AN ORDINANCE of the City Council of the City of Kent, Washington, amending the Parks and Recreation Element and the Capital Facilities Element of the City's Comprehensive Plan related to the adoption of a Park and Open Space Plan. (CPA -2016-3). RECITALS A. Pursuant to the Growth Management Act (GMA), the city's comprehensive plan provides for planning activities and capital budget decisions that are consistent with the comprehensive plan. RCW 36.70A.120. B. The city council's strategic goals include the creation of neighborhood urban centers, connections for people and places, fostering inclusiveness, and beautifying Kent. C. The GMA requires the city of Kent to establish procedures governing amendments to the comprehensive plan that limit amendments to once each year unless certain circumstances exist. RCW 36.70A.130(2). The city has established a procedure for amending the 1 Comprehensive Plan Amendment Park and Open Space Plan CPA 2006-13 comprehensive plan in Chapter 12.02 of the Kent City Code (KCC) that permits amendments in addition to the standard annual update if an emergency exists. An emergency is defined as an issue of community wide significance that promotes the public health, safety, and general welfare of the city of Kent. KCC 12.02.010(A). D. On January 11, 2016, the Economic and Community Development Committee moved to direct staff to update the Park and Open Space Plan. On January 19, 2016, the Kent City Council passed Resolution No. 1919, which authorized staff to move forward with the comprehensive plan amendment. The recitals of Resolution No. 1919 are incorporated herein by reference. E. The 2016 Park and Open Space Plan update continues with the significant shift in both approach and goals that was started in the previous update and anticipated in the 2015 update of the Kent Comprehensive Plan. When the Park and Open Space Plan is integrated into the Parks and Recreation Element of the city's comprehensive plan, it will direct future development, acquisition and renovation of parks and open spaces for the short and long-term future. The Parks and Recreation Element provides the foundation and guidance for the park system within the City. The Parks and Recreation Element includes an inventory of existing parks and open spaces, level of service standards, a summary of public participation, goals and policies, and opportunities for regional coordination. F. In general, the Capital Facilities Element of the city's comprehensive plan provides guidance for the provision and maintenance of public services and capital facilities required to support anticipated 2 Comprehensive Plan Amendment Park and Open Space P/an CPA 2006-Y3 growth over the next 20 years. The Capital Facilities Element includes a summary of park facilities and level of service standards that need to be amended with the information from the updated Park and Open Space Plan. G. The Park and Open Space Plan has undergone an extensive public process. In 2012, Kent Parks put together a citizens' committee to review the parks asset analysis and prioritize a list of parks capital projects. City staff, assisted by the newly -formed Parks Commission, reached out to the public in a variety of ways over the summer of 2015. Staff and Commissioners attended several community events, and invited attendees to participate in an informal online survey about the park system. A second, more formal, survey was mailed to randomly selected residents in late summer of 2015; that survey received 603 responses. H. On March 17, 2016, the city provided the State of Washington the required 60 -day notification under RCW 36.70A.106 of the City's proposed amendments, via email. No comments were received. I. On April 18, 2016, the city's State Environmental Policy Act (SEPA) Responsible Official issued an Addendum to the City of Kent Comprehensive Plan Review and Midway Subarea Planned Action Environmental Impact Statement and City of Kent Downtown Subarea Action Plan Planned Action Supplemental Environmental Impact Statement. The Addendum did not identify any additional significant adverse environmental impacts associated with the proposed comprehensive plan amendments. 3 Comprehensive Plan Amendment Park and Open Space Plan CPA 2006-13 ). On March 28, 2016, the Land Use and Planning Board ("LUPB") held a workshop to discuss the update to the Park and Open Space Plan as well as associated amendments to the Capital Facilities and Parks and Recreation Elements of the Kent Comprehensive Plan. On April 25, 2016, the LUPB held a public hearing to consider the matter. At the close of the public hearing, the LUPB voted to recommend approval of the comprehensive plan amendments. K. The Kent City Council's Economic and Community Development Committee considered the LUPB's recommendation at its regularly -scheduled meeting on May 9, 2016 and forwarded its own recommendation to the full City Council. The Park and Open Space Plan update was also considered by the City Council's Parks and Human Services Committee on April 21, 2016 and May 19, 2016. L. On June 7, 2016, the City Council approved incorporation of the Park and Open Space Plan into the comprehensive plan by reference as well as corresponding amendments to the Parks and Recreation Element and the Capital Facilities Element of the comprehensive plan. These amendments were made in accordance with KCC 12.02.050. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: ORDINANCE SECTION Y. -Incorporation of Recitals. The preceding recitals are incorporated herein. 4 Comprehensive Plan Amendment Park and Open Space Plan CPA 2006-13 SECTION 2. - Amendment. The 2016 Park and Open Space Plan is incorporated into the Kent Comprehensive Plan by reference and attached as Exhibit "A." The Parks and Recreation Element and Capital Facilities Element of the City of Kent's Comprehensive Plan are amended as attached and incorporated as Exhibit "B" and Exhibit "'C," respectively. SECTION 3. -Severability. If any one or more sections, sub- sections, or sentences of this ordinance are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this ordinance and the same shall remain in full force and effect. SECTION 4, -Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state or federal laws, codes, rules, or regulations; or ordinance numbering and section/subsection numbering. SECTION 5. -Effective Date. This ordinance shall take effect and be in force 30 days from and after the date of passage as provided by law.
