An Ordinanoe granting to the SUNSET TELEPHONE d TELEGRAPH COMPANY, its successors and assigns, the right to place, erect and maintain poles, wires and other appliances and conductors and to lay underground conductors tbr wires for the transmission of electri- city for telephone and telegraph purposes, in, upon and under the streets, alleys, avenues and thoroughfares and patblic highways in the Town of Kent, King County, Washington, and to exercise the privi- lege of operating telephone and telegraph inst"ents, and of doing a telephone and telegraph busibess within said Town - The Torn of Kent does ordain as follows: SECTION 1. The Town of Kent hereby grants to the SUNSET TELE) PHONE AND TELEGRAPH COMPANY, its successors and assigns, the right and privilege to do a telephone and telegraph business within said Tose, and to place, erect, lay maintain and operate in anis under the streets, alleys, avenues, thoroughfares and public highways within said Town, poles, wires and other appliances and conductors for the x transmission of electricity for telephone and telomra h puz oseV ever such wires or conductors may be strung upon poles or other fix t s Ids above ground, or at the option of the said grantee, its sucoessors and assigns, may be laid underground in pipes or conduits or other- w1se protected and suoh other apparatus may be used as may be nec- essary or proper to operate and maintain the same. SECTION 2. It shall be lawful for the SUNSET TELEPHONE AND TELE - IBM COIWAXY, its suooessors and assigns, to make all needful excava- tions in azW of said streets, alloys, avenues, thoroughfares and public highways in said Town of Kent for the purpose of placing, erecting, lay ing and maintaining poles or other supports or conductors for sai ld wires .or for repairing, renewing or replacing the same. Said wo* shall be done in compliance with the necessary rules, regulations, ordinanc- es or orders, which may during the continuance of this franchkee-be (1) adopted from time to time by the Toln of Kent, King C aunty # 'Wast SECTION S. Whenever the said SUNSET TIMEPHONE AND TELEGRAPH COMPANY, its successors and assigns, shall disturb any of such streets for trispu rp oses aforesaid, it or they sha U restore the Deme to good order and condition as soon as praeticable without any Vaneoessary 60 - lay, and failing to do so, the Town of Kent shall have the right to fix a reasonable time within which such repairs and restoration of streets shall be cooploted, and upon failure of such repairs being made by the SUNSET TELEPHONE & TELEGRAPH COMPAIiY, its successors and assigns, the Town of Kent 411811 cause saah repairs to be us &* at the expense of %rA SUNSET TMjpgCXX & TMLEGRAP$ CSOMPANY, its wuooessors and assigns. SECTION 4. nothing in this Ordinance shall be agnstrued in SAY way to prevent the proper authorities of the Town of Kent tram saser- ing, grading,, planking, repairing or altering any of the streets here• in mentioned, but all such repairs and Rork shall be done, if pa"i- ble, so as not to obstruct or prevent the free use of said poles, wires, conductors, conduits, pipes or other apparatus. SECTION b. In consideration of the rights and privileges hereby granted, the Toon of Kent shall bav• , and the SUNSET TBLEPROW AND TMZGRAPHCOMPANY hereby grants to it the right pfd privilege to sus- pend and maintain upon the poles placed by said grantee, its su0ee83- ors and arsUnst lathe streets and thoroaghfarea aforesaid, or it said wires are placed tinderground, to place f nd saintain in the aosAUits of said grantee, any and all wires which said Tarn of Kent my require for fire alarm and Pekoe telegrapli purposes free of charge to said 6 Town', SECTION ��.� The rights, privileges and franchises herein granted shall continue and be in force for a period of Zy -Le years from the data of the passage of this Ordinance.
