Dear Mr. Hurd:
Thank you for your February 27 , 1986, letter to Barry Marshall on
behalf of your client, the City of Kent. Since I am now responsi-
ble for the operations of all TCI properties (including the current
Group W systems) in the State of Washington, I felt responsible to
address the City' s concerns.
a) • It is my understanding that the City now has a map indi-
cating all streets served within the City of Kent.
• To date, all major line extensions have been completed.
The only remaining projects are small extensions in areas
where a new home (s) may have been built. To resolve this
issue, TCI will commit to serve these small extensions.
0 The City should recognize that in several cases it has
allowed new construction wherein the utilities are placed
underground with no consideration for cable. Cable will
usually find out about these projects after the trenches
are backfilled, oftentimes after landscaping is completed.
To serve these projects requires new trenching and restora-
tion, driving the cost for the project out of sight.
-- A solution to this problem, one that would make
this whole issue a moot point, would be for the
City to require, as part of its permit process,
that arrangements for cable service have been made.
The process is simple and works to everyone' s ad-
vantage.

b) Upgrading of the system was completed March 3 , 1986.
c) Upon proper Council action, TCI will agree to pay a fran-
chise fee of five percent (5%) as provided for in the
Cable Communications Policy Act of 1984 .
An additional item in your letter was the issue of an
access channel and its usage. TCI supports the concept of access.
However, we are aware of some technical problems that need to be
resolved in solving this issue in several communities. We would
propose a joint work session between the affected jurisdictions,
Group W engineers and TCI . In this way, progress could be made
with all parties understanding the problems and helping form the
solution. This should be done outside of the franchise transfer
issue, and you have TCI ' s commitment to working on this.
I hope these answers to the issues raised in your letter
of February 27 , 1986, will assure your client, the City of Kent,
that TCI is ready, willing and certainly able to satisfy the terms
and conditions of Ordinance 2093 and any other commitments made by
Group W.
