ordinance shall take effect and
be in force five days after its publication, as provided for by RCW
35A.11.090 and RCW 35A.12.130.
