DATE: October 20, 2020 TO: Kent City Council SUBJECT: Consultant Services Agreement with GeoEngineers, Inc for the Lower Russell Levee Accreditation Study - Authorize MOTION: Authorize the Mayor to sign a Consultant Services Agreement with GeoEngineers, Inc. in an amount not to exceed $220,204 for engineering services on the Lower Russell Levee Setback project, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. SUMMARY: The City of Kent and the King County Flood Control District have partnered on the largest (to date) levee improvement project in Kent with the Lower Russell Levee Setback project. The approximately $52 million project includes flood protection improvements from South 228th Street to South 212th Street on the right (east) bank of the Green River in the form of a new floodwall and an earthen levee. The project also includes a back-channel habitat area in the river, other habitat improvements, and relocation of Van Doren’s Landing Park. To the south, the project is connected to the Upper Russell Road Levee and to the north it is connected to the Boeing Levee. Both projects have been through FEMA’s accreditation process. The Lower Russell Levee Setback project will connect these three reaches which help provide flood risk reduction to about two-thirds of the Kent Valley. The interlocal agreement between the Flood District and the City includes the Flood District being responsible for the design and construction of the project, while the City is supplying the land. While the flood protection improvements have been designed to meet FEMA’s levee accreditation standards, the Flood District’s team of consultants are not under contract to accredit the new floodwall and earthen levee. The City performed a selection process to choose a levee accreditation consultant. The selection team agreed that GeoEngineers would be the best fit for this work. This consultant services agreement with GeoEngineers, Inc includes analysis and preparation of all needed reports for FEMA levee accreditation. This contract includes work to be performed by subconsultants for hydraulic and hydrologic analysis and reports as well. Work under this contract also includes coordination with FEMA during and after the submittal for accreditation. BUDGET IMPACT: Funding for this contract will come from budgeted drainage utility funds. SUPPORTS STRATEGIC PLAN GOAL: Evolving Infrastructure - Connecting people and places through strategic investments in physical and technological infrastructure. Thriving City - Creating safe neighborhoods, healthy people, vibrant commercial districts, and inviting parks and recreation. Sustainable Services - Providing quality services through responsible financial management, economic growth, and partnerships. O410-21&OO ¡NTRODUCTION The purpose of our services is to review existing data and analysis of the proposed Lower Russell Levee and provide our opinion if the proposed levee can be certified as meeting the 1-percent chance of exceedance flood (1O0-year flood). lf, in our opinion, certificat¡on is appropriate, we w¡ll prepare the documentation for levee certification and other documents required for a Letter of Map Revision (LOMR) or a Conditional Letter of Map Revision (CLOMR). The Lower Russell Levee is located on the right bank of the Green River between River Mile 17.85 and 19.27. A levee certification was provided in 2OIl by AMEC as part of a CLOMR application. However, the design changed significantly since that certification was provided. The current Lower Russell Levee Setback Project is a King County Flood Control Distr¡ct project designed by HDR. Changes between the 2011 design and current design include: r lncreasing the deslgn levee height from the 100-year flood elevation plus 2 feet of freeboard to the 500-year flood elevation plus 3 feet of freeboard. I Using floodwalls instead of earthen levees over about 2,600 feet of the upstream end. I lncreasing the setback of proposed levees over about 3,700 feet to expand Van Dorens park. r Excavating riparian habitat areas at the upstream end. The project is currently under construction with Scarsella Brothers as the prime contractor. Construction is being administered by King County Water and Land Resources Division with support by AnchorQEA. A schedule developed by Scarsella Brothers and provided to us by City of Kent indicates that the majority of the earthwork associated with the levee will be in the summer to fall of 2Q2O and the spring of 2021 with a scheduled weather break in between. We understand review of existing designs and analysis documentation and construction observation for the 2020 construction season will be authorized separately. Levee certification within the context of this project follows the def¡nition provided in 44 CFR 65.2, which states that "certification by a registered professional engineer or other party does not constitute a warranty 1101 South Fawcett Avenue, Suite 200 Tacoma, Washington 98402 253.383.4940 GroErucn EERIJ/ 4@YEARSp,o2o20 GeoENcr.¡ ÊERIJ/ Cityof Kent October 2,2O2O Page 2 or guarantee of performance, expressed or implied. Certification of data is a statement that the data is accurate to the best of the certifier's knowledge. Certification of analyses is a statement that the analyses have been performed correctly and in accordance with sound eng¡neer¡ng practices." SCHEDULE AND NOTICE TO PROCEED We intend to divide our services into two phases and up to three notices to proceed. This is done so the consultant team and the City can formally reevaluate and adjust the scope as needed during the project. The first notice to proceed will include data collection and analysis to confirm that the levee and system can be certified/accredited in its current or proposed condition. Key determinations during this first phase will include confirming the design and construction methods used are, in our opinion, appropriate for levee certification. This portion of the first phase will be authorized separately. Additionally, it must be confirmed that the 2D hydraulic model used for the design of the levee can be converted to the Federal Emergency Management Agency (FEMA) effective 1D model without indicating a rise in the calculated flood elevations. We anticipate that this phase will take about 10 weeks from receiving notice to proceed. Construction documentation will be based on the construction schedule. lf it is determined that the levee can be certified, the second phase and second notice to proceed will be to prepare and assemble the documentation required for a CLOMR or LOMR submittal to FEMA. We anticipate this phase will take about 12 weeks from complet¡ng the first phase and receiving the second notice to proceed. Subtasks included in notice to proceed 1 and notice to proceed 2 are indicated In the scope and budget with NTPI and NTP2, respectively. The third and final notice to proceed (NTP3) is a contingency task that will only be activated if additional services and/or effort is required to complete the project. SCOPE OF SERVICES Task 1- Levee Gertification t. (NTP1) Perform and review foundation stability and seepage analyses for earthen levees and global stability analyses forstructuralfloodwalls usingthe Seep/W and Slope/W computer programs. We will evaluate cross sections under the conditions outlined in U.S. Army Corps of Engineers (USACE) Engineering Manual ÊM 1,tLO-2-1913 "Design and Construction of Levees" and USACE Engineering Circular EC LLLO-2-6067 "USACE Process for the National Flood lnsurance Program (NFIP) Levee System Evaluation." The design cases that will be evaluated include End of Construction, Steady State Seepage during Full Flood Stage, Sudden Drawdown, and Seismic. We have assumed that a seismic deformation analysis will not be required. We anticipate the stability and seepage analysis will include developing five new cross sections and reviewing/incorporating two cross sections from the 2011 CLOMR submittal. 2. (NTP1) Provide analysis of proposed floodwalls. We will evaluate floodwalls in accordance with FEMA and USACE requirements for floodwall design. We will evaluate floodwalls for stability in accordance with USACE EM 71,tO-2-2502 "Retaining and Floodwalls". We anticipate evaluating the seven typical File No.0410-216.00 G¡oErcrn EERIJ/ Cityof Kent Oclober 2,2Q2Q Page 3 sectlons presented in the project plans and reviewing connection detailing and transitions as appropriate. 3. (NTP2) Perform a settlement analysis of the levee embankment that assesses the potential for settlement of the levee to reduce freeboard over time. The settlement analysis will be based on methods from the USACE Engineering Manual !L7O-L-L9O4 "Settlement Analysis" and standard local engineering practlce. We will also incorporate data collected during levee preloading periods during construction, if available. 4. (NTP2) Prepare documentation of analyses in a Levee Certification Report. Dellverables r Draft and Final Levee Analysis and Certification Report. Task 2 - Hydraulic Analysis and Mapping (NHC) Hydraulic Analysis will be performed by NHC with oversight and coordination from GeoEngineers. NHC's scope of services is attached and includes additional information regarding details of the technical analysis, deliverables, and assumptions. t. (NTPI) Update the Flo2D model developed for the Flood lnsurance Study (FlS) based on the proposed levee accreditation and the effects of other levees that are proposed to be accredited. 2. (NTP1) Provide estimates for hydrodynamic loading on floodwalls and levees, as appropriate. 3. (NTP1) Update, as appropriate, scour analysis performed for this reach in 2011. This will also include providing documentation for the currently proposed erosion protection systems. No new bathymetric data will be collected as part of this project. 4. (NïP2) Perform an interior drainage analysis, if required, to determine residual flood levels landward of the accredited levee due to backed up stormwater lines during periods of high river flow. This analysis will be used for a frequency analysis to determine 100-year ponding water surface elevations landward of Green River outfalls. The analysis is only required if the one stormwater outfall within the project area will be impacted by the project. 5. (NTP2) Use the results from the Flo2D model and interior drainage analysis to remap the flood hazard zones and Base Flood Elevations (BFEs) that would change as a result of the proposed levee accreditation. 6. (NTP2) Prepare documentation of analyses for FEMA submittal. Deliverables I Depth and Water Surface Elevation shapefiles for each Flo2D model simulation. I Tabulated 100-year water surface ponding elevations incorporated into the floodplain maps. Deliverables r FEMA MT2 Forms r Levee Operations and Maintenance Manual r Final submittal package including all scoped components of the CLOMR submittal (see above), perm¡tting documentation provided by King County, and formal introduction letter. ASSUMPTIONS r Certification of the levee and compliance with FEMA regulations of the as built or as designed levee system is not predetermined and might not be possible. lf at any time it appears that the levee cannot be certified in its current or currently proposed condition, we will stop our analyses, contact the City to discuss options, and receive further direction. . The City will assist GeoEngineers in revising the operations and maintenance manual and with coordination of other levee maintenance stakeholders (King County). Preparation of the manual will require cooperation from City public works, engineering, and maintenance personnel. The operations and maintenance manual will also require formal adoption from the City Council or other a ppropriate govern ing body. r Certified levee survey required for as-builts will be provided by others (City of Kent or King County). F'le No.0410 216-00 GroEncn EERIJ/ Cityof Kent October 2,2O2O Page 5 r Project permitting documentation is available and will be suitable for submittal to FEMA without revisions or modifications. r We will endeavor to complete the certification with as few reviews as possible. However, levee certification reviews can be subjective, and regulations can be interpreted in different ways by different reviewers. We have budgeted for one round of comments and associated minor edits to reports. r The level of effort for each task of work is limited to the amount of labor and expenses indicated in Exhibit B. These costs are itemized to aid in project tracking. The budget may be transferred between tasks, provided the total contract amount is not exceeded. Additional services beyond these limits and this scope will be considered an additional service. r We understand that our services can be terminated at any time. lf this occurs, we will only expend the additional effort required to organize our files so that the project can be efficiently resumed later and to invoice for the effort completed. r The City's project manager has authorityto provide notice to proceed on each phase and approve scope or schedule modifications.
