This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.

SB Structures crews encountered unknown obstructions while installing steel piles support the

Reference the attached pile driving refusal criteria.
The Delmag 46-32 impact hammer, that we are using for the closed end 24"pipe pile for the
culvert, is supplied by PACO Equipment CO.. PACO has issued the attached pile driving criteria
to maintain during driving. With this in mind, we will not exceed 120-blows/ff during pile
driving and will not exceed 250-blows/ft for the last foot. Also 10-ft of hammer stroke will not
be exceeded. Using this criteria we should still make the new required tip elevation but thought I
would let you know the hammer constraints.

I think we are going to have to do each pile on a case by case basis.Therefore they should install the plies such that they
done exceed the hammer refusal criteria (120/ft& 250/ft last foot.) and see what pile tip we are able to achieve, then

We drove the remaining four piles on the East side of the creek today on the S 224th St ph 2 job.The depths achieved
were approximately elevation 39 to 40. Our previously discussed requirement was 36.The diesel hammer blow count
was greater than 250, with less than two feet of movement when the above mentioned depths were achieved. The
hammer's manufacturer requires a max of 250 blows for two feet of movement. Is elevation 40-39 acceptable? The
contractor plans on performing demolition activities to the West approach on Monday.The sooner we can get an
answer,the better; once the approach is gone, so is our crane pad.
I appreciate your understanding of the urgency and "last minute" status that is attached to this email. Let me know if
you have any questions. I will have my work and personal phones on me all weekend.

Sounds like the piles came up a little short of our minimum embedment criteria.The driving resistance over the last 4
feet exceeded 32 blow/foot, so we are confident we are in the "stiff clay" soil. Logs are attached for reference. Are we
ok with the shallower total embedment depth?

I looked at Piles 2E(Tip 38.0) , 2F(Tip 40.92). 2G (Tip 39.42) 2H (tip 38.72). Because we had some dene material in the
last four feet of driving these piles will be acceptable for vertical and lateral loads even though the final tip elevation
was above the target El 36.0.

I agree with this approach. If they cannot meet the currently specified installation criteria with the D46 hammer we
should be notified to evaluate acceptability of the pile.
