SATTERBERG PROSECUTING ATTORNEY JUSTICE COMPASSION PROFESSIONALISM INTEGRITY LEADERSHIP April24,2018 Memorandum of Understanding between the Kent Police Department and the King County Prosecuting Attorney's Office The Kent Police Department is aware of the recent competitive grant announcement by the Bureau of Justice Assistance (BJA) for a "Local Law Enforcement CGIC Integration Initiative," seeking applications from qualified organizations who will work with law enforcement, ATF, and the community to address firearm- related crime and forensics by swiftly identifying crime guns, their sources, and prosecuting perpetrators of violent crimes. The Kent Police Deparhnent and the King County Prosecuting Attomey's Office agree to paftner on the CGIC project and commit to the following: The Kent Police Department will develop policies and procedures on the timely collection of shell casings and firearms with the local ATF and other partner law enforcement agencies. These policies and procedures will adhere to CGIC business practices and focus on the immediate collection, management and analysis of crime gun evidence, including shell casings and recovered firearms. The Kent Police Department agrees to respond to all crimes involving a firearm within its jurisdiction, and collect all shell casings and firearms from these scenes. Kent Police Department further agrees to enter all recovered ballistics evidence into NIBIN within 24 hours of collection. All crime gun recoveries will be documented and submitted to eTrace within 24 hours. The Kent Police Department agrees to provide relevant performance measure data regarding the number of crime of ballistics/crime gun recovered and submitted and the number cases developed and/or prosecuted as a result ofthose recoveries and submissions. The Kent Police Department will meet quarterly as part of a CGIC strategic planning committee to evaluate priorities and operational policies around NIBIN and CGIC. The Kent Police Department also agrees to review and assess its own adherence to the CGIC business practices on a quarterly basis and make any necessary changes and improvements in business practices. The Kent Police Department agrees to work collaboratively with all other law enforcement partners, ATF, DOC, the U.S. Attorney's Office, the King County Prosecutor's Office, and the Washington State Patrol Crime Lab to leverage investigative capabilities to identify firearm offenders and develop violent crime prevention strategies This includes participating in or contributing to a training program and collaborative work group to improve the investigation and prosecution of gun crimes. Satterberg King County Prosecuting Attomey 516 Third Ave V/554 Seattle, WA 98104 Dear Prosecutor Satterberg : I am writing to support the King County Prosecuting Attorney's Offtce application for a Local Law Enforcement Crime Gun Intelligence Center (CGIC) grant from the Bureau of Justice Assistance. As one of 40 law enforcement agencies in King County, the Kent Police Department recognizes the multi-jurisdictional nature of firearm violence throughout the region. Firearm violence is not confined to any one jurisdiction, and suspects who use firearms do not recognize jurisdictional boundaries. A collaborative effort is necessary to coordinate investigations and trace guns between the many jurisdictions. As the King County firearm data shows, most NIBIN Leads involve multiple jurisdictions, which means multiple agencies are often investigating the same gun. Currently, there is no coordinated approach to multijurisdictional investigations and no comprehensive system for crime gun analysis. A collaborative approach between local and federal law enforcement, ATF/CGIC, the crime lab, local and federal prosecutors, and Department of Corrections (probation) is necessary to standardize procedures and protocols for shell casing and crime gun analysis; coordinate investigations; and determine appropriate the appropriate local/federal venue for prosecution.
