HomeMy WebLinkAbout3981ORDINANCE NO. 32 9 / AN ORDINANCE of the City Council of the City of Kent, Washington, amending Section 7.05.090 Kent City Code to defer scheduled annual rate increases for storm water utility fees by one (1) year. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: ORDINANCE SECTION 1. -Amendment. Section 7 .05.090 of the Kent City Code entitled "System of Charges" 1s amended to defer the annual rate increases for storm water ut1l1ty fees by one (1) year as follows: Sec. 7.05.090. System of charges. A. There 1s hereby imposed a system of charges on each parcel of real property within the city served by or to which is available for service the 1 Stormwater Utility Fees Amend KCC 7.05.090 storm and surface water utility established by this chapter. The charges are found to be reasonable and necessary to fund administration, planning, design, construction, operation, maintenance, repair, improvement, and replacement of all existing and future storm and surface water facilities, including the accumulation of reserves and the retirement of any associated debt. B. The following charges are hereby established for all parcels of real property in the city: 1. Res1dent1a/ parcels. The single-family residential rate shall be as follows: Charged in Dollars Per Month, Per Residential Dwelling Effective January 1, 2007 $2.57 plus the basm- spec1f1c charge of subsection (B)(S) of this section. Effective January 1, 2012 $-13-3-111.57 Effective April 1, 2009 $8.75 Effective January 1, 2013 $±5a-9-13.31 Effective January 1, 2010 $10.06 Effective January 1, 2014 $-175915.30 Effective January 1, 2011 $11.5710.06 EffiH;;tiv~ J§nYS'!D!: 1 1 2015 $17.59 The bas1n-spec1fic charge set forth under subsection (B)(S) of this section shall apply to res1dent1al dwellings through March 31, 2009, but shall be eliminated a~er that date. SECTION 2. The adjusted fees are for services beginning January 1, 2011. 2 Stormwater Utility Fees Amend KCC 7.05.090 SECTION 3. -Savmgs. The existing section 7.05.090 of the Kent City Code, which 1s amended by this ordinance, shall remain in full force and effect until the effective date of this ordinance. $ECTION 4. -Severability. If any one or more sections, subsections, or sentences of this ordinance are held to be unconstitutional or 1nval1d, such dec1s1on shall not affect the val1d1ty of the remaining portion of this ordinance and the same shall remain in full force and effect. SECTION 5. -Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the code reviser are authorized to make necessary corrections to this ordinance, 1nclud1ng the correction of clerical errors, references to other local, state or federal laws, codes, rules or regulations; or ordinance numbering and section/subsection numbering. SECTION 6.-Effective Date. This ordinance shall take effect and be m force thirty (30) days from and a~er its passage as provided by law. ATTEST: 3 _ ..............
