ORDINANCE NO. 31°75
AN ORDINANCE of the City Council of the City
of Kent, Washington, amending Section 12.13.160 of the
Kent City Code to amend the school impact fee schedule
(CPA -2003-3).
WHEREAS, the City of Kent adopted a school impact fee program as
authorized by the Growth Management Act and RCW 82.02.050; and
WHEREAS, chapter 12.13.070 of the Kent City Code requires that the
Capital Facilities Plans of the school districts be submitted to the City of Kent on an
annual basis for City Council review, and that such review shall occur in conjunction
with any update of the Capital Facilities Element ofthe City's Comprehensive Plan; and
WHEREAS, the Kent and Federal Way School Districts have requested
amendments to the text of the Comprehensive Plan to reflect proposed changes to
impact fees; and
WHEREAS, the Auburn School District has submitted its Capital
Facilities Plan to the City for the first time to be included in an amendment of the City's
Capital Facilities Element of the Comprehensive Plan; and
WHEREAS, on August 20, 2003, the City provided the required sixty
(60) day notification under RCW 36.70A.106 to the state of Washington of the City's
proposed amendment to the Capital Facilities Element of the Comprehensive Plan; and

WHEREAS, the sixty (60) day notice period has lapsed; and
WHEREAS, after a public hearing before the City Council on September
16, 2003, the City Council on December 9, 2003, approved Comprehensive Plan
Amendment CPA -2003-3 to include the Capital Facilities Plans of the Kent, Federal
Way, and Auburn School Districts, which include changes in proposed impact fees as
follows: Federal Way School District decrease to $3,269.00 for single-family and
decrease to $940.00 for multifamily units; Kent School District increase to $4,292.00
for single-family and increase to $2,643.00 for multifamily; and Auburn School District
establish $4,528.00 for single-family and $1,212.00 for multifamily; and
WHEREAS, it is necessary to amend section 12.13.160 of the Kent City
Code to reflect the Comprehensive Plan amendment that established a new base fee
schedule for the Federal Way School District of $3,269.00 for single-family and
$940.00 for multifamily units; for the Kent School District of $4,292.00 for single-
family and $2,643.00 for multifamily; and for the Auburn School District of $4,528.00
for single-family and $1,212.00 for multifamily; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON,
SECTION I. -Amendment. Section 12.13.160 of the Kent City Code is
hereby amended as follows:
Sec. 12.13.160. Base fee schedule. The following fee shall be assessed for the
indicated types of development:

SECTION2. - Severability. If anyone or more sections, subsections, or
sentences of this Ordinance are held to be unconstitutional or invalid, such decision
shall not affect the validity of the remaining portion of this Ordinance and the same
shall remain in full force and effect.
SECTION 3. -Effective Date. This Ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval and publication as provided
by law.
