AN ORDINANCE of the City Council of the City of
Kent, Washington, annexing certain territory along 277`h
Street to the City of Kent, Washington, for municipal
purposes.
WHEREAS, RCW 35A.14.300 authorizes the Legislative body of
Municipal Code Cities, by majority vote, to annex certain territory outside its city limits,
whether contiguous or non-contiguous, for municipal purposes, when such territory is
owned by the City; and
WHEREAS, the City of Kent owns two (2) parcels of real property,
approximately 9.53 acres in size, which are legally described in Exhibit A attached and
incorporated by this reference, and which are not contiguous to the existing territorial
limits of the City of Kent; and
WHEREAS, the City of Kent's Public Works Department is using these
parcels as a portion of the City's South 277`h Street right-of-way and road expansion; and
WHEREAS, a Notice of Intent was filed with the King County Boundary
Review Board (`BRB") effective July 13, 2003, and the BRB deemed the proposed
annexation effective September 16, 2003; and

WHEREAS, it is in the best interest and benefit to the public, and in
particular the citizens of Kent, to annex these parcels of real property for municipal
purposes; and
WHEREAS, it appears to the City of Kent that said annexation meets the
requirement specified by law, that such land is owned by the City of Kent, and such land
will be used for municipal purposes; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. — Findings. The above-mentioned findings and recitals are
found to be true and correct in all respects.
SECTION 2. — Annexation. The real property described in Exhibit A,
which is attached and incorporated by this reference, is hereby annexed to the City of
Kent.
SECTION 3. — Certified copies. The City Clerk shall transmit a certified
copy of this ordinance along with a signed annexation certificate to the Washington State
Office of Financial Management (OFM), King County, the King County Boundary Review
Board, and the City of Auburn, Washington.
SECTION 4. — Severability. If any one or more section, subsections, or
sentences of this Ordinance are held to be unconstitutional or invalid, such decision shall
not affect the validity of the remaining portion of this ordinance and the same shall remain
in full force and effect.

SECTION 5. — Effective Date. This ordinance shall take effect and be in
force five (5) days after publication as provided by law.
