RESOLUTION NO. /7 73
A RESOLUTION of the City Council of the City of
Kent, Washmgton, authonzmg appl1cat1on to the state
Recreat1on and Conservation Off1ce for fundmg assistance
for a Youth or Community AthletiC Fac1l1ty proJect, as
provided In Ch. 79A.25 RCW.
RECITALS
A. The City of Kent has approved a comprehens1ve plan that Includes the
West Fenwick Park area. Under the Youth or Community Athletic Fac111t1es program
provided for 1n Ch. 79A.25 RCW, state fundmg ass1stance IS requested to a1d 1n
fmancmg the cost of basketball court improvements at West Fenw1ck Park.
B. The City of Kent considers 1t m the best public mterest to complete the
improvement proJect descnbed m the appl1cat1on.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -Application. The Parks, Recreation, and Commun1ty Serv1ces
D1rector IS authonzed to make formal appl1cat1on to the state Recreation and
Conservation Off1ce for fundmg ass1stance.
SECTION 2. -Use of Funds. Any fund assistance rece1ved w1ll be used for the
1mplementat1on of the proJect referenced above and descnbed m the appl1cat1on,
which are improvements to the basketball court at West Fenwick Park.

SECTION 3. -City Funds. The City of Kent cert1f1es that 1ts share of proJeCt
fund1ng 1s comm1tted and will be denved from Real Estate Exc1se Tax Cap1tal Funds.
SECTION 4. -Non-Cash Commitments. The City of Kent acknowledges that it
is responsible for supportmg all non-cash commitments to the sponsor share should
they not matenal1ze;
SECTION 5. -Term to Retam Use. The City of Kent acknowledges that any
fac1l1ty developed w1th fmanc1al a1d obtamed from the state Recreat1on and
Conservation Off1ce must be placed m use as an outdoor recreat1on fac1l1ty and be
reta1ned m such use for a m1n1mum of twenty (20) years from fmal reimbursement,
unless otherw1se prov1ded and agreed to by the City of Kent and the Recreation and
Conservation Off1ce.
SECTION 6. -Resolution to be Part of Application. This resolution becomes
part of the City's formal appl1cat1on to the state Recreat1on and Conservation Off1ce.
SECTION 7. -PubliC Comment. The City of Kent provided appropnate
opportunity for public comment on th1s appl1cat1on at the Parks and Human Serv1ces
Committee meet1ng on November 15, 2007.
SECTION 8. -Severability. If any sect1on, subsect1on, paragraph, sentence,
clause or phrase of th1s resolution IS declared unconst1tut1onal or mval1d for any
reason, such deCISion shall not affect the val1d1ty of the remam1ng port1ons of th1s
resolution.
SECTION 9. -Effective Date. This resolution shall take effect and be m force
immediately upon 1ts passage.
PASSED at a regular open public meet1ng by the City council of the c1ty of Kent,
Washmgton, this II day of December, 2007.
