SUBJECT: City of Kent Development Agreement—Minor Revision#FWLE-02 (Section 13.4)
Sound Transit and the City of Kent agree to a minor revision of the Development Agreement (GA-0274-
17) between Sound Transit and the City of Kent. Section 13.4 of the agreement addresses utility
connections to be provided in the Kent Des Moines station area in anticipation of potential future
development. This memo serves as approval of this revision, which is outlined below.
Minor Revision to Development Agreement Section 13.4
Section 13.4 of the Development Agreement directs the Contractor to provide utility connections from
the mainline utilities to the edge of the right-of-way.The following are the mainline utilities to be
provided with added detail clarified in this memo and included in direction to Sound Transit's Design
Build Contractor:
• New 12" water main and sewer line on 30th Avenue S.
• New 12" water main and sewer line on S. 2341h Street, S. 236th Street and S. 238th Street.
• New 8" stub-out to each parcel for both water and sewer.
• Dry utilities—east side of 30th Avenue S., S. 234th Street, S. 236th Street, and S. 238th Street.
In October 2019, Sound Transit and City of Kent staff met with staff from the Highline Water District and
Midway Sewer District to develop a detailed scope of work indicating required location and size of the
requested connections. Both Highline Water District and Midway Sewer District sent letters to the City
of Kent outlining the types of the utility connections and the locations. Below is a summary of the scope
outlined in those letters which are attached as Attachments A and B. In January of 2020, a
supplemental agreement with Highline Water District was also executed which agreed upon the location
of a watermain extension and fire hydrant as shown in Attachment C.
Highline Water District Utility Location Summary
• Install a new 12" water main along 30th Avenue S from Kent Des Moines Road to S. 240th Street.
• Install a new 12" water main along each cross street (S. 234th, S. 236th and S. 238th Streets)
between 30th Avenue S. and Pacific Highway South (Highway 99).
• Set hydrant spacing along 30th Avenue S. at maximum 300 feet spacing alternating sides with a
12" stub and hydrant off end for future development(4 on east,4 on west).
• Install one 8" stub with a hydrant off end to the north and south sides of each cross street (S.
234th, S. 236th and S. 238th Streets).

Midway Sewer District Utility Location Summary
• Install a new 8" diameter PVC lateral sewer main within the right-of-way of 30th Avenue S. from
Kent Des Moines Road to S. 240th Street.
• Install a new 8" diameter PVC lateral sewer mains to the west of 30th Avenue S.within the future
rights-of-way of S. 234th, S. 236th and S. 238th Streets terminating in a manhole located so as to
maximize the flow capacity of these laterals.
• Install two 8" diameter stubs from each of the three lateral sewer main manholes at a 2-percent
slope terminating behind proposed back of sidewalk or the ROW/Property line.
Dry Utilities
The City agrees to a relocation of the joint utility trench for dry utilities from the east side of 30th Avenue
S. to the west side of 30th Avenue S. with the following conditions:
• Install five lateral trenches and conduit from the joint utility trench to the east side of 30th
Avenue South to provide service for future development. Dry utilities(Century Link, PSE and
Comcast) shall terminate in utility boxes or vaults consistent with provisions of applicable codes
and requirements.
Sound Transit and the City of Kent agree to these minor revisions of Section 13.4 of the Development
Agreement. Minor revisions of the Development Agreement were anticipated as noted in Section
12.0. As required by Section 12.0 of the Development Agreement,these changes are necessary and
consistent with the terms of the Agreement; the original scope and intent of the project and does not
impact Kent City Code 15.08.450.
This memo serves as concurrence between Sound Transit and the City of Kent regarding the provision
and location of dry and wet utilities in the Kent Des Moines Station area. Furthermore, the City agrees
that Sound Transit is still meeting the intent of the Development Agreement regarding the provision of
utilities in the station area to serve future development.

Re: Sound Transit Developer Agreement —30th Ave South Improvements
Dear Chad:
Thank you and your team for meeting with the District to discuss the proposed improvements
by Sound Transit along 30th Ave S and the Kent-Des Moines Station. We look forward to
working with the City on this important regional project.
As discussed, and shown in the attached figure, the District will require the following
improvements be constructed in accordance with the City's Developer Agreement with Sound
Transit:
• 12-inch main along 30th Ave S from KDM to S 240th St.
• 12-inch main along each cross street (S 234th St, S 236th St and S 238th St) between
30th Ave S and PHS.
• Hydrant spacing along 30th Ave S at maximum 300 ft spacing alternating sides with a
12-inch stub and hydrant off end for future development (4 on east, 4 on
west). Sound Transit's DB Contractor to layout and design for 90% review by HWD.
• One 8-inch stub with a hydrant off end to the north and south sides of each cross
street (S 234th St, S 236th St, S 238th St).
• Any additional hydrants and fire lines necessary to accommodate station (TBD by DB
Contractor).
• Reconnect existing fire line to Dollar Tree building from 30th Ave S.
• If required, existing hydrants along PHS to be adjusted as necessary to accommodate
frontage improvements.
• Existing parcels requiring continued service will have services replaced to HWD
standards.

Existing services not necessary for Sound Transit development to be cut and capped
at main. The DB Contractor has been given a list of existing services and HWD will
coordinate with Sound Transit to determine the services to remain for their property.
Existing asbestos cement water main along KDM from PHS to Interstate 5 onramp to
be abandoned in place and filled with controlled density fill.
Existing asbestos cement water main along 30th Ave S to be removed and lawfully
disposed of in compliance with Puget Sound Clean Air Agency requirements and per
City direction.
The District agrees to minimize the cutting of concrete panels to accommodate future
development; however, the City acknowledges there may be instances where panels
must be cut. Panels will be replaced in accordance with City standards.
Any additional permitting requirements as determined by the City to be a requirement
of HWD.

Dear Mr. Abernathy,
In accordance with Section 13.4(2) of the Development Agreement between the City of
Kent and Sound Transit, the City of Kent is required to provide a letter of agreement
between the City and affected utilities. This letter serves as the agreement between
the City and Midway Sewer District to meet the requirements of Section 13.4(3) of the
Development Agreement between Sound Transit and the City of Kent.
The parties agree to the following design guidelines:
• An 8-Inch diameter PVC sewer main will be constructed within the right-
of-way of 301h Avenue from approximate station 11+73 to approximate
station 28+91.
• 8-Inch diameter PVC lateral sewer mains will be installed to the west of
30th Ave. S. within the future rights-of-way of S. 234`h, S. 236th and S.
238th Streets terminating in a manhole located so as to maximize the flow
capacity of these laterals.
• Two 8-Inch diameter stubs will be installed from each of the three lateral
sewer main manholes at a 2-percent slope terminating behind proposed
back of sidewalk or the ROW/Property line.
• Construction will be performed so as to maintain minimum required
separation from other utilities.
The signatures below indicated concurrence between the City of Kent and Midway
Sewer District to the conditions listed above.

City of Kent and Highline Water District
Dear Mr. Abernathy,
This letter serves as an addendum to the letter of agreement between the City of Kent
and Highline Water District dated October 21, 2019.
Under this addendum the parties agree to the following:
e The proposed 8-Inch diameter watermain on S 236t^ Street within the bus
turnaround will be extended to the south where it will terminate with a blind
flange, hydrant assembly and necessary appurtenances as generally shown
on the attached Exhibit A.
The signatures below indicated concurrence between the Cit of Kent and Highline Water
District to the condition listed above.
