HomeMy WebLinkAbout1856Resolution No. 1856 (Amending or Repealing Resolutions) CFN = 118-Parks & Human Services Department Passed-4/17/2012 Authonz1ng applications to the Recreation & Conservation Office (RCO) for state funding ass1stance RESOLUTION NO. /Jl ~-~ A RESOLUTION of the City Council of the City of Kent, Washmgton, authonz1ng applications to the Recreat1on and Conservation Off1ce (RCO) for state fundmg assistance for a Washmgton Wildlife and Recreation Program ("WWRP") as prov1ded 1n Chapter 79A.15 RCW, Acqu1S1t1on of Hab1tat Conservation and Outdoor Recreation Lands. RECITALS A. The City of Kent has approved a comprehensive plan that includes the propert1es w1thm the Panther Lake area. B. Under the prov1s1ons of the WWRP, state funding ass1stance has been requested to a1d 1n fmanc1ng the acqu1S1t1on of property in the Panther Lake area. C. The City of Kent cons1ders it in the best public mterest to complete the acqu1S1t1ons of properties w1th1n the Panther Lake area. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: 1 Recreation and Conservation Office Grant Application l RESOLUTION SECTION 1. -Application. The c1ty's Parks, Recreation, and Commumty Serv1ces director 1s authonzed to make formal appl1cat1on to RCO for fundmg ass1stance. SECTION 2. -Use of Funds. Any fundmg ass1stance rece1ved w1ll be used for the 1mplementat1on of the proJect referenced above, wh1ch is the acqws1t1on of properties withm the Panther Lake area. SECTION 3. -Non-Cash Commitments. The City of Kent acknowledges that it is responsible for supporting all non-cash commitments to the sponsor share should they not matenal1ze. SECTION 4. -Use Retamed in Perpetuity. The City of Kent acknowledges that any property acquired or facility developed w1th Recreation and Conservation Fund1ng Board (RCFB) fmanc1al a1d must be placed 1n use for the funded purpose as an outdoor recreation facil1ty and be retained in such use m perpetuity unless otherwise prov1ded and agreed to by the City of Kent and RCFB. SECTION 5. -Resolution -Part of Application. This resolution may become part of a formal appl1cat1on to RCO. SECTION 6. -Public Comment. The City of Kent provided appropnate opportunity for public comment heard on Apnl 17, 2012. SECTION 7. -Severability. If any section, subsect1on, paragraph, sentence, clause or phrase of th1s resolution IS declared unconstitUtional or invalid for any reason, such deciSIOn shall not affect the val1d1ty of the remam1ng port1ons of th1s resolution. 2 Recreation and Conservation Office Grant Application - SECTION 8. -Ratification. Any act consistent with the authority and pnor to the effect1ve date of th1s resolution 1s hereby rat1f1ed and affirmed. SECTION 9. -Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the code rev1ser are authonzed to make necessary corrections to this resolution, includmg the correct1on of clencal errors; references to other local, state or federal laws, codes, rules, or regulations; or resolution numbering and sect1onjsubsect10n numbenng. SECTION 10. -Effective Date. Th1s resolution shall take effect and be in force immediately upon 1ts passage.
