Letter of Agreement

Re: Western Conference of Teamsters Pension Trust Contribution Participation
This Letter of Agreement (LOA) is by and between the City of Kent ("City") and Teamsters Local
Union No. 117 ("Union") collectively referred to as the Parties regarding the 2013 Western
Conference of Teamsters Pension Trust ("WCTPT") participation.
As a result of bargaining that took place on December 20, 2013, the parties agree to the following
provisions regarding WCTPT participation for employees covered by the Collective Bargaining
Agreement dated January 1, 2014— December 31, 2016 between the City and the Union.
THEREFORE the Parties agree to amend and modify the January 1, 2014 — December 31, 2016
Collective Bargaining Agreement as follows:
ARTICLE 17 - PENSION
A. Pension for employees and contributions to Public Employees' Retirement System (PERS)
will be governed by Washington state statute.
B. Western Conference of Teamsters Pension Trust (WCTPT) - The City shall submit the
amount stated below to the Western Conference of Teamsters Pension Trust Fund on
account of each of its benefitted full-time, benefitted part-time, temporary limited term,
variable hour, seasonal 8-month temporary (until the classification is no longer utilized by
the city) and non-benefitted part-time employees who perform the represented work as
noted in Section 1.1 of this Agreement.
• Benefitted Full-Time, Benefitted Part-Time Employees. Effective January 1,
2014, employees hired prior to December 31, 2013, will have a one-time
thirty-eight cents ($0.38) per hour reallocation to their base hourly wage
AND a one-time twelve cents ($0.12) per hour reallocation to their base
hourly wage for a total reallocation of fifty cents ($0.50) per hour. The
twelve cents per hour reallocation represents the city's previous contribution
to the WCTPT and recognizes the city will no longer make any further
contributions to the WCTPT.
Employees in these classifications shall suffer a gross wage reduction of
eighty-seven dollars ($87.00) per pay period. Said reduction shall be
imposed regardless of the number of hours compensated; HOWEVER, if an

employee is in a leave without pay (LWOP) situation for an entire pay
period, there shall be no contribution for that pay period.
• Temporary Limited Term Employees. Employees in this classification shall
suffer a gross wage reduction of eighty-seven dollars ($87.00) per pay
period. Said reduction shall be imposed regardless of the number of hours
compensated; HOWEVER, if an employee is in a leave without pay (LWOP)
situation for an entire pay period, there shall be no contribution for that pay
period. There shall be no city paid contribution for employees in this
classification.
• Variable Hour Seasonal Temporary 8-month (until the classification is no
longer utilized by the city) and Non-Benefitted Part-Time Employees.
Employees in these classifications shall suffer a gross wage reduction of
nine dollars ($9.00) per pay period. Such wage reduction shall be imposed
as long as the employee is in an active status and regardless of hours
worked; HOWEVER, if an employee is in a leave without pay (LWOP)
situation for an entire pay period, there shall be no contribution for that pay
period. There shall be no city paid contribution for employees in these
classifications.
• The parties intend for this agreement to clarify that there shall be no
contribution to the Trust for cash outs of vacation, compensatory time,
or floating holiday upon separation of employment. The parties do not
intend to modify in any way their arrangements concerning eligibility for
cash out of vacation, compensatory time, floating holiday or other
such benefits upon separation of employment.
• The parties intend for this agreement to clarify that there shall not be
contributions due into the WCTPT for lump sum cash outs of
compensatory time during the year; however, compensatory time used
in place of a straight time equivalent (e.g. vacation) will be included in
reported hours. There is a maximum reporting of one hundred seventy-
four (174) hours (not to include overtime) in any one month and two
thousand eighty-eight (2088) hours in any one year.
• The parties agree in the event the city makes a contribution into the
WCTPT on behalf of the employee when the employee does not have
compensation to cover the contribution, the city shall have the right to
collect the contribution through a payroll reduction or other means
including, but not limited to, withholding money from the employee's final
pay check.
1. All other articles of the Parties' collective bargaining agreement shall remain in full force
and effect.
2. The parties agree that this agreement is non-precedent setting and shall not limit, restrict,
prevent, or require the City or the Union to agree to similar agreements in the future.
