AMENDMENT TO AGREEMENT
This Amendment to Agreement is made by and between the
EAST HILL COMMUNITY WELL COMPANY, a Washington corporation, ( "the
Company) " and the CITY OF KENT , a Washington municipal
corporation, ( "the City" ) .
RECITALS
A. The Company and the City entered into an agreement
dated May 1 , 1985 providing for the takeover by the The City of
the Company' s water service facilities and responsibilities.
B. The Company and the City are desirous of amending
that Agreement to provide for clarification of provision relating
to water rates applicable to two properties lying outside areas
of annexation.
NOW THEREFORE, the parties do hereby mutually agree that
paragraph 1 . 3 of the Agreement shall be and is hereby amended to
include the following additional language:
"In such event, Company shareholders currently served by
the Company whose property lies outside the annexation
areas outlined in Exhibit "C" shall be entitled to
within rates so long as those shareholders shall
continue to occupy their properties. "
All other terms and conditions of said Agreement shall
remain unchanged and remain in full force and effect.
