CALL TO ORDER / FLAG SALUTE Mayor Ralph called the meeting to order. 2. AGENDA APPROVAL Chief Administrative Officer, Derek Matheson added an item 8.H. Excused Absence for Councilmember Thomas and item 9.B. Motion to Allow the Council President to Suspend the Council Rules to allow for Remote Attendance of Councilmembers and Staff at Council Meetings and Meetings of the Committee of the Whole. A. PUBLIC COMMUNICATIONS A. Public Recognition Mayor Ralph advised that after tonight, she will continue issuing proclamations and will mail them rather than presenting during council meetings. Mayor read the Proclamation for Music4life Month and encouraged everyone to donate instruments and funds for this program at Kent City Council City Council Regular Meeting Minutes March 17, 2020 Kent, Washington Page 2 of 7 www.music4life.org. Councilmember Kaur expressed appreciation of all first responders that have been working during this time of the COVID-19 emergency. B. Community Events Council President Troutner advised that the accesso ShoWare Center, Kent Senior Center, Kent Commons and after school programs are closed. The Spotlight Series events have been cancelled. Councilmember Fincher advised that the Kent School District is providing breakfast and lunches. See the Kent School District website for information. C. Public Safety Report Chief Rafael Padilla presented the public safety report on COVID-19. Chief Padilla advised what the public should do if they think they have COVID-19. Chief Padilla advised that no Kent Police Department officers or employees have tested positive and all essential City functions continue operating. Kent police officers are limiting in-person contacts and are asking the public to submit reports online or over the phone. Call 253-852-2121 for non- emergencies. Police and jail lobbies and all city campus buildings are closed - only essential visitors are allowed entry. For information from King County on COVID-19, call 206-477-3977, or visit KingCounty.gov Chief Padilla indicated that many restaurants are open and available for delivery and take-out food. Chief Padilla advised that everyone should be prepared, but don’t be a part of the panic. Mayor Ralph conveyed that we should not panic. There are plans in place and the City is working to ensure residents have what they need and are kept are safe. 5. REPORTS FROM COUNCIL AND STAFF A. Mayor's Report Mayor Ralph advised the City will be making frequent social media posts in Kent City Council City Council Regular Meeting Minutes March 17, 2020 Kent, Washington Page 3 of 7 an effort to keep the public updated. Visit KentWA.gov/COVID-19 for updates and resources. Mayor Ralph suggested residents support local businesses and check on their elderly neighbors. Mayor Ralph advised of her communications with surrounding mayors to share best practices. B. Chief Administrative Officer's Report Chief Administrative Officer, Derek Matheson advised that the City is moving quickly have employees work from home and advised of the criteria to be able to work from home and the process to implement working from home. The City has protocols if an employee tests positive for COV-19 or have symptoms. The City has cleaning protocols in place. City buildings are locked at all times and some departments are open by appointment. The Municipal Court is closed to public and have cancelled court calendars for the next 2 weeks, all city-related travel has been cancelled, all board/commission meetings have been cancelled and the City is working to conduct future City Council and Committee of the Whole meetings virtually. Matheson provided an update on litigation involving the King County quarantine and isolation facility and advised the City is hoping to negotiate a cooperative agreement that includes terms that would have been part of a permit. His written report is in packet and there is an executive session that is expected to last for 15 minutes with no action following the session. C. Councilmember's Reports Councilmember Fincher advised that she recently went to Olympia and testified on the statewide plastic bag ban. Councilmember Larimer serves on the Sound Cities Association Advisory Council on Aging and Disability Services that met by phone and received an update from the policy analyst from the health department. The council discussed concerns from agencies about being able to check on and provide services for seniors living alone. Councilmember Boyce serves on the Sound Cities Association Public Issues Committee that recently met to discuss COVID-19. PUBLIC COMMENT Jaspreet Singh, a Kent resident spoke in opposition to the King County quarantine facility. Singh wants Kent to stay strong and he believes King County has been acting in bad faith. 8. Payment of Bills - Approve MOTION: Approve the Payment of Bills received through 2/15/20 and paid on 2/15/20, and received through 2/29/20 and paid on 2/29/20, and approve checks issued for payroll 2/1/20-2/15/20 and paid on 2/20/20, and checks issued for payroll 2/16/20-2/29/20 and paid on 3/5/20, and audited by the Committee of the Whole on 3/10/20. C. Appoint Padiet Thoa to the Kent Cultural Communities Board - Confirm MOTION: Confirm the appointment of Padiet Thoa to the Kent Cultural Communities Board for a one-year term that will expire March 17, 2021. D. Property Transaction: Road and Right-of-Way Deed and Easements to the City of Covington - Authorize MOTION: Authorize the Mayor to sign a warranty deed to the City of Covington for a 4,713-foot portion of King County Tax Parcel No. 362205-9184, along with a wall easement, an access easement, and a temporary construction easement on the same parcel, subject to final terms and conditions acceptable to the Public Works Director and City Attorney. Grant Acceptance - Pedestrian Crossing on West James Street at Second Avenue North - Authorize MOTION: Authorize the Mayor to sign the System Access Fund Project Agreement between the City of Kent and the Central Puget Sound Regional Transit Authority for the West James Street at Second Avenue crossing improvements, to accept the funds and amend the budget to authorize the expenditure of the grant funds, subject to final grant terms and conditions acceptable to the City Attorney and Public Works Director. F. 2020 City Art Plan and Five Year City Art Plan (2020-2024) - Approve MOTION: Approve the 2020 City Art Plan and Five Year City Art Plan for 2020-2024. G. Amendment to T-Mobile Telecom Lease Agreement for Wilson Playfields - Authorize MOTION: Authorize the Mayor to execute a second amendment to the telecom lease agreement with T-Mobile at Wilson Playfields, extending the lease five years with three additional five-year extension options, subject to final terms and conditions acceptable to the Parks Director and City Attorney. H. Excused Absence for Councilmember Thomas - Approve MOTION: Approve an excused absence for Councilmember Thomas, as he is not able to attend this March 17, 2020 City Council Meeting. 9. OTHER BUSINESS A. Resolution Discouraging Landlords and the Sheriff from Pursuing or Enforcing Evictions Related to the Inability to Pay Rent due to the Personal Effects of the Coronavirus City Attorney, Pat Fitzpatrick provided information on the Resolution Discouraging Landlords and the King County Sheriff from Pursuing or Enforcing Evictions Related to the Inability to Pay Rent due to the Personal Effects of the Coronavirus. Fitzpatrick indicated this resolution would encourage landlords and the King County Sheriff to not evict and pause on eviction proceedings. Fitzpatrick advised that late this afternoon, the King County Sheriff communicated they will not pursue evictions at this time. Mayor Ralph provided details on the powers of various government agencies and indicated she would forward this resolution as a request to the City's rental housing inspection participants. MOTION: Adopt Resolution No. 2008, discouraging landlords and the King County Sheriff from pursuing or enforcing evictions related to the inability of a tenant to pay rent due to the personal effects of the Coronavirus. RESULT: ADOPTED [UNANIMOUS] MOVER: Brenda Fincher, Councilmember SECONDER: Satwinder Kaur, Councilmember AYES: Troutner, Boyce, Fincher, Kaur, Larimer, Michaud B. Motion to Allow the Council President to Suspend the Council Rules to Allow for Remote Attendance of City Attorney, Pat Fitzpatrick provided the council with details on the motion to allow the Council President to suspend the council rules to allow for remote attendance of city council and council committee of the whole meetings. When this emergency is over, the Council President can unsuspend these rules. MOTION: Move to allow the Council President to suspend the council rules to allow for remote attendance of councilmembers and staff at future council meetings and meetings of the committee of the whole to encourage social distancing for the duration of the Coronavirus emergency. BIDS A. 2020 Asphalt Grinding Project Bid - Award Public Works Director, Tim LaPorte provided details on the 2020 Asphalt Grinding Project Bid and recommended Council award the bid. MOTION: Award the 2020 Crack Sealing Project to Central Paving, LLC in the amount of $63,475 and authorize the Mayor to sign all necessary documents, subject to final terms and conditions acceptable to the City Attorney and Public Works Director.
