A RESOLUTION of the City council of the City of
Kent, Washington, relatmg to zon1ng and comprehensive
plan map des1gnat1ons and 1mpos1ng a moratonum on
the f11ing of rezone and other dependent land use
applications for real property w1th smgle-famlly
res1dent1al zomng and/or smgle fam1ly res1dent1al
comprehensive plan map des1gnat1ons that are not of
equal dens1ty or otherw1se do not match (Dkt 2006-4 ).
RECITALS
A. Parcels of real property 1n the c1ty of Kent are g1ven both a zonmg
des1gnat10n and a comprehensive plan map des1gnat1on. In general, these
des1gnat10ns determme the type of land use and the dens1ty of land use to wh1ch
a parcel of property may be developed. There are currently parcels m the c1ty
that have zonmg des1gnat1ons that are not the same dens1ty or do not match w1th
the 1dent1f1ed comprehensive plan map des1gnat1ons. For mstance, a parcel may
have a zon1ng des1gnat1on of S1ngle-Fam1ly Residential, 4.5 un1ts per acre (SR
4.5) and have a comprehensive plan map des1gnat10n w1th a h1gher dens1ty of
Smgle-Famliy Res1dent1al, 8 umts per acre (SF 8). Another parcel may have a
zonmg des1gnat1on of Professional Off1ce (0) and an unmatched comprehensive
plan map des1gnat1on of Smgle-Fam1ly Res1dent1al, 6 umts per acre (SF 6).
B. As part of the c1ty's 2006 annual docket process requ1red by the
Growth Management Act and Chapter 12.02 of the Kent City Code, a study was
proposed that would entail rev1ew of the smgle-fam1ly res1dent1al zon1ng and/or
smgle-fam1ly res1dent1al comprehensive plan map des1gnat1ons that are of unequal
dens1ty or otherw1se do not match (hereafter "Dkt 2006-4"). A publ1c heanng to
rev1ew all 2006 docket 1tems was held by the Land Use and Plannmg Board on
October 23, 2006, after wh1ch the board recommended to the c1ty counc1l that Dkt
2006-4 be mcluded m the annual comprehensive plan amendment process. On

November 20, 2006, the c1ty council's Planning and Economtc Development
Commtttee dtscussed the tssues related to thts docket 1tem and also
recommended mcluston. The ctty counctl constdered the matter on December 12,
2006, and voted to mclude docket ttem Dkt 2006-4 1n the annual comprehenstve
plan amendment process.
C. Whtle the revtew and analysts IS betng done for Dkt 2006-4, 1t IS
probable that the ctty wtll recetve land use appltcattons that would vest
development of parcels to the current zontng and comprehenstve plan map
destgnattons. Thts vest1ng could defeat the purpose of the Dkt 2006-4 study. To
prevent thts result, the ctty counctl IS authonzed by RCWs 36. 70A.390 and
35A.63.220 to adopt moratonums, provtded that a publtc heanng IS held wtthm
stxty (60) days of 1ts adoptton. The ctty counctl finds that 1n thts mstance 1t IS
appropnate to tmpose a moratonum on the ftlmg of rezone and other related land
use appltcattons that would requtre the grantmg of a rezone to effectuate all or
part of the appltcatton bemg ftled. Thts moratonum ts tmposed only on real
property wtth smgle-famtly restdenttal zontng and/or stngle-famtly restdenttal
comprehenstve plan map destgnattons that are not of equal denstty or otherwtse
do not match. Thts moratonum ts necessary unttl addtttonal revtew and analysts
has been completed by staff, the Land Use and Plannmg Board, and the ctty
counctl regardtng Dkt 2006-4.
NOW THEREFORE THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. -ReCitals Incorporated. The recttals set forth m thts
resolutton are hereby mcorporated as tf fully set forth herem.
SECTION 2. -Moratonum. Due to the fmdmgs set forth herem and as
authonzed pursuant to RCWs 36. 70A.390 and 35A.63.220, the Kent Ctty Counctl
does hereby declare a moratonum on the fthng of rezone and other related land
use appltcattons that would requtre the grantmg of a rezone to effectuate all or
part of the appltcatton bemg ftled. Thts moratonum ts tmposed only on real
property wtth smgle-famtly restdenttal zonmg and/or smgle-famtly restdenttal

comprehensive plan map des1gnat1ons that are not of equal dens1ty or otherwise
do not match. The spec1f1c zonmg and correspondmg comprehensive plan map
des1gnat10ns affected by th1s moratonum are 1dent1f1ed m Exh1b1t "A," attached
and mcorporated by th1s reference. Th1s moratonum shall not apply to any
appl1cat1on for a land use perm1t or approval wh1ch has vested by the effective
date of th1s moratonum.
SECTION 3. -Duration. The moratonum established herem IS established
for a penod of SIX (6) months from the effect1ve date of th1s resolution, subject to
extensions or earl1er termmat1on by subsequent counc1l act1on.
SECTION 4. -Public Heannq. Pursuant to RCWs 36.70A.390 and
35A.63.220, the c1ty council shall hold a publ1c heanng on th1s moratonum w1thm
s1xty (60) days of 1ts adopt1on. Immediately after the publ1c heanng, the c1ty
counc1l shall adopt fmd1ngs of fact on the subject of th1s moratonum, e1ther
jUStlfymg 1ts contmued 1mpos1t1on or cancelmg the moratonum.
SECTION 5. -Severability. If any section, subsection, paragraph,
sentence, clause, or phrase of th1s resolution IS declared unconst1tut1onal or
mval1d for any reason, such dec1s1on shall not affect the val1d1ty of the rema1nmg
port1ons of th1s resolution.
SECTION 6. -Ratification. Any act consistent w1th the authonty and prior
to the effective date of th1s resolution IS hereby rat1f1ed and aff1rmed.

SECTION 7. -Effective Date. Th1s resolution shall take effect and be in
force 1mmed1ately upon 1ts passage.
PASSED at a regular open public meetmg by the c1ty council of the c1ty of
Kent, Washmgton, th1s /~ day of December, 2006.
CONCURRED 1n by the mayor of the c1ty of Kent th1s I 77-day of
December, 2006.
