HomeMy WebLinkAbout3587Ordinance No. 3587 ["Beginning July 1, 1998"] (Amending or Repealing Ordinances) Amends Sec. 4.01.170 & Repeals Sec. 4.01.180 of Ords. 2567 & 2794 (old Secs. 2.30 & 2.30.209 & 2.30.213) ORDINANCE NO. 3 X87 AN ORDINANCE of the City Council of the City of Kent, Washington, repeating Section 4 01 180 of the Kent City Code relating to meetings or the distribution of literature on park properties and amending Section 4 01 170 of the Kent City Code relating to permitted and scheduled activities WHEREAS, City of Kent park properties have historically been considered a public forum, and WHEREAS, governmental regulation of speech occurring in City parks must be content -neutral, serve a compelling governmental interest, and leave open alternative channels of communication, and WHEREAS, the enforcement of Section 4 01 180 of the Kent City Code may result in an unreasonable restriction on free speech, and WHEREAS, amendment of Section 4 01 170 of the Kent City Code will assist in clarifying that users of City parks shall not unreasonably interfere with others use of the park facilities, NOW THEREFORE, 1 Meetings THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS SECTION 1. Section 401 170 of the Kent City Code, entitled "Permitted and scheduled activities — Rules," is hereby amended to read as follows Sec. 4.01.170. Permitted and scheduled activities — Rules. Permits and schedules, officially issued or distributed by the director of the parks and recreation department, shall have priority over other activities Participants shall yield to the holder of such permit or schedule Participants with or without a permit or schedule shall abide by all rules and regulations,—and shall not unreasonably interfere with other persons' use of or the City's maintenance or operation of City park facilities A copy of all rules and regulations are filed with the city clerk SECTION Z Section 401 180 of the Kent City Code, entitled "Meetings," is hereby repealed in its entirety SECTION 3 — Severability If any one or more section, subsections, or sentences of this Ordinance are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this ordinance and the same shall remain in full force and effect SECTION 4 — Effectzve Date This ordinance shall take effect and be in force thirty (30) days from and after passage, as provided by 1 •C 2 Meetings ATTEST - BRENDA JACOBER, TY CLERK APPROVED AS TO FORM LUBOVICH, PASSED day of APPROVED / 5 day of PUBLISHED 9 day of - 2002 2002 2002 I hereby certify that this is a true copy of Ordinance No -3-597 passed by the City Council of the City of Kent, Washington, and approved by the Mayor of the City of Kent as hereon indicated 1V&m (SEAL) BRENDA JACO , CITY CLERK 3 Meetings
