REGARDING
COURT SECURITY OFFICER COVERAGE
This Memorandum of Understanding (MOU) is entered into by and between the City
of Kent ("City") and the Washington State Council of County and City Employees,
AFSCME, AFL-CIO, Local #2617 ('Union") to memorialize an agreement reached
between the City and the Union regarding the coverage of misdemeanor inmate
transport duties performed by Court Security Officer special commission position(s)
in the Kent Municipal Court.
The City and Union agree that the 'Court Security Officer" positions in the Kent
Municipal Court perform, and shall always in the future perform, KPOA bargaining
unit work. The City and the KPOA have mutually agreed that the Court Security
Officer positions will, for now, remain non-represented positions. One of the essential
functions of the Court Security Officer position, and included within the special
commission issued by the Kent Police Department, is to provide armed escort and
transport of felony inmates. The duties of the position may also require that the Court
Security Officer back up Union's Corrections Officers, when necessary, to escort
and/or transport misdemeanor inmates.
The City and Union agree that escort and transport of misdemeanor inmates is Union
work and shall only be performed by a Court Security Officer when it is not reasonably
possible for a Corrections Officer to perform the transport. If the need for a
misdemeanor transport is known in advance, the City will attempt to arrange for an
on-duty Corrections Officer or an overtime Corrections Officer to perform the
transport. If, however, an immediate need arises for a misdemeanor escort or
transport, and a Corrections Officer is not available to perform the transport due to
other operational needs, then in that event, the Court Security Officer may perform
the misdemeanor escort or transport.
To the extent the terms of this MOU conflict with the CBA, the terms of this MOU shall
control.
Any dispute regarding the interpretation or application of this MOU shall be handled
in accordance with the grievance procedures set forth in the CBA.
This MOU shall not be interpreted to create a past practice, nor shall it be precedent
setting in terms of how future similar issues will be resolved.
This MOU was prepared and/or reviewed by both parties. In the event of an ambiguity
in any term of this MOU, it shall be interpreted evenly, and not against the drafter of
the MOU. The principle of contra proferentem shall not apply.
By signing below, the parties agree that the above represents the parties' full and
entire agreement with respect to the subject matter of this MOU.
