RECITALS A. King County has increased its 2005 rate for sewage treatment, including applicable utility tax, by $2.44 per month per residential equivalent (750 cubic feet of sewage). Additionally, King County plans additional increases in 2007 of $3.13, in 2008 of $3.14, and in 2009 of $2.84. Moreover, the City has identified immediate infrastructure replacement needs of over $6,500,000 in excess of its regular projected annual maintenance, operation, and replacement cost needs that normally arise as the system ages. Taken together, these factors increase the costs to supply safe and sanitary sewer service to our community and thus require that the City's sewer service charges be increased. B. The Operations Committee has recommended that these increases, including applicable utility tax, be passed along to the City's customers. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: ORDINANCE SECTION 1. - Amendment Section 7.04.280 of the Kent City Code amended as follows: Sec. 7.04.280. Schedule of charges for service . The following sanitary sewer service charges for service inside the City limits are in effect on the dates and in the amounts listed below.. Sewer service charges for customers residing outside the City shall be the charges as on file in the City Clerk's Office. The adjusted fees are for services beginning January 1, 2005, which shall apply retroactively to January 1, 2005 on the effective date of this ordinance. SECTION 4. — Severabdity If any one or more section, subsections, sentences of this ordinance are held to be unconstitutional or invalid, such decision] shall not affect the validity of the remaining portion of this ordinance and the same shall remain in full force and effect.
