RECITALS A. A pet1t1on, attached as Exh1b1t A, has been f1led to vacate the south 120 feet of the alley 1n Block 3, Washmgton Central Improvement Company Knob H1ll Add1t1on 1n the City of Kent, Washington. B. The pet1t1on IS s1gned by the owners of at least two-th1rds of the real property abuttmg the south 120 feet of the alley 1n Block 3, Washmgton Central Improvement Company Knob H1ll Add1t1on of the alley to be vacated. C. The pet1t1on IS 1n all respects proper. NOW THEREFORE, THE CilY COUNCIL OF THE CilY OF KENT, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: RESOLUTION SECTION 1. -Publtc Hearing. A publ1c hearmg on the street vacation pet1t1on request1ng the vacat1on of the south 120 feet of the alley 1n Block 3, Washmgton Central Improvement Company Knob H1ll Add1t1on, located 1n Kent, Washington, shall be held at a regular meettng of the Kent City Council at 7:00 p.m., Tuesday, December 12, 2006, 1n the Council Chambers of City Hall located at 220 4th Avenue South, Kent, Washington, 98032. 1 South 120' -Block 3- A//ey Vacation SECTION 2. -Notice. The City Clerk shall g1ve proper not1ce of the heanng and cause the not1ce to be posted as provided by state law, Chapter 35.79 RCW. SECTION 3. -Informatton. The Plannmg Manager shall obtam any other necessary mformat1on from appropnate departments and shall transmit the 1nformat1on to the CounCil so that the CounCil may consider the matter at 1ts regularly scheduled meet1ng on December 12, 2006. SECTION 4. -Severabt!ttv. If any sect1on, subsection, paragraph, sentence, clause or phrase of th1s resolution IS declared unconst1tut1onal or mval1d for any reason, such dec1s1on shall not affect the validity of the remammg port1ons of th1s resolut1on. SECTION 5. -RattficattOn. Any act cons1stent w1th the authonty and pr1or to the effective date of th1s resolution IS hereby rat1f1ed and affirmed. SECTION 6. -Effective Date. This resolution shall take effect and be in force 1mmed1ately upon 1ts passage.
