A RESOLUTION of the City Council of the
City of Kent, Washington, authorizing the
assessment of service and convenience fees for
processing credit card, debit card, and eCheck
transactions.
RECITALS
A. The volume of credit card, debit card, and online transactions
has grown substantially over the past several years, and the trend of
increased use of these methods of payment is expected to continue.
B. The City incurs significant costs associated with processing
credit card, debit card, and eCheck transactions, and implementing a service
or convenience fee is a necessary means of avoiding those costs which
amount to over $700,000 annually.
C. The City could offset these significant transaction costs by
assessing a service fee and/or convenience fee which could be based on a
percentage of a transaction or a flat fee per transaction.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:

RESOLUTION
SECTION 1. - Service and Convenience Fees. The Finance Director
is authorized to implement a service fee and/or a convenience fee for the
purpose of avoiding or offsetting the cost of processing credit card, debit
card, and eCheck transactions.
SECTION 2. - Amount of Fees. The Finance Director should monitor
credit card, debit card, and eCheck processing fees relative to processing
costs, and may adjust the fees as necessary in an effort to avoid or offset
processing costs. The Director should also conduct such monitoring and may
make adjustments to ensure fees are reasonable and in line with industry
standards.
SECTION 3. - Severability. If any one or more section, subsection,
or sentence of this resolution is held to be unconstitutional or invalid, such
decision shall not affect the validity of the remaining portion of this resolution
and the same shall remain in full force and effect.
SECTION 4. - Corrections by City Clerk. Upon approval of the city
attorney, the city clerk is authorized to make necessary corrections to this
resolution, including the correction of clerical errors; resolution, section, or
subsection numbering; or references to other local, state, or federal laws,
codes, rules, or regulations.
SECTIONS. - Effective Date. This resolution shall take effect and be
in force immediately upon its passage.
