AN ORDINANCE of the City Council of the
City of Kent, Washington, amending the Kent City
Code by adding a new Section 9.38.195, entitled,
"Failure to respond - Penalty."
RECITALS
A. RCW 46.63.110 permits a local legislative body to set a
monetary penalty not to exceed twenty-five dollars for the failure to
respond to a notice of infraction relating to parking.
B. The Kent City Council has determined that it would be
appropriate to recoup the costs attributable to the non-payment of parking
violations through the imposition of the twenty-five dollar penalty.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:
ORDINANCE
SECTION 1. - Amendment. Chapter 9.38 of the Kent City Code is
hereby amended to add a new Section 9.38.195, entitled, "Failure to
respond - Penalty," as follows:

Sec. 9.38.195. Failure to respond - Penalty. Any person who
fails to respond to a notice of infraction relating to parking shall, in
addition to all other penalties and assessments, be assessed a penalty of
twenty-five dollars for failing to respond. For the purposes of this
subsection, a person shall be deemed to have failed to respond if he or she
fails to timely pay any required penalty as stated on the notice of infraction
or as required by the court, or fails to appear at the properly scheduled
hearing to contest or mitigate the parking infraction.
SECTION 2, - Corrections by City Clerk or Code Reviser. Upon
approval of the City Attorney, the City Clerk and the code reviser are
authorized to make necessary corrections to this ordinance, including the
correction of clerical errors; ordinance, section, or subsection numbering;
or references to other local, state or federal laws, codes, rules, or
regulations.
SECTION 3. - Severabilitv. If any one or more section, subsection,
or sentence of this ordinance is held to be unconstitutional or invalid, that
decision shall not affect the validity of the remaining portion of this
ordinance and that remaining portion shall maintain its full force and
effect.
SECTION 4. - Effective Date. This ordinance shall take effect and
be in force thirty (30) days from and after its passage and publication, as
provided by law.
