HomeMy WebLinkAbout3674ORDINANCE NO. 34 77 AN ORDINANCE of the City Council of the City of Kent, Washington, amending the City of Kent Comprehensive Plan to amend the Capital Facilities Element of the Comprehensive Plan to include the Capital Facilities Plans of the Kent, Federal Way, and Auburn School Districts (CPA -2003-3). WHEREAS, the Washington State Growth Management Act ("GMA") requires internal consistency among comprehensive plan elements and the plans from other jurisdictions; and WHEREAS, to assure that comprehensive plans remain relevant and up to date, the GMA allows amendments to the capital facilities element of comprehensive plans concurrently with the adoption or amendment of a city budget (RCW 36.70A.130(2)(iii)); and WHEREAS, the City of Kent has established procedures for amending the Comprehensive Plan in chapter 12.02 of the Kent City Code, allowing amendment of the Capital Facilities Element of the Comprehensive Plan concurrently with the adoption or amendment of the City budget and allowing the City Council to hold the public hearing instead of the Land Use and Planning Board; and WHEREAS, the Kent and Federal Way School Districts have submitted proposed amendments to their Capital Facilities Plans to be included in an amendment of the City's Capital Facilities Element of the Comprehensive Plan; and Comprehensive Plan Amendments School Districts' Capital Facilities Plans WHEREAS, the Auburn School District has submitted its Capital Facilities Plan to the City for the first time to be included in an amendment of the City's Capital Facilities Element of the Comprehensive Plan; and WHEREAS, after providing appropriate public notice, the City Council of the City of Kent considered the requested comprehensive plan amendment and conducted a public hearing on the same on September 16, 2003; and WHEREAS, on August 20, 2003, the City provided the required sixty (60) day notification under RCW 36.70A.106 to the state of Washington of the City's proposed amendment to the Capital Facilities Element of the Comprehensive Plan; and WHEREAS, the sixty (60) day notice period has lapsed; and WHEREAS, on December 9, 2003, the City Council for the City of Kent approved the Capital Facilities Element amendment CPA -2003-3 to include the Capital Facilities Plans of the Kent, Federal Way, and Auburn School Districts, as set forth in Exhibit "A" attached and incorporated by this reference (CPA -2003-3); NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: SECTIONI. -Amendment. The Capital Facilities Element ofthe City of Kent Comprehensive Plan is hereby amended to include the Capital Facilities Plans of the Kent, Federal Way, and Auburn School Districts, as set forth in Exhibit "A" attached and incorporated by this reference (CPA -2003-3). 2 Comprehensive Plan Amendments School Districts' Capital Facilities Plans SECTIONZ - Severability. If any one or more sections, sub -sections, or sentences of this Ordinance are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Ordinance and the same shall remain in full force and effect. SECTION3. - ff ective Date. This Ordinance shall take effect and be in force thirty (30) days from and after the date of passage as provided by n 1.0? 14.
