A RESOLUTION of the City council of the
city of Kent, Washmgton, wa1vmg compet1t1ve
bidd1ng procedures for the replacement of the
nett1ng at the R1verbend Drivmg Range.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES
HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. Findmgs. The city counc1l of the city of Kent,
Washington, makes the following find1ngs to establish an emergency
wa1ver of compet1t1ve b1ddmg requirements pursuant to RCW 39.04.280:
A. On January 19, 2012, the c1ty of Kent was h1t With a snow,
1ce, wmd and ram storm that caused catastrophic damage throughout the
c1ty. Power was lost, trees were damaged, streets were shut down, and the
general operations of the city were disrupted.
B. The nettmg at the R1verbend golf course drivmg range was
completely destroyed. The net collapsed, shattenng snow and 1ce onto the

dnv1ng range facility, onto the adJommg Green R1ver trail, and on to
ne1ghbonng property.
C. The dnvmg range 1s open daily, year-round. With the net
down, patrons are not able to use the dnvmg range as it normally
functions, and as a result, patrons are not as l1kely to use the city's dnvmg
range, resultmg in economic loss to the c1ty's golf course fac1l1ties.
D. The heavily-used Green R1ver pedestnanjb1ke trail borders the
south s1de of the dnvmg range, resultmg in the potential for the Increased
nsk of harm to persons usmg the tra1l, and add1t1onal damage to the trail.
E. The Colony Park apartments border the west s1de of the
driving range. These apartments, its res1dents, visitors, and vehicles are
subject to damage from errant golf balls 1f the nettmg IS not 1mmed1ately
replaced.
F. The above-descnbed Situation constitutes an emergency that
results from an unforeseen Circumstance that was beyond the control of
the City that presents a real, 1mmed1ate threat to the proper performance
of the c1ty's golf fac1l1ties and the Green R1ver tra1l, and 1t w1ll result 1n a
matenal loss and damage to public and pnvate property.
G. The c1ty council finds that 1t 1s appropriate for the City to enter
into an emergency public works contract for the replacement of the
R1verbend golf course dnvmg range nett1ng.
SECTION 2. Emergency Declared: Competitive Bidding
Requirements Watved. Based on the preced1ng Findmgs, an emergency
ex1sts and 1n accordance With RCW 39.04.280, 1t is appropnate to wa1ve
competitive biddmg requirements and to directly contract w1th a contractor

the c1ty determmes is best able to replace and 1nstall the dnv1ng range
nett1ng. City staff IS directed to employ its best efforts to obtain the most
advantageous pncmg for th1s work, g1ven the existence of th1s emergency.
SECTION 3. -Severability. If any sect1on, subsect1on, paragraph,
sentence, clause or phrase of th1s resolution 1s declared unconst1tut1onal or
invalid for any reason, such decision shall not affect the val1d1ty of the
remammg portions of th1s resolution.
SECTION 4. -Effective Date. This resolution shall take effect and
be in force 1mmed1ately upon 1ts passage.
PASSED at a regular open public meeting by the city council of the city
of Kent, Washington, th1s 7th day of February, 2012.
CONCURRED in by the mayor of the city of Kent this 7th day of
February, 2012.
