A RESOLUTION of the city councli of the city of
Kent, Washington, declanng Its mtent10n to order the
constructiOn of an 8" sanitary sewer system With 6" side
sewer stubs to the right of way !me or easement line and to
create a local Improvement d!stnct to assess a part of the cost
and expense of carrymg out those Improvements agamst the
properties specmlly benefited thereby, and notifying all
persons who desrre to object to the Improvements to appear
and present their objections at a heanng before the city
counCil to be held on July 15, 2003.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. It IS the mtention of the city councli of the city of Kent,
Washmgton, to order the Improvement of the properties within the area descnbed m
Exhibit A, attached hereto and by this reference made a part hereof, by the constructiOn
of an 8" sanitary sewer system with 6" side sewer stubs to the nght of way hne or
easement hne, as more fully descnbed m Exhibit B, attached hereto and by this reference
made a part hereof.
All of the foregoing Improvements shall be m accordance With the plans and
specificatiOns therefor prepared by the director of pubhc works of the City and may be
modified by the city as long as that modificatiOn does not affect the purpose of the
Improvements
SECTION 2. The total estimated cost and expense of the Improvements IS
declared to be $819,270 and approximately $60,405 of that cost and expense shall be pmd
by the City and the balance thereof (an estimated $758,866) shall be borne by and
assessed agamst the property specially benefited by the Improvements to be mcluded m a
local Improvement d1stnct to be established embracmg as nearly as practicable all the
property specmlly benefited by the Improvements Actual assessments may vary from
estimated assessments as long as they do not exceed a figure equal to the mcreased true
and fa1r value the Improvements add to the property.
SECTION 3. The c1ty clerk is authonzed and directed to g1ve notice of
the adoptwn of tins resolutiOn and of the date, t1me, and place fixed for the public hearmg
to each owner or reputed owner of any lot, tract, parcel of land, or other property w1thm
the proposed local1mprovement d1stnct by ma1lmg such not1ce at least fifteen (15) days
before the date fixed for public hearing to the owner or reputed owner of the property as
shown on the rolls of the Kmg County Assessor at the address shown thereon, as reqmred
by law The c1ty clerk also 1s authonzed and d1rected to g1ve notice of the adoptwn of
th1s resolutwn and of the date, time, and place fixed for the public heanng to each owner
or reputed owner of any lot, tract, parcel, of land or other property outside of the
proposed local Improvement d1stnct that IS reqmred by the Federal Housmg
Admm1strat1on as a condition of loan qualificatiOn to be connected to the proposed
Improvements, by mailmg such not1ce at least fifteen (15)days before the date fixed for
the pubhc heanng to the owner or reputed owner of the property as shown on the rolls of
the County Assessor at the address shown thereon, as required by law
Tins resolutiOn also shall be published m Its entirety m at least two
consecutive 1ssues of the offic1al newspaper of the c1ty, the date of the first publicatiOn to be
at least fifteen (15) days pnor to the date fixed for the public heanng

SECTION 4. All persons who may desire to comment m support of or
object to the Improvements are notified to appear and present those comments or
objectiOns at a hearing before the city council to be held in the council chambers in the
C1ty Hall m Kent. Washmgton, at 7 00 p m. on July 15, 2003, which time and place are
fixed for heanng all matters relatmg to the Improvements and all comments thereon and
objectiOns thereto and for determirung the method of payment for the Improvements All
persons who may desire to object thereto should appear and present their objections at
that heanng Any person who may desire to file a wntten protest with the city council
may do so w1thm th1rty (30) days after the date of passage of the ordmance ordering the
Improvements m the event the local rmprovement d1stnct IS formed The wntten protest
should be signed by the property owner and should mclude the legal descnptwn of the
property for which the protest IS filed and that protest should be delivered to the city
clerk
SECTION 5. The city's director of public works IS directed to subm1t to
the city council on or pnor to July 15, 2003, all data and mformat10n reqmred by law to
be subm1tted
SECTION 6. If any sectiOn, subsection, paragraph, sentence, clause, or
phrase of this resolutiOn 1s declared unconstitutiOnal or invalid for any reason, such
deciSion shall not affect the validity of the remammg portiOns of th1s resolution.
SECTION 7. Any act consistent w1th the authonty and prior to the
effective date of tlus resolutiOn 1s hereby ratified and affirmed.

SECTION 8. This resolutiOn shall take effect and be m force mnned1ately
upon Its passage
