RESTRICTIVE COVENANT
The City of Kent, a Washington Municipal Corporation, is the owner of real
estate legally described in Exhibit A attached hereto and incorporated by this
reference (the "Property").
Notice is hereby given that the"Property"is subject to use restrictions and other
obligations. The purpose of these restrictions is to prevent this land from future
development, ensure that the Property will be retained forever in a natural scenic
condition, and prevent any use of the Property that will impair or interfere with the
ecological services that the Property provides.
These use restrictions and other obligations are a condition of U.S. Army Corps
of Engineers Nationwide Permit NWS-2015-530 (the "Permit"), dated February 9,
2017.

The owner of the Property shall not make or permit to be made any use of the
Property, or any part of it, which is inconsistent with the mitigation purpose of the
Property and diminishes the Property's ecological services, unless the U.S. Army
Corps of Engineers, or its successor, consents to the inconsistent use.
Uses of the Property are restricted as set forth below. These restrictions and
obligations described above shall run with the land and shall be binding on the City
of Kent and any and all persons who acquire any interest in the Property:
1) The Property shall be retained in a natural scenic condition,
2) The Property shall not be used for any commercial or industrial use,
3) The Property shall not be used for agricultural activities,
4) Paving with concrete or asphalt is prohibited, and
5) Waste disposal is prohibited.l

Mitigation Area Description
Parcel 3830000055 will have 197,140 square feet dedicated to mitigation plantings.
The mitigation plantings will be divided into four zones, based on the water and soil
conditions of the site. The emergent wetland enhancement zone will be located in
the wettest and lowest area of the parcel and occupy 68,000 square feet. The scrub
shrub wetland enhancement zone will surround the emergent wetland enhancement
zone, have drier soils, and occupy 77,640 square feet. There are also two forested
wetland zones: one at the northern end of the parcel (27,000 square feet) and
another along the western edge (24,500 square feet). The map on the following
page shows the four planting zones. The locations of the planting zones are
approximate and will be determined prior to planting, which is anticipated to start
fall 2021, and later recorded with an as-built.
