2 AN ORDINANCE of the City of Kent, Washington,
establishing a procedure -to process applications
3 for segregation of spepial assessments against
tracts of land located within the City of Kent,
4 Washington.

THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
6
ORDAIN AS FOLLOWS:

Section 1. Whenever any land, against which there has
8
been levied any special assessment by the City of Kent, Washington,
8
shall have been sold in part or sub -divided, the City Council of
10
the City of Kent, Washington, shall have the power to order a
11
12 segregation of such an assessment.
Section 2. Any person desiring to have such a special
13
14 assessment against a tract of land segregated to apply to smaller
15 parts thereof, shall apply to the City Council of the City of Kent.
Section 3. If the City Council of the City of Kent,
16
thereafter determines that segregation should be made, it shall by
17
Resolution order the City Treasurer to make segregation on the
18
18 original assessment roll as directed in the Resolution.
Section 4. Such a segregation shall be made as nearly as
20
21 possible on the same basis as the original assessment was levied
and the total of the segregated parts of the assessment shall
22
23 equal the assessment before segregation. The Resolution shall
24 describe the original tract, the amount, and the date of the
25 original assessment and shall define the boundaries of the divided
26 parts and the amount of the assessment chargeable to each part.
Section 5. A certified copy of said Resolution shall

be delivered to the Kent City Treasurer, who shall proceed to
28
28 make the segregation ordered,upon being tendered a fee of
Ten Dollars ($10.00) for each tract of land for which a segrega-
30
tion is to be made.

Section 6. In addition to such .charge of Ten Dollars
32
1 ($10.00), as aforesaid, the City Council may require as a condition
2 to the order of segregation, that the person seeking it pay the
3 City of Kent the reasonable engineering and clerical costs :'inci-
4 dent to making the segregation.
5 Section 7. No segregation need be made if the Kent City
6 Council shall find that by such segregation the security of the
7 lien for such assessment would be so jeopardized as to reduce the
8 security for any outstanding local improvement district obligations
8 payable from such assessment.
10 Section 8. This Ordinance shall take effect and be in
11 force five (5) days from and after its passage, approval and
12 publication as provided by law.
