A RESOLUTION of the City Council of the
City of Kent, Washmgton, repealmg Resolution No.
1793, and readopting a fee schedule for the Kent
Corrections Facility Programs and fees of the Kent
Police Department.
RECITALS
A. Through its adoption of Resolution No. 1793 on August 19,
2008, the Kent City Council established a number of fees for the Kent
Corrections Facilities programs and the fees for the Kent Police
Department. These fees were established by resolution rather than by
ord1nance so that the fees could be adjusted by Council without amendmg
the text of the Kent City Code.
B. The Kent Police Department has requested that the Kent City
Council adopt a new fee schedule, wh1ch spec1f1cally prov1des that staff
may waive, at their discretion, program fees m order for those programs to
be made available to the indigent, poor, or inf1rm who would otherw1se
qualify, or to more effectively manage the inmate population at the Kent
Corrections Facility. Other than providing for this fee wa1ver, all fees
established through Resolution No. 1793 remain unchanged by th1s new
resolut1on.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -Repealer -Resolution No. 1793. Resolution No.
1793, adopted by Council on August 19, 2008, IS hereby repealed in its
ent1rety.
SECTION 2. -Fee Schedule and Fee Schedule Notes. The fee
schedule attached and incorporated as Exhibit A is hereby adopted and
established as the fee schedule for the City of Kent Corrections Facility
Programs and the City of Kent Police Department.
SECTION 3. -Savings. All fees prev1ously charged shall remain in
full force and effect unt1l the effective date of th1s resolution.
SECTION 4. -SeverabilitY. If any section, subsection, paragraph,
sentence, clause, or phrase of th1s resolution is declared unconst1tut1onal or
invalid for any reason, such decision shall not affect the val1d1ty of the
remammg portions of th1s resolution.
SECTION 5. -Ratification. Any act cons1stent with the authority
and prior to the effective date of this resolution is hereby ratified and
aff1rmed.

SECTION 6. -Effective Date. This resolution shall take effect and
be in force Immediately upon its passage.
PASSED at a regular open public meeting by the City Council of the
City of Kent, Washington, this d./ day of April, 2009.
CONCURRED in by the Mayor of the City of Kent this d-. 1 day of
April, 2009.
