ORDINANCE NO.
An Ordinance granting to Jim's Garbage
Disposal a franchise to collect and
dic-pose of garbage for a period of five (5)
years from the 20th day of March, 1958,
in that portion of the City of Kent annexed
by Ordinance No. 971 of said City.

WHEREAS, Jim's Garbage Disposal of Renton, Washington, was
upon the 20th day of Mar6h, 1958, the holder of Washington State
permit No. 11175 for the collection and disposal of garbage in
Kinv County, Washington, in certain areas contiguous to the City
of Kent; and
WHEREAS, by ordinance No. 971 of the City of Kent, passed
on the 17th day of February, 1958, and approved by the Mayor on
the 18th day of February, 1958, the City of Kent annexed certain
lands contiguous thereto and included in the permit No. 11175
of Jim's Garbage Disposal, said lands so annexed being described
as follows:
Shinn's Cloverdale Addition to Kent, as per plat
recorded in Volume 6 of Plats, page 52, situated in
King County, Washington,
ALSO the northwest quarter of section 7, township 22 north,
range 5 east W.M., situated in King County, Washington,
ALSO P.S.H. 5 adjacent on the west and any other streets
included within the body of the annexation but not specifically
mentioned,

WHEREAS,
under the terms of Section 1
of Chapter 282, of the
20
Laws of the
State of Washington of 1957
(R.C.W.35.13.280) the

said permit
was cancelled in so far as the
annexed area was
22

on the effective date of the
annexation, to -wit,

the 20th day of March, 1958; and

WHEREAS,
the City does not desire to
purchase or condemn
25
the said permit
rights of the said Jim's
Garbage Disposal in

the area so
annexed; and

WHEREAS,
under the said Section 1 of
Chapter 282, of the
28
Laws of the
State of Washington of 1957,
the City must grant
29
a franchise
to continue the garl09% collection
and disposal

business within
the annexed territory for
a term of not less than
31
five years;

1 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
2 CITY OF KENT as follows:
3 Section 1, That Jim's Garbage Disposal of Renton, Washington,
4 is hereby authorized to continue for a period of five years from
5 March 20, 1958, the collection anddisposal of garbage within 'the
8 following described portion of the City of Kent, to -wit:
7 Shinn's Cloverdale Additionto Kent, as per plat
recorded in Volume 6 of Plats, page 52, situated in
8 King County, Washington,
ALSO the northwest quarter of section 7, township 22 north.,
9 range 5 east W.M., situated in King County, Washington,
ALSO P.S.H. 5 adjacent on the west and any other streets
10 included within the body of the annexation but not specifically
mentioned.

Sectinn 2. That the City of Kent shall not by franchise,
12
permit or public operation, extend similar or competing services
13
to the described territory of the City, provided, however, that
14
nothing herein contained shall prevent the City from granting a
15
similar franchise to any other person, firm or corporation, holding
18
state or county permit for the same area, on the 20th day of
17
March, 1958, and provided further that the City of Kent shall
18
have a right to extend similar or competing services to the
19
annexed territory by franchise, permit or public operation, upon
20
a proper showing of the inability or refusal of J m!';.so�arbagq

at a reasonable price.

Section 3. This ordinance shall take effect and be in force

five (5) days after its passage, approval and publication, as by
