Subject: Habitat Conservation Measure 3; Interagency Agreement
In 2010, the City formally adopted the Clark Springs Habitat Conservation Plan
(HCP), which mandates the implementation of a number of habitat conservation
measures (HCM), in order to mitigation for the drawing of water from Clark Springs
and to stay in compliance with the HCP. These HCMs are designed to protect the
City's continued operation at Clark Springs in the event endangered salmon are
negatively impacted by the drawing of water.
The proposed HCM 3 is located within the Clark Springs basin and seeks to restore
Rock Creek to a more natural stream channel which is beneficial to the salmon who
utilize the Creek. This project is located in unincorporated King County in land
owned by King County's Department of Natural Resources and Parks. Although the
City will be completing this project in its entirety, as a stipulation to our HCP, the
City needs the County's permission to complete this work.
The proposed interagency agreement grants the City permission to complete the
designed project and to maintain it, however the parcel and completed project will
be owned by King County. This agreement has been reviewed numerous times by
the City and the County and will enable the City to comply with our HCP for Clarks
Springs.

THIS INTERAGENCY AGREEMENT IS A CONSTRUCTION, MAINTENANCE AND
MONITORING AGREEMENT
This construction, maintenance and monitoring agreement ("Agreement") is between
the CITY OF KENT, a Washington municipal corporation ("City"), and the KING
COUNTY DEPARTMENT OF NATURAL RESOURCES AND PARKS, a municipal
corporation of the State of Washington ("King County").
RECITALS
A. The Clark Springs water supply provides approximately 60% of the City
of Kent's (City) potable water supply. The Clark Springs water supply is near the
headwaters of Rock Creek, which is habitat for endangered Chinook salmon.
B. In 2010, the City formally adopted the Clark Springs Habitat
Conservation Plan (HCP), and in doing so was issued an Incidental Take Permit (ITP).
The HCP mandates a handful of habitat conservation measures that must be
implemented to mitigate for the water drawing and to maintain compliance with the
HCP. The ITP protects the Clark Springs water supply's continuing operations in the
event that an endangered salmon is accidentally harmed, killed, or otherwise taken
while the City is exercising its water right.
C. The City identified a location within the HCP as a site for implementation
of a habitat conservation measure described and depicted as Habitat Conservation
Measure 3 within the HCP (the Site). The Site is located on property owned by King
County, specifically King County Parcel Numbers 2222069006 and 2222069036.
D. Pursuant to King County Code 4.56.150(E), the Parks Division, an
agency of King County, is authorized to enter into agreements for the use of King
County land by governmental agencies that are either making improvements to
County property or providing a service that will benefit the public.
E. King County agrees to allow the City to access the Site to complete the
habitat conservation measure (The Project). King County's permission for the City
to complete the Project in no way waives King County's option to construct a larger
habitat enhancement project in the future (Future Project). Specifically, King County
desires to construct a larger habitat enhancement project in the future if adjacent
property owners become willing sellers. King County representatives have expressed
concern that mitigation assigned to the Project by permitting agencies will hinder the
potential to implement the Future Project. Therefore, the City endeavored to
implement the Project in a way that would require no local or United States Army
Corps of Engineers (USACE) permits. The City was successful in its endeavor and
received a letter from the USACE stating the Project as designed and described on
the revised permit plans dated May 13, 2018 would not require a USACE permit. This
letter and associated permit plans are attached to this agreement as Exhibit A and B
respectively. King County expressly reserves the right to construct its Future Project
at any time after the City's Project is completed.
F. Allowing the City to construct the Project, as well as provide certain
mutually agreed upon maintenance and monitoring, will improve King County's
property and potentially provide a significant public environmental benefit.
The parties therefore agree as follows.
AGREEMENT
1. CITY RESPONSIBILITIES
1.1 Project Construction.
(a) The City shall be responsible for completion of the Project as described
in Exhibit B and shall perform and/or procure the necessary engineering,
administrative, inspection, clerical and other services necessary to complete this
work. The City shall be responsible for overseeing that all work performed, and
services obtained, are completed in a good and workmanlike manner and are done
in accordance with all laws, codes, rules, regulations, and Lhe highest industry
standards applying to the work, including, but not limited to, environmental
regulations. The City's responsibility shall include compliance with all conditions that
the Washington Department of Fish and Wildlife set forth in its Hydraulic Project
Approval ("WDFW HPA") for the Project. The WDFW HPA is attached to this
Agreement as Exhibit C.
(b) The City acknowledges and understands that the USACE permit
exemption is contingent upon adherence to the plans the City provided to the USACE.
These plans, which are set forth in Exhibit B, represent that only de minimis discharge
or fill material will be discharged into the wetlands and waters of the U.S. The City
agrees that it will not change the Project location, plans, or methods, especially in
any way that may increase the discharge or fill material into U.S. waters or wetlands,
without first obtaining approval from King County and, if deemed necessary by King
County, the USACE.
(c) Upon execution of any contract pertaining to construction of the Project,
the City shall send a copy of the contract to King County.

Section 6 at least 2 weeks before accessing the Site for construction of the Project.
(e) The City shall notify King County in advance of pre -construction Project
meetings and thereafter allow King County the option to attend and participate.
When the City has substantially completed the Project, it shall notify King County.
Thereafter, the City shall notify King County in advance of final inspection and punch
list walk-through meetings and allow King County the option to attend and
participate.
(f) Any damage to the Cedar River Trail embankment slope, the existing
bridge, or any other King County Property, that is caused by the Project's construction
shall be repaired by the City at its sole expense. If the City fails to make such repairs,
after having reasonable notice of the damage, King County shall have the option to
perform the repairs or to retain a third -party to make the repairs on its behalf. All
expenses incurred by King County to repair damage to any King County Property
caused by the Project's construction shall be promptly reimbursed by the City to King
County.
(g) The City shall contact the King County Historic Preservation Program
(HPP) to determine if a site inventory update to archaeological site 45KI722 is
necessary ahead of project construction
(h) The City shall include the King County Executive Procedures for
Treatment of Cultural Resources in the regulatory context of the Project;
(i) The City shall provide record of tribal consultation/coordination to the
HPP Archaeologist, Phil Letourneau; and, (Phil Letourneau's email is

(j) The City shall ensure that a copy of cultural resources assessment report
is posted to the Washington State Department of Archaeology and Historic
Preservation's (DAHP) database, called the Washington Information System for
Architectural and Archaeological Records Data (WISAARD), with Phil Letourneau
listed as an editor.
1.2 Project Maintenance and Monitoring. The City shall maintain and
monitor the performance of the Project as follows:
(a) The City will conduct weekly spawning surveys for Chinook salmon,
sockeye salmon, coho salmon, and adfluvial cutthroat trout every fourth year.
Monitoring will occur beginning during the week of September 21 and extending
through the end of February. Survey reaches for Chinook and sockeye salmon will
include Reach 1 through Reach 3 from September 215t to December 315t. Coho
salmon will be surveyed in these reaches from November 15tn to February 28rn
(b) The City will conduct snorkel surveys for juvenile Chinook salmon,
sockeye salmon, coho salmon, steelhead trout, and cutthroat trout in the off -channel
wetland area enhanced by the Project. Monitoring will occur during the spring of the
first three years following the completion of the Project. If no salmonids are observed
within the wetland area, the mainstem of Rock Creek will be snorkeled for a minimum
of 300 feet immediately upstream of the wetland access point. The snorkel surveys
will count the number of salmon and also the species observed.
(c) Per section 2.1.2.3 of the HCP, the City will monitor the Project to ensure
it remains effective following high flood events. If the Project becomes ineffective
following a flood event, the City will consult with the Services who imposed the
underlying mitigation requirements via the HCP to develop a reasonable course of
action. The City will also consult with King County and allow King County the
opportunity to provide comment and input on the resulting remediation action(s).
Any and all remediation costs shall be the responsibility of the City.
(d) While this Agreement is in effect, the City will monitor for sediment
deposition, particularly at the entrance and exit to the wetland.
(e) While this Agreement is in effect, the City will monitor the stability of
the logs placed in the wetland area.
(f) The City shall maintain 80% plant survivability for 5 years after initial
planting is complete.
1.3 Liens and Encumbrances.
The City shall not cause or allow any lien or encumbrance arising from or related to
this Agreement to be placed upon the real property interests of King County. If
such lien or encumbrance is so placed, King County shall have the right to remove
such lien and charge the costs of such removal to the City.
2. KING COUNTY RESPONSIBILITIES.
2.1 Access to the Site.
(a) King County hereby represents and warrants to the City that it holds
title to King County Parcel Numbers 2222069006 and 2222069036, and that it has
the legal authority to authorize the City to construct the improvements on the Site.
The County further represents and warrants that there are no easements, covenants,
restrictions, encumbrances, or defects on or to the title to the property that will in
any way impair the County's or the City's ability to perform their respective
obligations under this Agreement.
(b) King County hereby grants access to the City and its representatives to
implement, maintain and monitor the Project in accordance with the terms of this
Agreement. Notification by the City of Kent shall be given to King County Parks a
minimum of 72 hours prior to access to King County Parks via
parksproperty _kingcounty.gov
3. OWNERSHIP. King County shall retain ownership of the Site, Including all
improvements, permanent fixtures, and county -purchased equipment.
4. FUTURE PROJECT.
(a) The City acknowledges that King County may construct the Future Project
without the City's consent.
(b) King County will not assume responsibility for the success of Kent's work
if water levels and connectivity to the mitigation project change as a result of a future
King County restoration project.
S. TERM.
5.1 This Agreement shall remain in effect until the current existing Special
Use Permit (SUPS13-0042) issued by King County expires on November 12, 2023.
Thereafter, upon renewal and/or issuance of a new Special Use Permit, this
Agreement and its terms may be renewed in writing upon mutual agreement by the
parties.
5.2 Either Party may terminate this Agreement at any time upon written
notice to the other Party in accordance with Section 7. Termination of this Agreement
by the City shall result in termination of its Special Use Permit, except to the extent
necessary to perform any repair, maintenance, removal of the mitigation, and/or
remediation. Should either party terminate this agreement, any cost of repair,
maintenance, removal of the mitigation, and/or remediation shall be the City's
responsibility. If within a reasonable time of having notice, the City fails to perform
any repair, maintenance, removal, or remediation (collectively "repairs") that King
County reasonably deems necessary, King County shall have the option to perform
the repairs or retain a third -party to do so on its behalf. All expenses incurred by King
County to make such repairs shall be promptly reimbursed by the City to King County.
6. MUTUAL INDEMNIFICATION.
To the maximum extent permitted by law, each Party shall defend, indemnify, and
hold harmless the other Party, and all of its officials, employees, principals and
agents, from any and all claims, demands, suits, actions, fines, penalties and liability
of any kind, including injuries to persons or damages to property, arising out of or
relating to any negligent acts, errors or omissions of the indemnifying Party and its
contractors, agents, employees and representatives in performing these obligations
under this Agreement, unless such damages and injuries to persons or property are
caused by or result from the sole negligence or willful misconduct of King County or
its contractors, employees, agents, or representatives, or the City or its contractor
or employees, agents, or representatives. Each Party's obligation hereunder applies
only to the extent of the negligence of such Party or its contractor or employees,
agents, or representatives. This indemnification provision shall not be construed as
waiving any immunity grantcd to the City or King County, under state statute,
including chapters 86.12 and 86.15 RCW, as to any other entity.
This indemnity is specifically and expressly intended to constitute a waiver of each
Party's immunity under industrial insurance, Title 51 RCW, as respects the other Party
only, and only to the extent necessary to provide the indemnified Party with a full
and complete indemnity of claims made by the indemnitor's employees. This waiver
has been mutually negotiated.
7. NOTICE.
All communications regarding this Agreement shall be sent to the parties at the
addresses specified in this Section 6. Any written notice shall become effective upon
delivery, but in any event three (3) calendar days after the date of mailing by
registered or certified mail, and shall be deemed sufficiently given if sent to the
addressee at the address stated in this Section.

S. MISCELLANEOUS.
8.1 Compliance with Laws. The parties shall comply with all federal, state
and local laws, rules dnd regulations throughout every aspect in the performance of
this Agreement.
8.2 Nonwaiver of Breach. The failure of a party to insist upon strict
performance of any of the terms and rights contained herein, or to exercise any
option herein conferred in one or more instances, shall not be constructed to be a
waiver or relinquishment of those terms and rights and they shall remain in full force
and effect
8.3 Governing Law. This Agreement shall be governed and construed in
accordance with the laws of the State of Washington. If any dispute arises between
the parties or between any party and the contractor under any of the provisions of
this Agreement, resolution of that dispute shall be available only through the
jurisdiction, venue and rules of the King County Superior Court, King County,
Washington.
8.4 Attorney's Fees. To the extent not inconsistent with RCW 39.04.240, in
any claim or lawsuit for damages arising from the parties' performance of this
Agreement, each party shall be responsible for payment of its own legal costs and
attorney's fees incurred in defending or bringing such claim or lawsuit; however,
nothing in this subsection shall limit a party's right to indemnification under Section
6 of this Agreement.
8.5 Modification. No waiver, alteration, or modification of any of the
provisions of this Agreement shall be binding unless in writing and signed by a duly
authorized representative of each of the affected parties.
8.6 Severability. If any one or more sections, sub -sections, or sentences of
this Agreement are held to be unconstitutional or invalid, that decision shall not affect
the validity of the remaining portion of this Agreement and the remainder shall
remain in full force and effect.
8.7 Relationship. It is understood and agreed that no agency, employment,
joint venture, co -employer or partnership is created by this Agreement. No party
shall (i) have the power or authority to act for another in any manner to create
obligations or debts which would be binding upon another, and; (ii) be responsible
for any obligation or expense whatsoever of another.
8.8 Force Majeure. A party will not be in breach of this Agreement if unable
to perform its respective obligations as a result of the occurrence of an event of "force
majeure," which shall include, but not be limited to, acts of God, acts of the
government of the United States or of any state or political subdivision thereof,
strikes, civil riots or disturbances, fire, floods, explosions, earthquakes, wind, storms,
hurricanes, lightning or other similar catastrophes or other causes beyond the parties'
reasonable control. The scope of events of force majeure shall not extend to payment
of money owed hereunder.
8.9 Entire Agreement. The written provisions and terms of this Agreement,
together with any attached Exhibits, supersede all prior verbal statements by any
representative of the City, and those statements shall not be construed as forming a
part of or altering in any manner this agreement. This Agreement and any attached
Exhibits contain the entire Agreement between the parties. Should any language in
any Exhibit to this Agreement conflict with any language contained in this Agreement,
the terms of this Agreement shall prevail.
8.10 Binding Nature. The rights and responsibilities contained in this
Agreement shall inure to the benefit of and are binding upon the Parties and their
respective successors in interest and assigns.
8.11 Third Parties. This Agreement and any activities authorized hereunder
shall not be construed as granting any rights or privileges to any third person or
entity, or as a guarantee or warranty of protection from flooding or flood damage to
any person, entity or property, and nothing contained herein shall be construed as
waiving any immunity to liability to the City or King County, granted under state
statute, including Chapters 86.12 and 86.15 RCW, or as otherwise granted or
provided for by law.
8.12 Counterparts. The parties may sign this Agreement in several
counterparts, each of which will be deemed an original but all of which together will
constitute one instrument.
8.13 Effective date. This Agreement will become effective when all the
parties have signed it. The date this agreement is signed by the last party to sign it
will be deemed the date of this Agreement.

Dear Mr. Knox:
We have received your application for a Department of the Army (DA) permit to place up to
six large woody debris structures in Reach 11 of Rock Creek at Kent, Washington, as depicted
on the enclosed drawings dated December 21, 2016. We have reviewed the information you
provided to us pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and
Harbors Act of 1899. We have determined that a DA permit is not required for your proposed
--work-as described in your application and drawings.
Under Section 10 of the Rivers and Harbors Act of 1899, a Section 10 DA permit is
normally required for work or structures in or affecting navigable waters of the U.S. Because
Rock Creek is not a navigable water, a Section 10 DA permit is not required.
Under Section 404 of the Clean Water Act, a DA permit is normally required for the
discharge of dredged or fill material (e.g., fill, excavation, or mechanized land clearing) into
waters of the U.S., including wetlands and navigable waters of the U.S. For more information,
see the enclosed Clean Water Act Extracts and Definitions. Rock Creek is a water of the U.S.
However, because placement of the Large Woody Debris does not involve a discharge of
dredged or fill material, a Section 404 DA permit is not required.
While a DA permit is not required, local, State, and other Federal requirements may still
apply. For assistance in determining other permit requirements for the proposed project, we
recommend you contact the Washington State Office of Regulatory Assistance via the internet at
www.ora.wa.gov.

EXTRACTS from the Clean Water Act:
1. SECTION 404
(a) The Secretary of the Army, acting through the Chief of Engineers, may issue permits,
after notice and opportunity for public hearings for the discharge of dredged or fill material into
the navigable waters at specified disposal sites.
(b) Subject to subsection (c) of this section, each such disposal site shall be specified for
each such permit by the Secretary of the Army (1) through the application of guidelines
developed by the Administrator of the Environmental Protection Agency (Administrator), in
conjunction with the Secretary of the Army, which guidelines shall be based upon criteria
comparable to the criteria applicable to the territorial seas, the contiguous zone, and the ocean
under section 403(c), and (2) in any case where such guidelines under clause (1) alone would
prohibit the specification of a site, through the application additionally of the economic impacts
of the site on navigation and anchorage.
(c) The Administrator is authorized to prohibit the specification (including the withdrawal
of specification) of any defined area as a disposal site, and he is authorized to deny or restrict the
use of any defined area for specification (including the withdrawal of specification) as a disposal
site, whenever he determines, after notice and opportunity for public hearings, that the discharge
of such materials into such area will have an unacceptable adverse effect on municipal water
supplies, shellfish beds and fishery areas (including spawning and breeding areas), wildlife, or
recreational areas. Before making such determination, the Administrator shall set forth in
writing and make public his findings and his reasons for making any determination under this
subsection.
2. SECTION 301
This section prohibits the discharge of any pollutant including fill or dredged material
except as in compliance with various sections of the Clean Water Act, including Section 404.
3. SECTION 307
The Administrator shall publish a list of toxic pollutants. Each toxic pollutant shall be
subject to effluent standards (which may include a prohibition). Under this section it is unlawful
to violate any such effluent standards or prohibition.
4. SECTION 309
This section provides that any person who willfully or negligently violates the provisions of
this Act may be punished by a fine of not less than $2,500 or more than $37,500 per day of
violation or by imprisonment for not more than one year or by both. In addition, any person
violating this Act may be subject to a civil penalty of not more than $37,500 per day of violation.
DEFINITIONS regarding the Clean Water Act:
The term "wetlands" means those areas that are inundated or saturated by surface or ground
water at a frequency and duration sufficient to support, and that under normal circumstances do
support, a prevalence of vegetation typically adapted for life in saturated soil conditions. The
Corps of Engineers has the responsibility for determining whether a specific wetland area is
within Section 404 jurisdiction.
The term "adjacent" means bordering, contiguous, or neighboring. Wetlands separated
from other waters of the United States by manmade dikes or barriers, natural river berms, beach
dunes, and the like are "adjacent wetlands."
The term "discharge of dredged material" means the addition, including redeposition, of
dredged material, runoff from a contained land or water disposal area, and any addition,
including redeposition, of excavated material. These activities include mechanized landclearing,
grading, filling in low areas, sidecasting of excavated material from new ditching work, and
other placement of excavated material into waters of the United States, including wetlands.
The term "discharge of fill material" means the addition of fill material used for the
primary effect of replacing any portion of a water of the U.S. with dry land or of changing the
bottom elevation of a water of the U.S., including wetlands. The placement of pilings constitutes
a discharge of fill material when such placement has or would have the effect of a discharge of
fill material.
The term "ordinary high water mark" means that line on the shore established by the
fluctuations of water and indicated by physical characteristics such as a clear, natural line
impressed on the bank, shelving, changes in the character of soil, destruction of terrestrial
vegetation, the presence of litter and debris, or other appropriate means that consider the
characteristics of the surrounding area.

Project Name: Rock Creek HCM 2, Rock Creek HCM 3 (Lower Rock Creek)
Project Description: HCM 2 is intended to improve upstream fish passage at the mouth of Rock Creek during low
flow periods. Passage improvements will consist of the adjustment of 20 existing rocks by
hand -methods directed by the project engineer. No grading will occur as a part of HCM 2.
HCM 3 is intended to connect a small unnamed wetland and pond (Wetland B), located
immediately west of Rock Creek, to the main creek channel by removing portions of a berm
that has isolated the historic channel. The connection of the wetlands with Rock Creek will
create and make available off -channel rearing and flood refuge habitat for use by juvenile
salmonid species.
Existing pond habitat will be improved by placement of large woody material in the pond to
provide cover for juvenile salmonids.
Seasonal off -channel flows in HCM-3 will follow an observable historic channel. It is believed
that a gravel extraction operation produced the ponded topography and the berms. During
extraction, Rock Creek was diverted to its current alignment. HCM-3 pierces the berms in
three locations allowing seasonal off -channel flows to access the historic corridor while not
dewatering the pond or causing any reduction in wetland area.
PROVISIONS
1. TIMING - PLANS - INVASIVE SPECIES CONTROL
1. TIMING LIMITATION: You may begin the project immediately, and you must complete the project by April 10, 2022,
provided work within the wetted perimeter shall occur only between July 1 and August 31.
2. APPROVED PLANS: You must accomplish the work per plans and specifications submitted with the application and
approved by the Washington Department of Fish and Wildlife (WDFW) entitled, "CLARK SPRINGS WATER SUPPLY
SYSTEM HABITAT CONSERVATION PLAN -- HCM 2, 3, & X6X CITY OF KENT", except as modified by this
Hydraulic Project Approval (HPA). You must have a copy of these plans and this HPA available on site during all
phases of the project proposal.
3. INVASIVE SPECIES CONTROL: Thoroughly clean all equipment and gear before arriving and leaving the job site to
prevent the transport and introduction of aquatic invasive species. Properly dispose of any water and chemicals used to
clean gear and equipment. You can find additional information in the WDFW's Invasive Species Management Protocols
(November 2012), available online at http://wdfw.wa.gov/publications/01490/wdfw01490.pdf.

NOTIFICATION REQUIREMENTS
4. PRE- AND POST -CONSTRUCTION NOTIFICATION: You, your agent, or contractor must contact WDFW by e-mail
at larry.fisher@dfw.wa.gov and at HPAapplications@dfw.wa.gov; mail to Post Office Box 43234, Olympia, Washington
98504-3234; or fax to (360) 902-2946 at least three business days before starting work, and again within seven days
after completing the work. The notification must include the permittee's name, project location, starting date for work or
date the work was completed, and the permit number. WDFW may conduct inspections during and after construction;
however, WDFW will notify you or your agent before conducting the inspection.
5. PHOTOGRAPHS: You, your agent, or contractor must take photographs of the job site before the work begins and
after the work is completed. You must upload the photographs to the post -permit requirement page in the Aquatic
Protection Permitting System (APPS) or mail them to WDFW at Post Office Box 43234, Olympia, Washington 98504-
3234 within 30-days after the work is completed.
6. FISH KILL/ WATER QUALITY PROBLEM NOTIFICATION: If a fish kill occurs or fish are observed in distress at the
job site, immediately stop all activities causing harm. Immediately notify WDFW Habitat Biologist at 425-313-5683 or
425-449-6790 of the problem. If the likely cause of the fish kill or fish distress is related to water quality, also notify the
Washington Military Department Emergency Management Division at 1-800-258-5990. Activities related to the fish kill
or fish distress must not resume until WDFW gives approval. WDFW may require additional measures to mitigate
impacts.
STAGING, JOB SITE ACCESS, AND EQUIPMENT
7. Establish staging areas (used for equipment storage, vehicle storage, fueling, servicing, and hazardous material
storage) in a location and manner that will prevent contaminants such as petroleum products, hydraulic fluid, fresh
concrete, sediments, sediment -laden water, chemicals, or any other toxic or harmful materials from entering waters of
the state.
8. Design and locate new temporary access roads to prevent erosion and sediment delivery to waters of the state.
9. Clearly mark boundaries to establish the limit of work associated with site access and construction.
10. Limit the removal of native riparian vegetation to the minimum amount needed to construct the project.
11. Retain all natural habitat features on the bed or banks including large woody material and boulders. You may move
these natural habitat features during construction but you must place them near the preproject location before leaving
the job site.
12. Confine the use of equipment to the specific access and work corridor shown in the approved plans.
13. Remove soil or debris from the drive mechanisms (wheels, tires, tracks, etc.) and undercarriage of equipment prior
to operating the equipment waterward of the ordinary high water line (OHWL).
14. Check equipment daily for leaks and complete any required repairs in an upland location before using the
equipment in or near the water.
15. Use environmentally acceptable lubricants composed of biodegradable base oils such as vegetable oils, synthetic
esters, and polyalkylene glycols in equipment operated in or near the water.
16. This HPA does not authorize equipment crossings of the stream.

18. Protect all disturbed areas from erosion. Maintain erosion and sediment control until all work and cleanup of the job
site is complete.
19. All erosion control materials that will remain onsite must be composed of 100% biodegradable materials.
20. Straw used for erosion and sediment control, must be certified free of noxious weeds and their seeds.
21. Stop all hydraulic project activities except those needed to control erosion and siltation, if flow conditions arise that
will result in erosion or siltation of waters of the state.
22. Prevent project contaminants, such as petroleum products, hydraulic fluid, fresh concrete, sediments, sediment -
laden water, chemicals, or any other toxic or harmful materials, from entering or leaching into waters of the state.
23. Route construction water (wastewater) from the project to an upland area above the limits of anticipated floodwater.
Remove fine sediment and other contaminants before discharging the construction water to waters of the state.
24. Deposit waste material from the project, such as construction debris, silt, excess dirt, or overburden, in an upland
area above the limits of anticipated floodwater unless the material is approved by the Washington Department of Fish
and Wildlife for reuse in the project.
25. Deposit all trash from the project at an appropriate upland disposal location.
CONSTRUCTION MATERIALS
26. Store all construction and deconstruction material in a location and manner that will prevent contaminants such as
petroleum products, hydraulic fluid, fresh cement, sediments, sediment -laden water, chemicals, or any other toxic or
harmful materials from entering waters of the state.
27. Do not stockpile construction material waterward of the OHWL.
LARGE WOOD INSTALLATION
28. Project installation is required to partially fulfill mitigation requirements resulting from the Clark Springs Water
Supply System Habitat Conservation Plan.
29. Place large wood or other materials consistent with natural stream processes as shown in the approved plans.
30. Install the large woody materials in a manner to withstand the 100-year peak flows.
31. Use fir, cedar, or other coniferous species to construct the large woody material habitat structures.
32. Do not release overburden material into the waters of the state when resloping the bank.
33. Avoid damaging existing vegetation when placing bank protection material.

revocation if the Department of Fish and Wildlife determines that changed conditions require such action. The person(s)

MINOR MODIFICATIONS TO THIS HPA: You may request approval of minor modifications to the required work timing
or to the plans and specifications approved in this HPA unless this is a General HPA. If this is a General HPA you must
use the Major Modification process described below. Any approved minor modification will require issuance of a letter
documenting the approval. A minor modification to the required work timing means any change to the work start or end
dates of the current work season to enable project or work phase completion. Minor modifications will be approved only
if spawning or incubating fish are not present within the vicinity of the project. You may request subsequent minor
modifications to the required work timing. A minor modification of the plans and specifications means any changes in the
materials, characteristics or construction of your project that does not alter the project's impact to fish life or habitat and
does not require a change in the provisions of the HPA to mitigate the impacts of the modification. Minor modifications
do not require you to pay additional application fees or be issued a new HPA. If you originally applied for your HPA
through the online Aquatic Protection Permitting System (APPS), you may request a minor modification through APPS.

clearly indicates you are seeking a minor modification to an existing HPA. Written requests must include the name of the
applicant, the name of the authorized agent if one is acting for the applicant, the APP ID number of the HPA, the date
issued, the permitting biologist, the requested changes to the HPA, the reason for the requested change, the date of the

If you wish to appeal the issuance, denial, conditioning, or modification of a Hydraulic Project Approval (HPA),
Washington Department of Fish and Wildlife (WDFW) recommends that you first contact the department employee who
issued or denied the HPA to discuss your concerns. Such a discussion may resolve your concerns without the need for
further appeal action. If you proceed with an appeal, you may request an informal or formal appeal. WDFW encourages
you to take advantage of the informal appeal process before initiating a formal appeal. The informal appeal process
includes a review by department management of the HPA or denial and often resolves issues faster and with less legal
complexity than the formal appeal process. If the informal appeal process does not resolve your concerns, you may
