AN ORDINANCE of the City of Kent, Washington, providing for the purchase and/or condemnation of right of way, permanent slope easements, and temporary construction easements in, over and upon certain land necessary in connection with improvement of S. 212th Street, L.I.D. No. 251, and installation of a sanitary sewer, L.I.D. No. 250, and providing for the payment of said light of way and ease- ments. The City Council of the City of Kent, Washington, do ordain as follows: SECTION I: That the City Attorney for the City of Kent be and he is hereby authorized and directed to purchase and/or institute and prosecute to determination in the Superior Court of the State of Washington, in the County of King, an action in the name of the City of Kent for condemnation and acquisition in fee of right of way, permanent slope easements, and temporary construction easements in, over and upon the following described land, situated in the County of King, State of Washington, for the purpose of obtaining the necessary area for the improvement of S. 212th Street from the Kent City limits (Russell road) to the West Dalley highway and for installation therein of a sanitary sewer, a portion of the "North Sewer System", L.I.D. No. 250, in the City of Kent, to -wit: Parcel A: (Record Owners - Robert Bailey and Rose Bailey) The North 30 feet of the following described property: Beginning at a point which is 11.88 feet West of a stone set for a Northeast corner of the land of Martin Cummings, which said stone is described as being 995.28 feet North and 1320 feet West of the quarter section corner between Sections 11 and 12, Township 22 North, Range 4 East, W.M., in King County, Washington; thence West 895.3 feet to the East line of a ditch right-of-way; thence Northeast along said East line of said ditch right-of-way, 359.2 feet to the South line of the County Road; thence along the said South line of said County Road North 89000' East 285.1 feet; thence South 86045' East 479.5 feet; thence South 298.32 feet to the point of beginning; EXCEPT that portion thereof lying Southerly of a line drawn 300 feet South of and parallel with said County Road. (Also known as 212th Street) Also a 50 feet temporary construction easement for sewer main in- stallation over the South 50 feet of the North 80 feet of the above described property. Also an 80 foot temporary construction easement over that portion of the South 80 feet of the North 120 feet of the above described property lying West of a line extended Southerly at right angles from the centerline of South 212th Street at a point which is Easterly 1750 feet, measured along said centerline, from the Easterly margin of Russell Road. Also a ten foot permanent slope easement for road construction purposes over that portion of the South 10 feet of the North 40 feet of the above described property lying West of a line extended Southerly at right angles from the centerline of South 212th Street at a point which is Easterly 1950 feet, measured along said centerline from the Easterly margin of Russell Road. Parcel B: (Record Owners - Hans Ingemand Burswick) The North 30 feet of the following described property: That portion of Section 11, Township 22 North, Range 4 East, W.M., in King County, Washington, described as follows: Beginning at the intersection of County Road No. 8, with County Road No. 22; thence Easterly along County Road No. 22, 212 feet; thence South 132 feet; thence West 200 feet to said County Road No. 8; thence North 100 feet to place of beginning. Also a 50 foot temporary construction easement for sewer main installation over theSouth 50 feet of the North 80 feet of the above described property. Parcel C: (Record Owners - Gerald L. Miller and Alice 0. Miller, his wife) The North 30 feet of the following d®scribed property: The east 108 feet of the West 278 feet of the North 159 feet of the Southeast quarter of the Northeast quarter of Section 11, Town- ship 22 North, Range 4 East, W.M., in King County, Washington, EXCEPT that portion thereof lying within South 212th Street. Also a 50 foot temporary construction easement for sewer main in- stallation over the South 50 feet of the North 80 feet of the above described property. Parcel D: (Record Owners - Rufino Ordonio and Christina Ordonio) The North 30 feet of the following described property: The East one acre of that portion of the following described premises lying South of theSouth line of South 212th Street, That portion of Government Lots 1 and 2, Section 11, Township 22 North, Range 4 East, W.M., in King County, Washington, lying between the following described boundaries: Beginning at the intersection of the centerlines of State Road No. 5M and the O'Brien Road (South 212th Street) as constructed; thence North 89017'50" West along the centerline of the O'Brien Road, 1012.60 feet to an angle point; thence North 88030'00" West along the centerline of the O'Brien Road 653.11 feet to an angle point; thence North 85000'40" West along the centerline of the O'Brien Road 842.57 feet to an angle point; thence North 88019'50" West along the centerline of the O'Brien Road, 242.67 feet to the point of beginning; thence continuing North 88019'50" West along -2- the centerline of the O'Brien Road, 768.09 feet; thence South 3010'31" West 141.81 feet; thence North 86039142" West 190.95 feet; thence South 15036'58 " West 276.83 feet; thence South 89001'25" East 1032.34 feet; thence North 1015'07" East 392.40 feet to the point of beginning. Also a 50 foot temporary construction easement for sewer main installation over the South 50 feet of the North 80 feet of the above describedopropeuty. Parcel E: (Record Owners - George Sharkey, and Rufino Ordonio and Christina Ordonio, his wife) The North 30 feet of that portion of the following described property which adjoins South 212th Street: That portion of Government Lots 1 and 2, Section 11, Township 22 North, Range 4 East, W.M., in King County, Washington, described as follows: Beginning at the intersection of the centerlines of State Road No. 5M and the O'Brien Road (South 212th Street) as constructed; thence North 89017'50, West along the centerline of the O'Brien Road, 1012.60 feet to an angle point; thence North 88030'00" West along the centerline of the O'Brien;_Road, 242.67 feet to the true point of beginning; thence continuing North 88019'50" West along the centerline cf the O'Brien Road 768.09 feet; thence South 301031" West 141.81 feet; thence North 86039'42" West 190.95 feet; thence South 15036'58" West 276.83 feet; thence South 89001'25" East 1032.34 feet; thence North 1015'07" East 392.40 feet to the true point of beginning; EXCEPT that portion thereof lying within Russell Road and within South 212 Street; and EXCEPT the East 1 acre thereof, as deeded under Auditor's File No. 5027618 Also a 50 foot temporary construction easement for sewer main in- stallation over the South 50 feet of the North 80 feet of theabove described property. Parcel F: (Record Owners - Earl M. McLaughlin and Siri McLaughlin, his wife) The North 30 feet of the following described property: That portion of Government Lots 1 and 2 and the West half of the Northeast quarter of Section 11, Township 22 North, Range 4 East, W.M., in King County, Washington, described as follows: Beginning at a point on the North line of the tract of land con- veyed to Martin Cummings, by deed recorded in Volume 27 of deeds, Page 683, under Auditor's File No. 2058, which point is 11.88 feet West of the stone monument set for Northeast corner of said Cummings Tract; thence West along the North line of said Cumminga Tract 895.3 feet to the Easterly line of drainage ditch right-of-way for the true point of beginning of this description; thence continuing along the North line of said Cummings Tract 532.94 feet, more or less, to a Southeasterly corner of the tract of unci conveyed to Thomas Sharkey Estate, Inc., a Washington Corporation, by deed recorded under Auditor's File No. 2727032; thence North along the boundary of said Sharkey Tract 372.9 feet; thence Easterly along the boundary of said Sharkey Tract 102.96 feet to an angle point in said boundary thence continuing Easterly along sad boundary to its intersection *the centerline of the O'Brien Road, 653.11 feet to an angle point; thence North 85000'40" West along the centerline of the O'Brien Road 842.57 feet to an angle point; thence No5th 88019'50" West along with the said Easterly line of drainage ditch right-of-way; thence Southerly along said Easterly line of drainage ditch right-of-way to the true point of beginning; EXCEPT that portion thereof lying with- in O'Brien Road (South 212th Street), and EXCEPT that portion thereof lying within drainage ditch right-of-way. Also a 50 foot temporary construction easement for sewer main installation over the South 50 feet of the North 80 feet of the above described property. Also an 80 foot temporary street construction easement over that portion of the South 80 feet of the North 120 feet of the above described property lying East of a line extended Southerly at right angles from the centerline of South 212th Street at apoint which is Easterly 1390 feet, measured along said centerline, from the easterly margin of Russell Road. Also a permanent slope easement for street construction over that portion of the South 10 feet of the North 40 feet of the above described property lying East of a line extended Southerly at right angles from the centerline of South 212th Street at a point which is easterly 1350 feet, measured along said centerline, from the Easterly marjn of Russell Road. Parcel G: (Record Owners - Pasquale Picardo, Jr. et al) The North 30 feet of the following described property: That portion of the Southeast quarter of the Northeast quarter of Section 11, Township 22 North, Range 4 East, W.K., in King County, Washington, described as follows: Beginning at the Northwest corner of said subdivision ;thence East along the road on the North boundary thereof, 1267 feet to the North- east corner of said subdivision; thence South along the East boundary thereof, 650.7 feet; thence West 1262.15 feet to the West Boundary of said subdivision; thence North 649.7 feet to the point of beginning; EXCEPT the East 108 feet of the West 278 feet of the North 159 feet thereof; and EXCEPT those portions thereof lying within South 212th Street and 68th Avenue South (Secondary State Highway No. 2M). Also a 50 foot temporary construction easement for sewer main in- stallation over the South 50 feet of the North 80 feet of the above described property. Parcel H: (Record owner - The Boeing Company) The South 30 feet in width of that portion of Section 11, Township 22 North, Range 4 East, W.M., in King County, Washington, lying North of and adjoining the Northerly margin of South 212th Street, as established and used on January 11, 1964, and lying between the Easterly margin of Russell Road and a line extended Northerly at right angles from the centerline of South 212th Street at a point which is easterly 1575.00 feet, measured along said centerline, from the Easterly margin of Russell Road. Also the South 40 feet in width of that portion of said Section 11, lying North of and adjoining the Northerly margin of South 212th Street, as established and used on January 11, 1964, and lying between lines extended Northerly at right angles from the centerline of South 212th Street at points which are Easterly 1575.00 feet, and 1675.00 feet, respectively, measured along said centerline, from the Easterly margin of Russell Road. Ml Also the South 20 feet in width of that portion of said Section 11, lying North of and adjoining the Northerly margin of South 212th street as established and used on January 11, 1964, and lying between a line extended Northerly at right angles from the centerline of South 212th Street at a point which is Easterly 1675.00 feet, measured along said centerline from the Easterly margin of Russell Road, and the Hest line of that,certdn.tract of land conveyed to the State of Washington for highway purposes by deed recorded May 9, 1966 under Auditor's File No. 6025918. Also a permanent slope easement for road construction purposes over the North 20 feet of the South 50 feet of that portion of said Section 11, lying North of and adjoining the Northerly margin of South 212th Street as established and used on January 11, 1964 and lying between the Easterly margin of Russell Road and a line ex- tended Northerly at right a1 gles from the centsrline of South 212th Street, at a point which is Easterly 400 feet, measured along said centerline, from the Easterly margin of Russell Road. SECTION II: That the acquiring of said right of way and easements for the purpose herein mentioned is for a public use and necessity. SECTION III: Payment for the right of way and easements herein described to be acquired shall be made from proceeds of the sale of General Obligation Bonds of the City of Kent, a grant from the Economic Development Administration of the United States Department of Commerce, and assessments against the property specially benefited by the proposed improvements. SECTION IV: Nothing in this Ordinance shall be construed as a waiver by the City of Kent of its right to decline to take and pay for said easements after the amount of damages has been ascertained and within the time allowed by law. SECTION V: This Ordinance shall take effect and be in force from and after its passage, approval and publication as provided by law.
