ORDINANCE NO. -3/0 33
AN ORDINANCE of the City Council of the city
of Kent, Washington, repealing Ordinance 3624
regarding the modification of master planned
developments located in commercial, office, and
manufacturing zones
WHEREAS, on October 15, 2002, the Kent City Council adopted
Ordinance No. 3624, effective on November 14, 2002, which adopted an amendment
to Kent City Code subsection 15 08 400(I) as follows
and
I. Modifications of plan Requests for modifications of final
approved plans shall be made in writing and shall be submitted to the
planning services office departmet-A—m the manner and form
prescribed by the planning manager. In commercial, office, and
manufacturing zones, determination of minor and mWor
modifications in master plans consistent with a planned action
ordinance and development agreement shall be made at the sole
discretion of the planning manager. Criteria for determining minor
and major modifications in all other cases shall be as stated in
subsection I_(1) and I(2) below The criteria for approval of a request
for a major modification shall be those criteria covering original
approval of the permit which is the subject of the proposed
modification,
WHEREAS, prior to the final adoption of Ordinance No 3624, a
notice had not been sent to the state of Washington Department of Community
Development in accord with RCW 36 70A 106, and

WHEREAS, the Kent City Council seeks to repeal Ordinance No
3624, so that the appropriate notice can be sent to the state of Washington
Department of Community Development prior to final adoption of the Ordinance,
NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS
SECTION 1. Ordinance No. 3624 is hereby repealed in its entirety.
SECTION 2. The planning manager is directed to send the necessary
notice to the state of Washington Department of Community Development in accord
with RCW 36 70A 106 as soon as possible so that the matter may be brought before
Council again in a timely manner
SECTION 3. If any one or more section, subsections, or sentences of
this Ordinance are held to be unconstitutional or invalid, such decision shall not
affect the validity of the remaining portion of this ordinance and the same shall
remain in full force and effect.
SECTION 4. This Ordinance shall take effect and be in force five (5)
days from and after passage and publication as provided by law.
