Other Approval Authority: ❑ Director �✓ Mayor City Council Other Details: MOU for New Shift Schedules and Bidding Procedures MEMORANDUM OF UNDERSTANDING By and Between the CITY OF KENT and WASHINGTON STATE COUNCIL OF COUNTY AND CITY EMPLOYEES Representing the AFSCME, AFL-CIO, LOCAL #2617 Regarding NEW SHIFT SCHEDULES AND BIDDING PROCEDURES This Memorandum of Understanding ("MOU") is entered by and between the City of Kent ("City") and the Washington State Council of County and City Employees, AFSCME, AFL-CIO, Local #2617 (Union). The parties agree to the following changes regarding Corrections Officer and Sergeant shift schedules, rotations, and shift bidding processes: Corrections Position Bidding and Bid Rotation The City and the Union are parties to a collective bargaining agreement ("CBA") effective January 1, 2017, through December 31, 2019. The City and the Union agree to change the shift bidding and bid rotation process that applies to Corrections Officer and Corrections Sergeant positions, for a one-year trial period, in an effort to improve efficiency in the bidding process and increase morale. Section 36.2 of the CBA, entitled "Corrections Position Bidding," and Appendix E to the CBA, will remain in place except to the extent those existing provisions conflict with the following provisions that will apply during the one-year trial period. If there is a conflict between the terms of this MOU and the CBA, the terms of this MOU will control. The following provisions shall apply to the next shift bidding cycle, which is scheduled to begin on June 1, 2019, and for all subsequent shift bidding cycles that occur through May 31, 2020: • One of the day shift assignment slots in each rotation will be replaced with a new "power" shift from 0900-1900 hours. The new power shift will be included in the bid cycle that is opened on June 1, 2019, and applicable for the September through December rotation. Appendix E will be updated for the June 1, 2019, shift bidding to reflect these available shift assignment changes. • Appendix E will also be updated for the June 1, 2019, shift bidding to replace the current five shift assignment rotations with two revised shift assignment rotations: Shift Assignment Rotation 1 and Shift Assignment Rotation 2 (attached). With each four-month bid cycle, shift bidding will alternate between these two shift assignment schedules. The bid cycle that opens on June 1, 2019, will bid for shift assignments applicable beginning with the bid rotation that begins on September 1, 2019, and ends on December 31, 2019, utilizing the schedule for "Shift Assignment Rotation 1." • Section 36.2 of the CBA is also revised to provide that the process for the second bid cycle (May - August) and third bid cycle (September - December), shall give priority to the most senior personnel for shift assignment/days off preference, rather than the process for the first and second bid cycle as the CBA currently provides. The process for the first bid cycle (January - April) is revised to give preference to the least senior personnel, who shall have first choice in shift assignment/days off preference. • Section 36.2 of the CBA is further amended to provide that Corrections Officers and Corrections Sergeants will be similarly treated and are no longer limited in their ability to bid a particular shift assignment due to previous days off they enjoyed under a prior shift assignment and bid rotation. The changes outlined in this MOU will be in effect until May 31, 2020. At that time, or such other time as the parties may agree, all Corrections Officers and Corrections Sergeants will vote to either keep the new shift assignment and bid procedures outlined in this MOU or revert to the prior practices outlined in Section 36.2 and Appendix E of the 2017-2019 CBA. All other language of the CBA, including Section 36.2 and Appendix E, that are not specifically amended by this MOU shall remain in full force and effect and shall not be altered by this MOU. This MOU was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOU, it shall be interpreted evenly, and not against the drafter of the MOU. The principle of contra proferentem shall not apply.
