A RESOLUTION of the City Council of the
City of Kent, Washington, relating to the water utility
and declaring an emergency because reduced rainfall
and a probable drought constitute an unforeseen
circumstance beyond the City's control that presents a
real and immediate threat to the proper performance of
the City's water system, and providing for: (1) the
expedited construction and installation of an additional
pump motor at Kent Springs; (2) the drilling of a
replacement well and the installation of pumps and all
necessary appurtenances at 2Iz!h Street well site; (3) the
reconstruction of a new intertie with the City of Auburn
in the vicinity of 27ih and 78th Avenue; (4) the
reconstruction a new intertie with Soos Creek Water and
Sewer District in the vicinity of 1141h Way and 228th
block; and (5) the waiving of competitive bid
requirements.
WHEREAS, rainfall this year is 54% below the average, and Governor
Locke has declared a state of emergency for an expected drought to occur in the
summer months of2001; and
WHEREAS, because ofthis low rainfall, summer demand on the City's
water supply system may strain the City's water supply services earlier in the summer
season and for an extended period of time; and
WHEREAS, all aquifers are experiencing lower than normal water
levels for this time of year; and

WHEREAS, the Kent Springs aquifer has not been able to adequately
supply the City's infiltration gallery at this site; and
WHEREAS, the City Council finds it necessary to provide for the
expedited construction and installation of an additional pump motor at one Kent
Springs well site; the drilling of a replacement well and the installation of pumps and
all necessary appurtenances at the 21zth Street well site; the redesign and
reconstruction of a modified intertie with the City of Auburn in the vicinity of 2771h
and 78th Avenue; and the redesign and reconstruction of a modified intertie with Soos
Creek Water and Sewer District in the vicinity of 1141h Way and the 228th block, all to
provide for additional existing and emergency backup sources of municipal water
supply; and
WHEREAS, statutory bid procedures for public works projects would
not allow for the construction of such facilities in time to complete these projects
before critical summer demand occurs; and
WHEREAS, the existence of this reduced rainfall and its resultant
drought constitutes an unforeseen circumstance beyond the City's control that presents
a real and immediate threat to the proper performance of the City's water system,
thereby making it appropriate to waive the application of the competitive bidding
requirements by declaring an emergency pursuant to RCW 39.04.280; NOW
THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The existence of reduced rainfall and its resultant drought
constitutes an unforeseen circumstance beyond the City's control that presents a real
and immediate threat to the proper performance of the City's water system, thereby

making it appropriate to waive the application of the competitive bidding requirements
by declaring an emergency pursuant to RCW 39.04.280.
SECTION 2. The Public Works Department may immediately proceed
with the design, construction, and installation of: (1) an additional pump motor and all
necessary appurtenances at its Kent Springs well site; (2) the drilling of a replacement
well and the installation of pumps and all necessary appurtenances at the 212 1h Street
well site; (3) the redesign and reconstruction of a modified intertie with the City of
Auburn in the vicinity of 277 1h and 78th Avenue; and (4) the redesign and
reconstruction of a modified intertie with Soos Creek Water and Sewer District in the
vicinity of 1141h Way approximately the 228 1h block.
SECTION 3. Although these projects are exempt from competitive
bidding requirements, these contracts shall remain subject to all other applicable public
works requirements, including, holdback of contract retainage, payment of
performance bonds, and payment of prevailing wage rates.
SECTION 4. The Public Works Department is further authorized to
proceed to contract for the acquisition of pumps, motors, equipment, and all other
necessary appurtenances and to contract for the construction and installation for the
purposes provided herein.
SECTION 5. If any section, subsection, paragraph, sentence, clause, or
phrase of this resolution is declared unconstitutional or invalid for any reason; such
decision shall not affect the validity of the remaining portions ofthis resolution.
SECTION 6. Any act consistent with the authority and prior to the
effective date of this resolution is hereby ratified and affirmed.

SECTION 7. This resolution shall take effect and be m force
immediately upon its passage.
PASS ED at a regular open public meeting by the City Council of the City
of Kent, Washington, this 2P day of March, 2001.
