Condition of approval #13 requires onetree to be planted for every 40 feet of street within the plat. sheet L2.0 of the approvedcivil construction plans (RECC 2L43OL7) showed 26 trees to be planted along'streetedges in compliance with this condition. However, City staff completed the o-ne-yearmaintenance walk-thru for this project in June 2019 and found that these required treeswere not planted. You were notified of these findings in a letterdated June27,2019. In response to the City's letter, you provided Kent Planning staff with a letter from thepresident of the Marbella Homeowners Association stating that the required trees arenot wanted by the HOA. You also inquired about planting the required trees off-site, butCity staff determined that these trees are not needed foi any pubtic projects. Thereiore,you have agreed to pay the City a fee of $14,5O6.00 in-lieu of planting the requiredtrees. This fee was derived from a cost estimate prepared on t0/3/2019 by a qualified landscaping professional, and the funds will be used for planting and maintiining public street trees in other areas of the City. By signing this letter, the City agrees to'accept Lungren Homes'offer to pay a fee in-lieu of planting 26 trees. Please acknowledge Lungren Homes'agreement to pay the feein-lieu subject to the terms of this letter by signing in the spaci provided below, thenscan and email the signed letter to Cheryl Rolcik-Wilcox at crolcik-wilcoxtfikentwa.gcv. Payment can also be mailed to Cheryl's attention at the aUove-tisteO aOdress.
