At the beginning of next year, the Corrections Facility is due to change medical providers and will as a result lose access to a pharmacy. This change in medical providers is the result of an extended Request for Proposals period, from which a medical provider was selected, Healthcare Delivery. Healthcare Delivery does not maintain its own pharmacy. Instead Healthcare Delivery recommended a pharmacy it works with in other correctional facilities, Omnicare. Comparison of the prices quoted by Omnicare with those offered by the state’s pharmacy contract showed minor price advantages for branded drugs, but some price disadvantages for generic drugs. Given the short time period, and desire to facilitate a smooth transition of medical service provider, under the circumstances, observing the normal bidding requirements would not be in the City’s best interests. KCC 3.70.110(A)(2) &(A)(3) allows the Mayor to waive the bidding requirements for the purchase of goods, materials, equipment, or services that are not part of a public work upon a finding that the bidding requirements would otherwise not be practicable or in the City’s best interests under the circumstances. Because Omnicare offers a special service and because of the totality of the circumstances, I believe it is in the City’s best interest to directly negotiate a services agreement with Omnicare and request that you authorize the waiver of the bidding requirements. If you concur, please indicate your approval and waiver of bidding requirements by signing where indicated below. This waiver and the resulting contract will be filed with the City Clerk’s office in accordance with Kent City Code 3.70.050.
