ADDENDUM TO AGREEMENT FOR SALMON ENHANCEMENT PROGRAM
This agreement is entered into between the City of Kent (hereinafter
"City") and Kent School District (hereinafter "District") as an amendment to
the agreement signed August 8, 1989.
Whereas, the City retains ownership of all tanks and related equipment
purchased by the District from the City's Salmon Enhancement and Habitat
Improvement Project fund;
For mutual consideration the parties hereby agree as follows:
1. The District shall incur no liability for lost or damaged fish tanks
and related equipment purchased by the City.
2. The City shall be held harmless and indemnified from any and all
costs, claims, judgments or awards of damages arising from the use of the
purchased fish tanks and related equipment while housed on District property,
including attorney fees and costs of defense thereof.
The District shall notify the City in writing when the program is
discontinued; and all surplusing of the fish tanks and related equipment, in
accordance with City, County, and/or State law, will be the responsibility of
the City.
4. All other terms of the original agreement, except to the extent they
are modified herein, remain in full force and effect.
