MEMORANDUM OF UNDERSTANDING
By And Between The

KENT POLICE OFFICERS ASSOCIATION
Representing the
POLICE SERGEANTS AND OFFICERS
and
POLICE ASSISTANT CHIEFS AND COMMANDERS
Regarding
Physical Fitness Incentive
This Memorandum of Understanding ("MOU") is entered into by and between the
City of Kent ("the City") and Kent Police Officers Association ("KPOA") representing
the Police Sergeants and Officers' bargaining unit and the Police Assistant Chiefs
and Commanders' bargaining unit (also collectively referred to herein as "KPOA").
This MOU amends: (1) Article 17, Section 17.14 Physical Fitness - in the Collective
Bargaining Agreement between the City and the Sergeants and Officers' bargaining
unit within KPOA; and (2) Article 16, Section 16.12 Fitness Incentive - in the
Collective Bargaining Agreement between the City and the Assistant Chiefs and
Commanders bargaining unit within KPOA; For convenience, the foregoing CBAs
may be collectively referenced herein as "CBA".
Section I - Purpose and Amendment
The City desires to provide KPOA members with a $500 incentive for successful
participation in the Physical Agility Test (PAT) program and participation to the Gold
level in the City Wellness program. Beginning in 2017 this incentive will be earned
in the in the current year and then paid on the January 20th paycheck of the
following year.
Section 2 — Amendment t0 the CBA
The parties agree that Section 17.14 of the Police Officers and Sergeants CBA shall
be amended as set forth below. Further, Section 16.12 of the Police Assistant
Chiefs and Commanders CBA will be replaced in its entirety with the amended
language below.
Section 17.14. Physical Fitness
To encourage employees to maintain a healthy lifestyle and physical fitness, the
City will update the physical fitness program. In order to earn the incentive, the
employee must participate in the incentive program as follows:
1, Employees will participate in the City's Wellness Program and achieve a

Gold level by Dec 31 of the incentive year.
2. Employees will successfully complete the PAT twice during the incentive
year.
3. Payment of the $500 incentive, for employees who passed the
examination during the year and achieved Gold level, will be made once
a year on the January 20th pay check of the following year; and
4. Employees who pass the physical fitness program but will have not
passed their new hire probationary period by December 315t of that year
will not be eligible for the incentive payment.
The PAT will be a design that is approved by the Chief of Police.
Section 3 - Signatures

By signing below, the Parties agree that the above represents the Parties' full and
entire agreement with respect to this MOU. This MOU shall not be interpreted to
create a past practice; nor does it waive either Party's right to bargain over wages,
hours and working conditions as provided by statute and other applicable law.
This MOU shall be deemed executed and effective as of this day of
October 2017.
