RESOLUTION NO. 1796
A RESOLUTION of the City Council of the
City of Kent, Wash1ngton, declaring 1ts intention to
order the construction of a roadway begmn1ng at the
intersection of East Valley Highway and S. 224th
Street via S. 218th/216th Street, termmat1ng at the
intersection of Benson Road and S. 216th and the
installation of curbs, gutters, Sidewalks, a two-way
left turn lane, planted center medians where
possible, roadside planter strips, street lighting,
undergroundmg of overhead electncal facilities,
storm water management fac111t1es, a bndge over SR
167, a new Garnson Creek bndge, sanitary sewer
and water extensions and/or stubs and
appurtenances to prov1de serv1ce to propert1es not
currently served by City ut11it1es, all relat1ng to the
overall proJect on East Valley H1ghway to the west
and 108th Avenue SE (SR 515, Benson Highway) to
the east; and to create a local Improvement distnct
to assess a part of the cost and expense of carrymg
out those Improvements agamst the properties
specially benefited thereby, and notifying all persons
who des1re to ObJect to the improvements to appear
and present their objections at a hearing before the
City Council to be held on December 9, 2008.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. It is the intention of the City Council of the City of
Kent, Washington, to order the improvement of the properties withm the

area described in Exhibit A, attached hereto and by this reference made a
part hereof, by the construction or mstallat1on of a roadway, including curbs,
gutters, sidewalks, a two-way left turn lane, planted center medians where
possible, roadside planter stnps, street lighting, undergrounding of overhead
electncal facilities, storm water management facilities, a bridge over SR 167,
a new Garrison Creek bridge, sanitary sewer and water extensions and/or
stubs to certain propert1es not served currently by City utilities, all relating
to the overall project from East Valley H1ghway on the west to 108th Avenue
SE (SR 515, Benson Highway) as more fully described in Exhibit B, attached
hereto and by this reference made a part hereof.
All of the foregoing improvements shall be in accordance with the
plans and specifications therefor prepared by the D1rector of Public Works of
the City and may be modified by the City as long as that modification does
not affect the purpose of the improvements.
SECTION 2. The total estimated cost and expense of the
improvements is declared to be $35,100,00.00, approximately
$24,174,095.73 of that cost and expense shall be paid by the City, and the
balance thereof (an estimated $10,925,904.27) shall be borne by and
assessed against the property specially benefited by the Improvements to
be included in a local improvement district to be established embracing as
nearly as practicable all the property spec1ally benefited by the
improvements. Actual assessments may vary from estimated assessments

as long as they do not exceed a figure equal to the increased true and fair
value the improvements add to the property.
SECTION 3. The City Clerk is authorized and directed to give notice
of the adoption of this resolution and of the date, time and place fixed for
the public hearing to each owner or reputed owner of any lot, tract, parcel
of land or other property within the proposed local Improvement district by
mailing such notice at least fifteen days before the date fixed for public
hearing to the owner or reputed owner of the property as shown on the
rolls of the King County Assessor at the address shown thereon, as
required by law.
Th1s resolution also shall be published in its entirety in at least two
consecutive issues of the official newspaper of the City, the date of the first
publication to be at least 15 days pnor to the date fixed for the public
hearing.
SECTION 4. All persons who may desire to comment in support of
or object to the Improvements are notified to appear and present those
comments or obJections at a hearing before the City Council to be held in
the Council Chambers in the City Hall in Kent, Washington, at 7:00p.m. on
December 9, 2008, which time and place are fixed for hearing all matters
relating to the improvements and all comments thereon and objections
thereto and for determining the method of payment for the improvements.
All persons who may desire to obJect thereto should appear and present

their objections at that heanng. Any person who may des1re to f1le a
written protest w1th the City Council may do so withm 30 days after the
date of passage of the ordinance ordenng the Improvements in the event
the local improvement district is formed. The written protest should be
Signed by the property owner and should include the legal descnpt1on of
the property for wh1ch the protest is filed and that protest should be
delivered to the City Clerk.
SECTION 5. The City's Director of Public Works is directed to
submit to the City Council on or pnor to December 9, 2008, all data and
information required by law to be submitted.
Passed at a regular open public meeting by the City Counc1l of the City
of Kent, Washington, th1s 4th day of November, 2008.

Those properties lymg w1thin the City of Kent subJect to a recorded South 224th/228th
Street Corridor (Easterly Section) Environmental M1t1gat1on Agreement lymg w1thm the
boundanes or terntonal extent of Local Improvement Distnct 363. The boundanes or
terntonal extent of Local Improvement Distnct 363 are generally lying South of South
208th/212th Street, East of 68th Avenue South, North of Southeast 256th Street and
West of 140th Avenue Southeast.
A copy of each Environmental Mitigation Agreement has been recorded, and
copies of the Environmental Mitigation Agreements and the legal description
of each parcel are available for inspection and copying at the offices of the
Kent City Clerk, City Hall, 220 4th Avenue South, Kent, Washington and the
Public Works Department, Centennial Building, 400 West Gowe Street, Kent,
Washington.

Description of Improvements
L.I.D 363 -224th Street Project
(East Valley Highway to SR 515)
The overall project limits are East Valley Highway to the west and 108th Ave SE
(SR 515, Benson Highway) to the east. The roadway improvements will be m
accordance with the alternative selected by the City Council dunng the
environmental rev1ew process under the State Environmental Polly Act (SEPA).
The roadway will be in vanous configurations depending on factors such as
environmental constraints, locat1on and traffic capacity: four lanes on the valley
floor at the mtersect1on of East Valley Highway and S. 224th Street; two to four
lanes crossmg over SR 167; three lanes up the Kent East Hill v1a S. 218th/216th
Street; and, four lanes terminatmg at the intersection of Benson Road and S. 216th
Street. The new roadway w1ll be roughly 1.8 miles long, and will mclude curbs,
gutters and sidewalks, a two-way left turn lane, planted center medians where
possible, roadside planter stnps, street lightmg, undergroundmg of overhead
electncal fac111t1es, storm water management facil1t1es, a bndge over SR 167, a new
Garrison Creek bndge and other appurtenances. Sanitary sewer and water
extensions, stubs and other utility appurtenances w1ll be prov1ded where necessary
for properties currently without access to the ut1l1ty systems, to av01d cuttmg the
new road at a later date.

I, the undersigned, City Clerk of the City of Kent, Washmgton (the "City"),
hereby certify as follows:
1. The attached copy of Resolution No./'796 (the "Resolution") is a full, true
and correct copy of an Resolution duly adopted at a regular meetmg of the City
Council of the City held at the regular meeting place thereof on November 4, 2008,
as that Resolution appears on the mmute book of the City; and the Resolution will
be m full force and effect 1mmed1ately following 1ts adoption; and
2. A quorum of the members of the City Council was present throughout the
meeting and a ma]onty of those members present voted in the proper manner for
the adopt1on of the Resolution.
