The City and the Union are parties to a collective bargaining agreement ("CBA") effective January 1, 2017, through December 31, 2019. With the intent of continuing the process the parties agree to the following, for a three-year trial period, regarding the arming of Corrections Officers: The Kent Police Department ("KPD") is implementing a new process by which qualified Corrections Officers shall be transporting inmates charged or convicted of felonies in addition to their current duty of transporting inmates charged or convicted of misdemeanors. This will relieve commissioned police officers from the duty of transporting most felony inmates, which will allow them to dedicate more time and effort to their law enforcement duties and responsibilities. The parties believe this will result in a more efficient and effective delivery of public safety services to the citizens of Kent. SECTION 1. INITIAL IMPLEMENTATION To implement this new transport process, the parties have agreed to the following: A. Corrections officers who as of January 5, 2020 are occupying Day shift or Swing shift positions, will be eligible to apply for training to qualify to use a firearm while performing the duties of transport officer or work crew coordinator. B. For those employees who applied for the initial training, the City shall select and provide training for up to six (6) employees during the January 2020 rotation. The Work Crew Coordinator will be included in the first round of training. PD shall determine the training and qualification standards and schedules. Training, including classroom and range, must be completed and successful firearm weapon qualifications must be met by at least one (1) Corrections Officer selected prior to the commencement of this Transport Officer program. C. Each employee who passes the initial training and qualify per KPD standard, Police Administration will assign the employee a firearm and he/she will be eligible to serve as a qualified Transport Officer when the program commences. Corrections Officers hired after January 1, 2020 must become KPD weapons qualified within one year of hire date. Failure to qualify within that time frame may lead to discipline up to, and including, termination. SECTION 2. CONTINUED MAINTENANCE OF TRAINING & QUALIFICATIONS Once the initial Transport Officer(s) have been trained and qualified, the parties agree to maintain the training for this program as follows: A. The KPD is committed (within budgetary parameters and KPD availability) to training up to five (5) current Corrections Officer per training cycle to meet firearm weapons qualification. This training and qualification track will continue until all City of Kent Corrections Officers who volunteer to become trained and firearm qualified have had an opportunity to do so. After the initial training, with at least two (2) qualified transport officers, selection will be based on seniority. B. The KPD shall determine, at its discretion, the training and qualification standards. C. Once an employee has been trained and qualified for firearms, the employee shall maintain his/her qualifications according to KPD policies, procedures and standards. D. After January 1, 2021, should a shift rotation cycle pass, during which no qualified Corrections Officers bid for day and/or swing shifts the City reserves the right to rotate a qualified transport officer, based on inverse seniority, from a different shift onto the shift lacking a qualified Transport Corrections Officer. This shall not apply should there be a qualified volunteer to rotate to the affected shift. SECTION 3. ASSIGNMENT OF TRANSPORT OFFICER DUTIES A. The transport of felonies shall only be assigned to weapons-qualified personnel when Police Administration assigns such to Corrections staff. B. The transport of misdemeanants is currently a part of a Corrections Officer's regularly assigned duties and responsibilities. Police Administration, at its discretion, may assign the transport of misdemeanants to weapons-qualified or to non-weapons qualified personnel. C. The parties acknowledge that the transporting of felonies is currently performed by Patrol staff. Patrol shall continue to maintain the right to City of Kent and AFSCME Local #2617 MOU re: Corrections Transport Officer Page 3 of 4 transport felonies as the Police Administration deems appropriate to assign such duty. SECTION S. MISCELLANEOUS To the extent that the specific content of this MOU directly conflicts with any of the terms of the current CBA between the City and the Union, this MOU shall control. If the specific content of this MOU directly conflicts with any of the terms of the successor Agreement, the successor Agreement shall control. All other provisions of the CBA shall remain unaffected by this MOU. SECTION 6. SIGNATURES By signature below, all parties agree that the above represents the parties' full and entire agreement with regard to the Corrections Transport Officer assignment.
